Background: In November 1989, voters approved Measure I authorizing San Bernardino Associated Governments (SANBAG), acting as the Transportation Authority, to impose a one-half of one- percent retail transaction and use-tax applicable throughout the county for a period of 20 years beginning April 1, 1990 and extending to March 31, 2010. This tax is commonly known as the '/z-cent sales tax. In November of 2004, voters approved an extension of the '/2-cent sales tax for an additional 30 years from April 1, 2010, extending it to March 31, 2040. In order to distinguish the two programs, they are now being referenced as Measure I 1990-2010 and Measure I 2010-2040. Revenue from the tax can only be used for transportation improvements and traffic management programs authorized in the Expenditure Plans set forth in Ordinance Nos. 89-01 and 04-1 of the Authority. The referenced ordinances require each local agency to expend funds based on a 5-year Measure I Capital Improvement Program (CIP) and a 20-year Measure I Transportation Plan adopted by resolution. The 5-year Measure I Capital Improvement Program only relates to the expenditure of Measure I funds and each agency is required to update the program annually. The 20-year Measure I Transportation Plan is only required to be amended if it changes. Since the Measure I 1990-2010 program expired on March 31, 2010, SANBAG has allowed jurisdictions to submit a 6-year Measure I Capital Improvement Program for FY 2009-2015 covering the final year of Measure I 1990-2010 and the first five years of Measure I 2010-2040. San Bernardino's 6-year Measure I CIP was approved by the Mayor and Common Council on October 5, 2009 and a copy of the Program was sent to SANBAG. As of June 30th of each year, SANBAG audits the City's financial records to insure that Measure I local pass through expenditures have been made in accordance with the approved 6-Year Measure I Capital Improvement Program. A deficiency report is created and sent to the City Manager if improper expenditures are found with a requirement that the deficiencies be promptly corrected. Amendment No. 1 to the 6-Year Program 1) establishes a project for Street Maintenance and allocates $500,000 in Measure I funds thereby providing a funding source for rendering maintenance services related to the public rights-of-way; 2) deletes two completed projects (SS10-04 "Rehabilitation of Donald Street, San Anselmo and Duffy Street" and SS10-06 "Rehabilitation of San Anselmo and Duffy Street to cul-de-sac) from the Measure I, 6-year Capital Improvement Program because they are being financed using Proposition 42 funding; and 3) adds eligible projects which were previously budgeted and approved, but not included as 2 CITY OF SAN BERNARDINO- REQUEST FOR COUNCIL ACTION STAFF REPORT (Continued) part of the Measure I CIP. These projects were originally funded with an I-Bank loan and the debt service payments were made with Measure I dollars. SANBAG has requested that instead of listing debt service payments on the 6-Year CIP, each individual project should be listed. Financial Impact: The financial impact related to approval of Amendment No. 1 to the 6-year Measure I Capital Improvement Program is reflected in Exhibit A attached to the Resolution. The following changes are reflected: 1. The City's FY 2009/10 annual budget has been adjusted to transfer $500,000 in Measure I available funds to this Street Maintenance project. Funds will be used for non-specific projects and is an approved use of Measure I funds under the general program categories. 2. Two projects, SS10-04 and SS10-06 have been deleted from the Measure I program and will be funded through Proposition 42. 3. Project SS08-23, I-Bank Loan payback has been deleted from the program for FY's 07/08, 08/09 and 09/10. This deletion was necessary due to SANBAG audit requirements. 4. Twenty projects have been added to the program. These projects were previously funded through the I-Bank Loan and originally it was planned to pay them back using Measure I funds. SANBAG has requested that instead of listing the I-Bank Loan debt service with Measure I monies; to list the actual projects being funded in the current Measure I Capital Improvement Program. Recommendation: Adopt Resolution.
