INTER OFFICE MEMORANDUM
OFFICE OF THE CITY ATTORNEY
CITY OF SAN BERNARDINO
TO: Mayor and Common Council P
FROM: James F. Penman, City Attorney . •
Date: December 17, 2012
Subject: Agenda Item No. 8.
In an attempt to further reduce legal costs I am recommending not renewing the contract with Chad
Bradbury as an in-house, deputy City Attorney IV. Instead, I am recommending that we contract
with him solely to prosecute ACP collections.
This will result in leaving his current position vacant. I am recommending that in lieu of his salary
of$10,757.00 per month, that we pay him a retainer of$6,000 per month for six months and a
contingency fee of 25%of the money he brings in as a result of his ACP collection enforcement.
He will return to private practice after January 9, 2013.
Mr. Bradbury has been devoting himself to this effort for the past 45 days and has been successful
in realizing approximately$30,000 in collections during that period.
As we have worked down other litigation it will be possible to keep the previously mentioned
position vacant. However, the collection prosecutions Mr.Bradbury has been performing with the
ACPs need to continue.
Under terms of the agreement the$6,000 is limited to the first six months of the contract. Near the
end of the first.six months we will renegotiate the monthly retainer, the intention being to lower it
as Mr. Bradbury's contingency fees gradually increase in the amount of money(not the percentage)
he collects.
