Date: April 29, 2010 Meeting Date: May 3, 2010 Synopsis of Previous Council Action: February 1, 2010 the ordinance of the City of San Bernardino amending the definition of "Roll-off Bin" was brought to the Mayor and Common Council. The item was referred to the LRC Committee and was heard on February 2, 2010. January 19, 2010 (MC 1321) — An urgency ordinance was approved by the Mayor and Common Council of the City of San Bernardino in order to amend the definition of"Roll- off Bin" contained in Section 8.24.060(W), of Chapter 8.24 of the San Bernardino Municipal Code and declaring the urgency thereof. October 2, 2006 (MC 1232) — An Ordinance of the Mayor and Common Council of the City of San Bernardino, California Repealing Chapter 8.21; Repealing and Replacing Chapter 8.24 of the San Bernardino Municipal Code Regarding Garbage and Rubbish and Repealing and Replacing Chapter 8.25 regarding scavenging of recyclable materials. Background: On February 1, 2010 the ordinance of the City of San Bernardino amending the definition of "Roll-off Bin" was brought to the Mayor and Common Council. The item was referred to the LRC Committee and was heard on February 2, 2010. The Legislative Review Committee heard the roll-off item on February 2, 17 and March 2, 2010. Additionally, the discussion included self haul and C & D ordinance. The matter was continued. The Legislative Review Committee members changed in April before the matter was ready for the Mayor and Common Council. To comply with the Brown Act, staff is recommending that the matters 'Roll-off Bin", Self Haul and Construction & Demolition be referred back to the Legislative Review Committee. Financial Impact: No Cost to the City. Recommendation: That the matter be referred to the Legislative Review Committee.
