Subject:
Resolution adopting the 6-year Capital Improvement Program (2009-2015) for Measure I Local
Expenditures.
Background:
In November 1989, voters approved Measure I authorizing San Bernardino Associated
Governments (SANBAG), acting as the Transportation Authority, to impose a one-half of one-
percent retail transaction and use-tax applicable throughout the county for a period of 20 years
beginning Apri l 1, 1990 and extending to March 31, 2010. This tax is commonly known as the
-cent sales tax. In November of 2004, voters approved an extension of the %2-cent sales tax for
an additional 30 years from April 1, 2010, extending it to March 31, 2040. In order to
distinguish the two programs, they are now being referenced as Measure I 1990-2010 and
Measure 12010-2040.
This %-cent sales tax can only be used for transportation improvements and traffic management
programs authorized in the expenditure plans set forth in Ordinance No. 89-1 of the
Transportation Authority.
The referenced ordinance requires each local agency to expend funds based on a 5-year Measure
I Capital Improvement Program (CIP) and a 20-year Measure I Transportation Plan adopted by
resolution. The 5-year Measure I Capital Improvement Program only relates to the expenditure
of Measure I funds and each agency is required to update the program annually. The 20-year
Measure I Transportation Plan is only required to be amended if it changes.
Since the Measure I 1990-2010 program will expire on March 31, 2010, SANBAG is allowing
jurisdictions to submit a 6-year Measure I Capital Improvement Program covering the final year
of Measure 11990-20 10 and the first five years of Measure 12010-2040.
The proposed 6-year Measure I CIP (Exhibit "A") is based upon the City's current 5-Year CIP,
which was approved on June 23, 2009. The sixth year was developed to be consistent with the
previous years.
The City is committed to expend funds in accordance with the first year of the plan. The second
through sixth year are estimates for planning purposes and the City is not committed to expend
the funds in accordance with those estimates. Changes to the program during the year are
permitted subject to approval of Amendments to the plan by resolution of the Mayor and
Common Council.
This year, SANBAG is again requiring cities to provide an "Expenditure Strategy" statement.
Attached is a copy of the proposed statement (see Exhibit `B") for this year. SANBAG has
requested that each agency's Measure I CIP and Expenditure Strategy be submitted no later than
the month of October.

WHEREAS, San Bernardino County voters approved passage of Measure"I" (hereinafter
5 known as Measure I 1990-2010) in November 1989, authorizing San Bernardino Associated
6 Governments (SANBAG), acting as the San Bernardino County Transportation Authority, to
impose a one-half of one percent retail transactions and use tax applicable in the incorporated
7 and unincorporated territory of the County of San Bernardino beginning April 1, 1990 and
ending March 31, 2010; and,

WHEREAS, San Bernardino County voters approved passage of Measure "I" (hereinafter
9 known as Measure 12010-2040) in November 2004, authorizing SANBAG, acting as the San
10 Bernardino County Transportation Authority, to impose a one-half of one percent retail
transactions and use tax applicable in the incorporated and unincorporated territory of the County
11 of San Bernardino beginning April 1, 2010 and ending March 31, 2040; and,
12 WHEREAS, revenue from the tax can only be used for transportation improvements and
traffic management programs authorized in the Expenditure Plans set forth in Ordinance Nos.
13 89-01 and 04-1 of the Authority; and,

WHEREAS, Expenditure Plans of the Ordinance require each local jurisdiction receiving
15 revenue from the tax to expend those funds pursuant to a Five-year Capital Improvement
Program and a Twenty-Year Transportation Plan adopted by resolution of the local jurisdiction;
16 and,
17 WHEREAS, due to the expiration of the current Measure 11990-2010 Program on March
18 31, 2010, SANBAG is requesting that each local jurisdiction submit a six-year plan to include
e final year of the Measure I 1990-2010 and the first five years of the Measure 12010-2040;
19 and,
20 WHEREAS, Expenditure Plans of the Ordinance also require that each local jurisdiction
21 annually adopt and update its Capital Improvement Plan.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
4 OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. The Six-Year Capital Improvement Program (2009-2015) for Measure "I"
6 Local Expenditures, referenced hereto in Exhibit "A" including the Expenditure Strategy as
7
indicated in Exhibit "B", both incorporated herein by reference as though fully set forth, are
8
9 adopted as the policy and program of the City of San Bernardino relating to construction of
10 capital improvement projects, using Measure I Local Expenditures, except for the following
11 Streets and Street Light CIP Projects:
12 1. SSO4-51 Hunts Lane Grade Separation,
13 2 SS06-102 Hunts Lane and Commercial Road Street Rehabilitation, and
14
3. SS 10-07 SB-X Rapid Bus Transit Project Inspection Cost;

16 which shall be voted upon by separate motion to become part of this Resolution as Exhibit"C".

MEASURE I SIX-YEAR CAPITAL IMPROVEMENT PLAN
EXPENDITURE STRATEGY
2009-2015
The City of San Bernardino will continue to place emphasis on both its regional and sub-
regional arterial roadway system. At least fifty percent of our Measure I funds allocation
will be earmarked for specific capital projects that are geared towards improving traffic
flow and motorist convenience. Failing pavement surfaces will be rehabilitated and
traffic striping modified as needed to accommodate increased traffic demand; and
intersection capacity will be improved with new and modified traffic signals.
In addition to the above capital projects program, San Bernardino will continue to
allocate up to fifty percent of our annual Measure I funds towards public works
maintenance activities. Maintenance work will continue to include the City's traffic
signal systems, sidewalk and curb repair, and pavement repair and overlay on the local
street system.

EXPENDITURE STRATEGY
