COMMISSION MEETING AGENDA Meeting Date: 08116/2010 i Agenda Item Number: �3� ECONOMIC DEVELOPMENT AGENCY STAFF REPORT JACK IN THE BOX RESTAURANT—INTERIM EXECUTIVE DIRECTOR AUTHORIZATION TO APPROVE BUILDIGN SIGNAGE REIMAGING BACKGROUND: In April 1970, the State College Redevelopment Project Area was adopted. The Redevelopment Plan includes a section outlining Planning Criteria and Standards for Development. This section allows the Redevelopment Agency authority to review and approve site plans, architectural design, architectural plans,parking, landscaping and building signage. In July 1971, a Declaration of Restrictions was recorded on property which now has a Jack in the Box restaurant. CURRENT ISSUE: On June 24, 2010, an application for signage for signage reimaging for a Jack in the Box located at 4020 University Parkway, San Bernardino, CA, was submitted to the Planning Department for review and approval. On July 1, 2010, the Agency received signage plans and information, and a request to review and approve signage reimaging for the Jack in the Box restaurant. On July 12, 2010, the Planning Department determined that the new signage met all development code requirements and was approved. The Agency later received a Declaration of Restrictions which included conditions requiring review and approval of building plans, signage, landscaping, et al. Specifically, Section 5 of the Declaration states: "No sign shall be permitted to be constructed, attached, inscribed, affixed or painted on or to any building in the Project unless and until design for such sign has been presented to and approved by the Redevelopment Agency as to location, size,design and construction." Agency Staff has reviewed the attached exhibits and concurs with the Planning Department determination. Staff recommends that the Community Development Commission authorize the Interim Executive Director to review, approve and accept the signage reimaging for the Jack in the Box restaurant. ENVIRONMENTAL IMPACT: Authorizing the Interim Executive Director to review and approve signage reimaging for the Jack in the Box does not meet the definition of a "project' under Section 15378 of the California Environmental Quality Act(CEQA).
