M/CC Meeting Date: August 16, 2010 Synopsis of Previous Council Action: On June 7, 2010, the Mayor and Common Council approved Resolution No. 2010-138 recognizing the San Bernardino City Fire Management Association (FMA) as the majority representative for the Fire Management Unit. On April 6, 2009, the Mayor and Common Council approved Resolution No. 2009-71 amending Resolution No. 2007-345, Section 2, B, Compensation; Section 2, H, Uniform Allowance; Section 2, K, Overtime; Section 2, O, Deferred Compensation; Section 2, Q, Vacation Leave; Section 2, X, Post Employment Health Plan; and adding Section 2, AA, Welfare Benefit Plan and Trust, between the City and Management/Confidential Fire Safety Management employees. Description) Finance: Council Notes: cs� Agenda Item No. �S 9-/c,o -Za c CITY OF SAN BERNARDINO — REQUEST FOR COUNCIL ACTION Staff Report Subject: Resolution of the Mayor and Common Council of the City of San Bernardino amending Resolution No. 2007-345, Section 2, C, Insurance (Medical, Dental, Vision), Subsection 1; Section 2, I, PERS, Safety Employees, Subsection 3; and Resolution No. 2009-71, Section 2, B, Compensation, Subsection 1; Section 2, X, Post Employment Health Plan; between the City and Fire Management employees. Backeround• The City Negotiations Team and Members of the San Bernardino City Fire Management Association (FMA) met to discuss ways the members could continue to assist with the City's financial deficit for the 2010-2011 and 2011-2012 fiscal years' budgets. As a result, FMA has agreed to employee concessions equaling approximately a ten percent (10%) reduction in salary and implementation of a second tier retirement formula (3% at 55) for new employees. Additionally, FMA agreed to reduce concession hours from six (6) hours of leave time per week to three (3) hours, which will provide additional savings to the City. It is recommended that the following actions be approved: • Fire Management employees will achieve the ten percent (10%) reduction by reducing the employer contribution for health care plans by $790.00 per month per employee effective September 1, 2010, as well as eliminate tie of 10% above highest group. Additionally, all Fire Management employees voluntarily turned in their City-paid cell phones,which provided additional savings for the City. • Effective January 1, 2011 the City of San Bernardino will amend the current PERS contract to provide a two-tier retirement benefit of 3% @ 55 for all newly hired employees in the group hired on or after January 1, 2011. In return for the above employee concessions, it is recommended that the following actions be adopted: ➢ Effective September 1, 2010 and continuing through June 30, 2012,all Fire Management employees shall accrue three(3)hours of leave time per week. This leave time shall have no expiration date or cash value. ➢ The City will amend the Post Employment Health Plan agreement to allow holiday hours to be included in calculations. The City and FMA agree that if the economy were to improve prior to June 30, 2012, the following "trigger" language would be followed: The City agrees to restore the ten percent (10%) employee concession prior to June 30, 2012 if sales tax, utility tax, and property tax totals restore to the FY 07- 08 levels or if the City of San Bernardino receives a Federal or State bailout or other windfall that can be applied to the General Fund with no limitations equal to or greater than the amount of savings achieved through the employee concessions. Financial Impact: This will result in a savings of$144,400 (FY 2010-11) and $144,400(FY 2011-12). Recommendations: Adopt Resolution. r I Resolution No. COPY 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 2007-345, SECTION 2, C, 3 INSURANCE (MEDICAL, DENTAL, VISION), SUBSECTION 1; SECTION 2, I, 9 PERS, SAFETY EMPLOYEES, SUBSECTION 3; AND RESOLUTION NO. 2009-71, SECTION 2, B, COMPENSATION, SUBSECTION 1; SECTION 2, X, POST 5 EMPLOYMENT HEALTH PLAN; BETWEEN THE CITY AND FIRE MANAGEMENT EMPLOYEES. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 7 OF SAN BERNARDINO AS FOLLOWS: 8 SECTION 1: Resolution No. 2007-345, Section 2, C, Insurance (Medical, Dental 9 Vision),is hereby amended by adding Subsection 1 as follows: 10 (1) Insurance(Medical.Dental.Visionl 11 For the period commencing September 1, 2010, and continuing 12 through June 30, 2012, the City shall contribute for Fire 13 p Management employees a flat rate of$301.81 per month to be 19 used 15 to purchase City-sponsored medical, dental, vision, and life 16 insurance. Eliminate tie of 10%above the highest group. 17 SECTION 2: Resolution No. 2007-345, Section 2, I,PERS, Safety Employees, 18 Subsection 3, is hereby amended as follows: 19 3. The City shall provide the 3% @ 55 retirement benefit formula for 20 fire and police management employees. 21 Effective January 1, 2011 the City of San Bernardino will amend 22 the current PERS contract to provide a two-tier retirement benefit 23 of 3%@ 55 for all newly hired employees in the Fire Management 24 group hired on or after January 1,2011. 25 SECTION 3: Resolution No. 2009-71, Section 2, B, Compensation, Subsection 1, is -1- 1 QRESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 2 BERNARDINO AMENDING RESOLUTION NO. 2007-345, SECTION 2, C, INSURANCE (MEDICAL, DENTAL, VISION), SUBSECTION l; SECTION 2, I, 3 PERS, SAFETY EMPLOYEES, SUBSECTION 3; AND RESOLUTION NO. 2009-71, 4 SECTION 2, B, COMPENSATION, SUBSECTION 1; SECTION 2, X, POST EMPLOYMENT HEALTH PLAN; BETWEEN THE CITY AND FIRE 5 MANAGEMENT EMPLOYEES. 6 hereby amended as follows: 7 1. Safety classifications shall have their salaries determined i 8 accordance with Charter Section 186. 9 a Effective September 1, 2010, and continuing through Jun 10 30, 2012, all Fire Management employees shall accrue 11 three (3) hours of leave time per week. This leave time 12 shall have no expiration date or cash value. In all cases 13 p leave use shall be arranged for and used according t 19 established departmental policy. 15 b. The City agrees to participate in the Post Employment Health Plan 7 (PEHP) in accordance with the terms and conditions of the Plan' 8 Participation Agreement. Specifically,the City will establish the following 9 PEHP programs for Fire Safety Management employees: 10 ➢ 401 (a)Accumulated Benefit Conversion Program 11 ➢ Universal Reimbursement Account 12 ➢ Insurance Premium Reimbursement Account 13 p Effective December 1, 2010, the City agrees to amend the Post 14 15 Employment Health Plan (PEHP), in accordance with the teams an 16 conditions of the Plan's Participation Agreement, to include Holiday 17 hours. 18 SECTION 5: All other terms of Resolution Nos. 2007-345 and 2009-71 not modified b 19 these amendments continue in full force and effect.
