Description) N/A Finance: Council Notes: �J Agenda Item No. —t 1 09-67- 20lD 94��p ge CITY OF SAN BERNARDINO — REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Authorization to Proceed and Resolution establishing a sales price and setting a public hearing to consider the sale of the Convention Center(Exhibit Hall) and the adjacent parcel to the west, generally located on the west side of City Hall, and an appurtenant easement to the south, to the Redevelopment Agency. (APN 0134-251-53, and portions of APNs 0134-251-51 and 0134-311- 37). BACKGROUND: On April 27, 2010, the City Manager presented a "Budget Balancing Strategy Options" plan to address the proposed budget shortfall for FY 2010/2011. Part of that plan included the proposal to sell the Convention Center (previously known as Exhibit Hall) to the Redevelopment Agency ("RDA"). On June 30, 2010, the FY 2010/2011 budget was approved, including the proposed sale. The proposed sale also includes an appurtenant but separate parcel of land lying between the Convention Center and"E" Street. In 2009, an appraisal was obtained by the RDA for this sale proposal being considered for the FY 2009/2010 budget. The appraisal was prepared by Smothers Appraisal on April 14, 2009, in the amount of$3,100,000. The appraisal included the pavilion at Court Street Square and the underlying parcel of land, which is not part of the sale(that site is already owned by the Redevelopment Agency). After adjustments,the net value of the Convention Center is $2,447,000. The estimate of value was based on replacement cost, rather than market value, due to the unique function of the center. The sale will include the granting of easements to the RDA for access, storage and meeting space,which are appurtenant to the use of the convention center,but also share common area in the vicinity of the southerly basement entrance to City Hall Hall, as shown on the attached plat. Additionally, the City will retain an easement for access and maintenance of the plaza directly west of City Hall, which is also the roof area of the Convention Center, and the plaza area between the convention center and "E" Street, including the pedestrian bridge and the stairs to the north of the bridge. Section 2.65.050 of the San Bernardino Municipal Code allows the sale of property from one public agency to another at fair market value, without the need for competitive bid. Government Code Section 37420 et. seq. requires the adoption of a resolution of intention to sell, which fixes a time and place for a public hearing relative to the proposed sale. The attached Resolution of Intention sets a hearing for 4:00 p.m., October 4, 2010. If approved, the resolution will be published and notices posted on the property to be sold, as required by law. At the conclusion of the hearing, and upon approval of the proposed sale, a Sales and Purchase Agreement may be considered. FINANCIAL IMPACT: The City will receive $2,447,000 from the RDA in sales proceeds for both parcels. The public interest and convenience require the sale of City owned 13 parcels of real property known as the Convention Center, and appurtenant parcel to the west, 14 generally located west of and adjacent to City Hall, east of"E" Street and south of Court Street , 15 16 and the granting of an appurtenant easement, more fully described in said Exhibit "A" and 17 depicted on said Exhibit"B". 18 SECTION 2. It is therefore the intention of the Mayor and Common Council of the 19 City of San Bernardino to sell said parcels of real property to the RDA and grant an appurtenant 20 easement as set forth herein; 21 22 SECTION 3. The Mayor and Common Council do hereby establish the Fair Market 23 Value of said parcels of real property, in the amount of TWO MILLION FOUR HUNDRED 24 FORTY-SEVEN THOUSAND DOLLARS ($2,447,000); and 25 SECTION 4. Description) N/A Finance: Council Notes: -- © Agenda Item No. 1 �Zc CITY OF SAN BERNARDINO — REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Authorization to Proceed and Resolution establishing a sales price and setting a public hearing to consider the sale of the Convention Center(Exhibit Hall) and the adjacent parcel to the west, generally located on the west side of City Hall, and an appurtenant easement to the south, to the Redevelopment Agency. (APN 0134-251-53, and portions of APNs 0134-251-51 and 0134-311- 37). BACKGROUND: On April 27, 2010, the City Manager presented a "Budget Balancing Strategy Options" plan to address the proposed budget shortfall for FY 2010/2011. Part of that plan included the proposal to sell the Convention Center (previously known as Exhibit Hall) to the Redevelopment Agency ("RDA"). On June 30, 2010, the FY 2010/2011 budget was approved, including the proposed sale. The proposed sale also includes an appurtenant but separate parcel of land lying between the Convention Center and"E" Street. In 2009, an appraisal was obtained by the RDA for this sale proposal being considered for the FY 2009/2010 budget. The appraisal was prepared by Smothers Appraisal on April 14, 2009, in the amount of$3,100,000. The appraisal included the pavilion at Court Street Square and the underlying parcel of land, which is not part of the sale (that site is already owned by the Redevelopment Agency). After adjustments,the net value of the Convention Center is $2,447,000. The estimate of value was based on replacement cost, rather than market value, due to the unique function of the center. The sale will include the granting of easements to the RDA for access, storage and meeting space, which are appurtenant to the use of the convention center,but also share common area in the vicinity of the southerly basement entrance to City Hall Hall, as shown on the attached plat. Additionally, the City will retain an easement for access and maintenance of the plaza directly west of City Hall,which is also the roof area of the Convention Center, and the plaza area between the convention center and"E" Street, including the pedestrian bridge and the stairs to the north of the bridge. Section 2.65.050 of the San Bernardino Municipal Code allows the sale of property from one public agency to another at fair market value, without the need for competitive bid. Government Code Section 37420 et. seq. requires the adoption of a resolution of intention to sell,which fixes a time and place for a public hearing relative to the proposed sale. The attached Resolution of Intention sets a hearing for 4:00 p.m., October 4, 2010. If approved, the resolution will be published and notices posted on the property to be sold, as required by law. At the conclusion of the hearing, and upon approval of the proposed sale, a Sales and Purchase Agreement may be - - — — — considered. FINANCIAL IMPACT: The City will receive $2,447,000 from the RDA in sales proceeds for both parcels.
