Date: August 11, 2010 M/CC Meeting Date: August 16, 2010 Synopsis of Previous Council Action: On June 30, 2010, the Mayor and Common Council approved an extension of Side Letter to Resolution No. 2009-69 through August 31, 2010, for full-time, non-safety, Middle Management Unit employees (Resolution No. 2010-217). On April 6, 2009, the Mayor and Common Council approved a Side Letter to Resolution No. 2007-343 for full-time, non-safety, Middle Management Unit employees (Resolution No. 2009-69). On February 17, 2009, the Mayor and Common Council approved a Side Letter to Resolution No. 2007-343 for full-time, non-safety, Middle Management Unit employees (Resolution No. 2009-34). Background: On August 31, 2010, the current 10% concession Side Letter agreement will expire for the Middle Management Unit. The Middle Management Unit has agreed to extend its respective Side Letter agreement to continue review of proposals, counter proposals and to reach an agreement. The Human Resources Department recommends that the Mayor and Common Council adopt the attached Resolution. Financial Impact: General Fund savings total $22,600. Recommendation: Adopt Resolution. I RESOLUTION NO. COPY 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 3 BERNARDINO AUTHORIZING EXTENSION OF SIDE LETTER FOR MIDDLE MANAGEMENT BARGAINING UNIT. 4 WHEREAS, the Middle Management Unit entered into a Side Letter agreement to provide 5 a 10%salary reduction administered through a 36-hour reduced work week; 6 7 WHEREAS, pursuant to this Side Letter, the aforesaid employee concessions were to 8 expire on August 31, 2010; 9 WHEREAS, the City is in contract negotiations with this employee group and desires to 10 continue the aforesaid concessions; 11 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 12 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 13 14 SECTION 1: The City Manager of the City of San Bernardino and the Director of Human Q 15 Resources are hereby authorized and directed on behalf of the City to extend the termination date 16 of the following Side Letter from August 31,2010 to September 15,2010: 17 Middle Management Unit—Side Letter/Resolution Nos. 2009-34,2009-69, 2010-217 18 SECTION 2: The Side Letter executed by the affected employee group reflecting the 19 extension of the above-mentioned termination date is attached hereto and incorporated herein, 20 marked as Exhibit"A." 21 22 23 24 25 26 .. 27 28 i I RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING EXTENSION OF SIDE LETTER FOR MIDDLE 2 MANAGEMENT BARGAINING UNIT. 3 4 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and 5 Common Council of the City of San Bernardino at a meeting thereof, held 6 on the day of , 2010,by the following vote,to wit: 7 Council Members Ayes Nays Abstain Absent 8 MARQUEZ 9 10 DESJARDINS 11 BRINKER 12 SHORETT 13 KELLEY • 14 JOHNSON 15 MC CAMMACK 16 17 18 City Clerk 19 The foregoing resolution is hereby approved this day of 2010. 20 21 Patrick J.
