HomeMy WebLinkAbout2013-014 1 RESOLUTION NO. 2013-14 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY 3 OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A FIRST 4 AMENDMENT TO AN AGREEMENT AND ISSUANCE OF A PURCHASE ORDER TO CAL STRIPE INC. FOR CITYWIDE TRAFFIC STRIPING AND PAVEMENT 5 MARKINGS. 6 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 8 SECTION 1. The City Manager is hereby authorized and directed to execute a First 9 Amendment to an Agreement with Cal Stripe Inc., a copy of which is attached and 10 11 incorporated herein as Exhibit "A", in the amount of$200,000 with three one-year extensions 12 at the City's option, for City-wide traffic striping and pavement markings. 13 SECTION 2. The Director of Finance or his designee is hereby authorized and 14 directed to issue a Purchase Order in the amount of$200,000 to Cal Stripe Inc. which shall 15 reference this Resolution and shall incorporate the terms and conditions of this Agreement. 16 17 SECTION 4. Penman, City Attorney 26 BY: 27 28 2013-14 FIRST AMENDMENT TO ANNUAL CITYWIDE MAINTENANCE SERVICES CONTRACT WITH CAL STRIPE INC. FOR TRAFFIC STRIPING & PAVEMENT MARKING This First Amendment to Annual Citywide Maintenance Services Contract with Cal Stripe Inc. for Traffic Striping & Pavement Marking is entered into this 22nd day of January, 2013, by and between Cal Stripe Inc. ("VENDOR") and the City of San Bernardino ("CITY"). WITNESSETH: WHEREAS, the Mayor and Common Council has determined that it is advantageous and in the best interest of the CITY to contract for Citywide Traffic Striping and Pavement Markings; and WHEREAS, VENDOR was the lowest responsible bidder for Annual Citywide Maintenance Services Contract for Traffic Striping and Pavement Markings (2011-2012) Special Provisions No. 11329 and was awarded a contract by the Mayor and Council on November 7, 2011 by Resolution 2011-296, in the amount of $200,000 for FY 11/12 ("Agreement"); and WHEREAS, the Agreement in the Bid Schedule in Special Provisions No. 11329, stated that the City reserved the right to extend the contract up to four (4) years with annual one-year renewals; NOW, THEREFORE, the parties hereto agree as follows: 1. The Agreement is hereby amended to extend the term for up to three (3) years with annual one-year renewals to be exercised at the sole discretion of the CITY. The term of the Agreement shall be from January 23, 2013 through June 30, 2013, with two (2) one-year extensions at the City's option. Option year one, if exercised, shall be effective July 1, 2013 Exhibit"A" 1 2013-14 FIRST AMENDMENT TO ANNUAL CITYWIDE MAINTENANCE SERVICES CONTRACT WITH CAL STRIPE INC. FOR TRAFFIC STRIPING & PAVEMENT MARKING through June 30, 2014. Option year two, if exercised, shall be effective July 1, 2014 through June 30, 2015. The Agreement may be terminated at any time for any reason by thirty (30) days prior written notice by either party. 2. The Agreement is hereby amended to increase the payment to VENDOR up to the amount of$200,000. 3. All other terms and conditions of the Agreement shall remain in full force and effect.
