Financial Impact: The Water Department will receive the payment of$6,200 as compensation. Southern California Edison Company will pay all recording fees relative to this easement. Motion: Adopt the Resolution. Synopsis of Previous Council Action: None. Background: On April 13, 2012, a letter was received from Spectrum Land Services on behalf of the Southern California Edison Company (SCE), requesting an easement for the replacement of existing poles and lines over a portion of City-owned property (Water Department) located on the north side of Base Line Street, east of Meridian Avenue, known as Assessor's Parcel Number (APN) 0269- 172-01. The request is a result of SCE replacing a portion of the electrical circuit/equipment that crosses over the Lytle Creek Channel with an alignment change on the west side of the channel To accommodate the new alignment, the existing poles will need to be replaced and installed on the south portion of Water Department property. To facilitate the replacement of the appurtenant pole line, SCE needs an easement that is approximately 2,064 sq. ft. (13' X 157') on the southerly portion of the Water Department property. The attached map indicates the proposed easement area. In the event of a necessity to widen this portion of Base Line Street sometime in the future, SCE will relocate its facilities into a new easement area of similar size within the Water Department property at no additional cost to SCE for the new easement area. However, the cost of the physical relocation of all appurtenant facilities will be paid by SCE as set forth in the Grant of Easement. On November 5, 2012, the Board of Water Commissioners unanimously voted to approve the Grant of Easement for electrical facilities and submit to the Mayor and Common Council for their approval. The attached resolution authorizes the execution of a Grant of Easement to SCE O over City property. Based on an appraisal prepared by Valentine Appraisal & Associates for the proposed area to be used as an easement (summary attached), it was determined that the fair Updated: 12/13/2012 by Georgeann"Gigi"Hanna 2093 market value of this easement is $6,200. Water Department and City staff have reviewed the appraisal and concur with the valuation. This compensation will be paid by SCE to the Water Department if approved. According to public records, I have no record of when the City of San Bernardino acquired the subject property, as it appears that the subject property has not sold within the past three years. Zoning: The subject property is zoned PFC with a General Plan designation of Public Flood Control. Both the zoning and general plan use are consistent. The purpose of this district is to provide for the continuation, maintenance, and expansion of public flood control facilities. Other permitted uses include golf courses and related facilities, and existing single-family dwellings. Highest and Best Use: The procedure used in this report is to estimate the highest and best use of the subject property and to consider the site's legally permissible use, its physically possible use, its financially feasible use, and its maximally productive or highest and best use. The subject property is currently zoned for public flood control uses, and since the proposed take does not impact any improvements, no valuation of the property as improved is necessary. Legally Permissible - The property is located on the north side of Baseline Road, at the public flood control in the city of San Bernardino, San Bernardino County, California,and is zoned PFC. Physically Possible-The configuration of the subject property is 1.15 acres. It is part of the larger adjacent public flood control channel, although the site has level terrain and is adjacent to off-site improvements. Financially Feasible -This aspect of the highest and best use analysis looks at the ability of a property to produce an income stream greater than or equal to the amounts needed to satisfy operating expenses, financial obligations, and capital amortization of the investment. Nor is the construction of a public flood control channel financially feasible, as they are typically created by public agencies for the betterment of the public. Considering the above noted factors, it is my opinion that the highest and best use of the subject property is for its current use, a public flood control channel, and secondary uses such as communication towers. Purpose and Intended Use This appraisal is provided for internal Edison valuation purposes to determine the fair market value of an easement to improve the electrical system. The intended use is for Edison Corporate Real Estate staff to assist in negotiations to acquire the easement upgrade and is considered confidential. The intended users of this report are the Edison Corporate Real Estate staff. Date of Appraisal: The date of inspection and the date of value for this appraisal report is March 20, 2012. The date of the report is March 28, 2012. Appraisal Process and Scope of Work: The scope of this assignment includes appraising the fair market value for the proposed longitudinal easement located within a portion of the public flood control channel in order to enhance the electrical transmission service within the neighborhood. The traditional Sales Comparison Approach is not normally applicable in this type of appraisal. Public flood channels, like the subject property, are special purpose properties. That is, properties that are devoted or available for special uses not usually found in the open real estate market. Existing transportation corridors are not commonly bought or sold in the routine marketplace. Rather, sale prices are sometimes based on "alternative settlement," not based on an economic analysis. Due to the wide disparity in geographic location, climate, sales concessions, retained rights,comparison with the subject corridor, sales of other corridors should be made with extreme caution. The Income Capitalization Approach is used for investment purposes, and has as its premise the concept that the income stream can be diverted into an indication of fair market value when capitalized in a manner that is commensurate with the risk, the quality of income stream, and the life expectancy of the improvements. The Income Capitalization Approach is not generally used for transportation corridors, like public flood channels, because there is no practical method to allocate the revenue derived from a single segment or small portion of the overall integrity of the channel. The Cost Approach is the measure of value when the property is unique and there is no relevant market in comparable sales, nor is there any income stream available for analysis to determine the market value. While this approach is based on the principle of substitution, it is less reliable than other approaches due to the difficulty in estimating all the cost of transportation corridor. The Across-The-Fence (ATF) Methodology is based on the concept of altemative use that is assignable to land segments within the overall corridor. In theory, the segments are divided down the centerline and each half is joined to the adjacent parcel, along with the adjacent property's highest and best use and unit value. The corridor is uniquely configured to meet the highest and best use as a right-of-way and should not be penalized for special physical characteristics when compared with vacant parcels in the neighborhood. The ATF methodology has precedence in the practices of the State Board of Equalization, railroad companies, utility companies, and public agencies. In addition, the private and public agencies have utilized this method for estimation of value of operating property and non-operating property, and have used it as a basis for ground rent and for estimating value for public and private streets. Adjustments are made only for the differences in marketing conditions (time) and location. The underlying assumption of this method is that land in the transportation corridor is equal to the value of the adjoining lands. Across-The-Fence(ATF) When utilizing the ATF approach, a unit value of a typical parcel of those adjacent lands, usually on a per square foot or per acre basis, is multiplied by the area of that district or zone of the corridor to estimate its value. After each zone has been assigned a value, the zones are added together to estimate the ATF value of the unencumbered fee value of the corridor. It is assumed that easement being acquired is a permanent, non-exclusive easement. It is assumed that the proposed electrical facilities are in a location beneath the private roadway that is minimally disruptive to the existing uses. According to the engineering drawings provided, the easement area required on the property is located on the south side fronting along Baseline Road, and measures 13 feet wide, totaling 2,064 sq. ft. The area to be encumbered by the easement is vacant and unimproved. For purpose of this appraisal, the unit of comparison used is the price per square foot. This unit is a common unit of comparison in the area. Valuation: Recent sales of similar use and zoning were sought to represent the current fair market value of the unencumbered fee interest. Few new industrial developments have gone online since 2008. Quantitative adjustments were considered, but data was insufficient to support them. As such, qualitative adjustments were weighted. The next step is to appraise that portion of the larger parcel that will be taken per ATF valuation analysis, as most experienced appraisers would do. This is done by setting an appropriate ATF unit value for the only valuation segment of the subject property. In this case there is one valuation segment, as described earlier in the report, a 0.90 acre parcel located to the west, zoned M-1, rectangular in shape, good interior access, level terrain, all utilities available, is a good indicator of ATF. Segment Value: $6.00/sq.ft. The fair market value of the underlying fee interest of the proposed easement identified in the legal description found in the Addenda section of this report, as determined by ATF methodology, as of March 20,2012, is as follows: 2,064 sq. ft. @$6/sq. ft. _$12,384 Easement: The typical appraisal method for valuing partial interests is the before and after method. In this method, the appraiser values the larger parcel before the taking (or easement) is applied, and then again after the easement is assumed to be in place. The difference (if any) is the amount attributed to the easement and is the value due to the owner. However, when the lesser takings, or grants, are involved, where such a before and after value would likely be nominal (due to impact, location, etc.)another approach and formula is often applied. This formula basically estimates the value of the part taken (as a part of the whole), adds damages to the larger parcel (if any), subtracts benefits (if any), and the difference is the value of the property interest in question. This method is based on the knowledge that property ownership is known as a "bundle of fights", where an ownership can be divided into separate sticks that comprise the "bundle". For example, certain sticks or rights represent the right to use the surface of the land, or the air rights around an airport, or the subsurface rights to acquire the right to run a pipeline. This latter method has been deemed appropriate and is used in this report. There are no severance damages as no damages or benefits exist to the remainder as a result of this easement. Easement percentage of fee: The area that the easement will encumber is considered a non-buildable area, located in an area deemed public flood control. This new SCE easement will have minimal impact on the use of the property. Nevertheless, the owner must be compensated for the property rights acquired. The loss in property rights have been quantified based on an apportionment of the impact on the surface, subsurface, and air right estates of the property. Based on the use to which the easement will be put and the restrictions imposed by the easement rights, an appropriate percentage will be applied to the previous unencumbered fee unit value. The easement percentage has been quantified based on an apportionment of the impact on the subsurface, surface, and air rights of the property. It is my experienced opinion that the contributory value of the additional easement interest is approximately 50% of the per unit unencumbered fee value of the property. Reasoning is provided as follows: Therefore, I conclude that the easement rights will primarily affect the air rights, and some surface rights, and few subsurface rights, and is assigned a percentage of the unencumbered fee value of approximately 50%. Reconciliation: The sales noted above exhibit recent market activity for transactions of industrial land in the immediate area of the subject property. Taking these factors into consideration, and weighing the appropriateness, quantity and quality of the data to support ATF value, it is my conclusion that the sales were determined to be applicable comparable unit values of the unencumbered land. Considering the information provided above as well as my experience as an appraiser, it is my opinion that the unit value for the unencumbered fee interest is $6.00 per square foot.
