O COMMISSION MEETING AGENDA Meeting Date: 08/1612L0110 l Agenda Item Number: 3 ECONOMIC DEVELOPMENT AGENCY STAFF REPORT PROPOSED SAN BERNARDINO REDEVELOPMENT SURVEY AREA BACKGROUND: In August 2008, Agency Staff conducted research and prepared studies to determine the feasibility of merging and/or amending the City's multiple redevelopment project areas. It was determined that redevelopment project areas throughout the City of San Bernardino would benefit from two separate merger/amendment processes. In July 2009, work commenced to conduct the necessary analysis and prepare the necessary plan and environmental documentation and work commenced on Area A, comprising the redevelopment project areas o£ Central City North, Southeast Industrial Park, Tri-City, South Valle, Meadowbrook, Central City, Central City South and Central City East. In an effort to proceed with the second phase of the redevelopment project area merger and amendments for the City's westerly project areas, Area B, includes the following redevelopment project areas of: State College, Central City West,Northwest, Uptown, Mt. Vernon and 40th Street. The Agency has started the preparation of redevelopment plan and environmental documents in order to meet an adoption date of October 2011. The Agency has also contracted with Rosenow Spevacek Group("RSG")to prepare the required redevelopment plan merger and amendment documents. One of the first steps in this process is to study and survey blighting influences of new land areas to be added to existing redevelopment project areas. The California Community Redevelopment Law ("CRL") requires the establishment of a redevelopment survey area before the beginning of a blight analysis and redevelopment feasibility study. The blight analysis and redevelopment feasibility study is only that, a "study." This does not create a redevelopment project area or amend one; it only indicates that a survey area be eligible for further study to determine whether a redevelopment project area may be established pursuant to CRL. CURRENT ISSUE: A redevelopment survey area is important to aid in the assessment of the implications of formulating a redevelopment project area pursuant to the CRL. The CRL permits cities to adopt and implement redevelopment plans by providing legal and financial tools to mitigate specific physical and economic blighting conditions. The proposed San Bernardino Redevelopment Survey Area("Survey Area") is within all Wards: 1, 2, 3, 4, 5, 6 and 7. Documentation of blight is needed to substantiate how existing conditions impact the physical and economic viability of a proposed redevelopment area. A blight survey and study considers incompatible land and building uses, building conditions, shifts in use of buildings, building/functional obsolescence, poor roadway configuration, public improvement deficiencies, code enforcement, circulation issues and environmental constraints to name a few. It should be noted that the Survey Area does not include the redevelopment areas listed above. The establishment and adoption of the proposed Survey Area will enable the Agency and City to explore the feasibility of utilizing its redevelopment authority to address physical and economic blight conditions. The advantage of studying a larger area is that certain areas may have blight that have not been previously identified and that the Agency is authorized to purchase property outside of a redevelopment project area for redevelopment purposes as long as it was in a survey area. Ultimately, the actual area that could be added or amended will be significantly smaller than the survey area size. ENVIRONMENTAL IMPACT: The establishment of a redevelopment survey area does not meet the definition of a "project' under Section 15378 of the California Environmental Quality Act(CEQA). FISCAL IMPACT: The establishment of the San Bernardino Redevelopment Survey Area will not have a fiscal impact on the Agency. A contract was previously approved for RSG for all consultant costs associated with Area Merger— Area B, as part of the approved Redevelopment Agency FY 2009-2010 Budget and by FY 2010-2011 Budget. RECOMMENDATION: That the Mayor and Common Council adopt the attached Resolution. L U 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE 3 CITY OF SAN BERNARDINO DESIGNATING THE SAN BERNARDINO REDEVELOPMENT SURVEY AREA FOR PROJECT STUDY PURPOSES 4 5 WHEREAS, the City of San Bernardino, California (the "City"), is a municipal 6 corporation and a charter city duly created and existing pursuant to the Constitution and the laws 7 of the State of California; and 8 WHEREAS, the Community Development Commission of the City of San Bernardino 9 (the "Commission") on behalf of the Redevelopment Agency of the City of San Bernardino (the 10 "Agency"), is a redevelopment agency, a public body, corporate and politic of the State of 11 California, organized and existing pursuant to the Community Redevelopment Law (Part 1 of 12 Division 24 commencing with Section 33000) of the Health and Safety Code of the State of 13 California(the"Law"); and © 14 WHEREAS, the Agency is interested in examining the feasibility of merging and, or 15 amending the State College, Central City West, Northwest, Uptown, Mt. The area depicted in Exhibit "A" is hereby designated as the San Bernardino 2 Redevelopment Survey Area("Survey Area"). 3 Section 2. The Mayor and Common Council hereby finds and determines that the 4 Survey Area requires study to investigate the feasibility of the formation of a redevelopment 5 project or projects to abate and eliminate the condition of blight, and designate the Survey Area(as 6 depicted in Exhibit"A") in accordance with Section 33310 of the Law. 7 Section 3. Upon a preliminary finding that redevelopment project is feasible, Health 8 and Safety Code Section 33322 provides that "the planning commission shall select one or more 9 project areas comprised of all or part of any survey area, at the direction of the legislative body, or 10 upon the written petition of the owners in fee of the majority in the area of a proposed project 11 area." 12 Section 4. Consistent with the authority contained in the above quoted provisions of 13 Health and Safety Code Section 33322, the Mayor and Common Council hereby direct that, upon a C14 preliminary finding that a redevelopment project is feasible, the Planning Commission select 15 boundaries for one or more redevelopment project areas within the Survey Area and submit a 16 preliminary plan for the redevelopment of such proposed project areas, in accordance with Sections 17 33322 and 33325 of the Law. 18 Section 5. The designation of any territory as part of a redevelopment survey area 19 accomplished by action of the Mayor and Common Council prior to approval of this Resolution 20 shall remain in full force and effect from now and after the date of such action. 21 Section 6.
