Backeround: On February 2, 2009, the Mayor and Common Council approved a new fee for the Fire Department to start charging insurance companies for hazardous spills resulting from traffic collisions. The fee is to recover costs for actions taken at traffic collisions that leave hazardous materials on public right of ways. These hazardous materials include gasoline, diesel, hydraulic fluid, radiator fluid, lubricants, and battery acid. During these incidents, fire personnel contain and remove spilled material from the accident site, and secure the vehicle(s) in preparation for towing so that no further release of harmful materials will occur. The Fire Department estimated that the fee to be charge per incident is $291 per hour. The recommended fee was proposed based on a single responding unit with four fire personnel responding to the traffic collisions with motor vehicle fluid spills, see attachment A. However, the number of apparatus and personnel responding to each incident can vary. The number of apparatus responding is determined on the severity of the incident and the nearest apparatus available in the city's responding jurisdiction. For example, if a commercial vehicle or multiple vehicles are involved, it may require more than one engine, truck, or paramedic squad respond to the incident. Each of these resources may be staffed with a different number of personnel, and these personnel may ultimately be involved in the cleanup. Therefore, we are requesting that the language establishing the fee be amended to reflect the potential total cost per incident based on the number of fire personnel and apparatus responding. The following is the current established service fee: Hazardous Material Spill incident $291.00 per hour The following is the proposed revision to the service fee: Hazardous Material Spill incident up to $291.00 per hour per incident for each responding fire department apparatus Financial Impact: The current established service fee was based on a single, 4 person engine response, for a minimum of a one hour with a stipulation to charge $43.50 for every additional 15 minutes for the incident. With amending the language, the city will be authorized to charge up to $291 per responding unit that is involved with the cleanup, which includes the cost of personnel assigned to that unit. Recommendation: Adopt resolution. 1 RESOLUTION NO. Resolution No. 2009-122, adopted by the Mayor and Common Council 8 on May 18, 2009 establishing a new master fee schedule (marked Attachment A) for city-wide 9 user fees is hereby amended to revise Part IX: Fire Department 10 SECTION 2. Resolution #2009-122, Part IX: Fire Department is hereby amended to 11 add Section 11 as follows: 12 13 "Section 11: The following fee is hereby established for response services at a ,;' 14 traffic incident that involves hazardous substances that spill onto public right of ways, streets, I, � 15 and highways of the City of San Bernardino jurisdiction by billing the insurance company. 16 A.
