Source: 001-210-5014-0000-0081 Traffic Part-time salaries 001-000.4740 Revenue -Misc.Receipts Council Notes: Finance ��a Agenda Item No. Oq-47-20(0 CITY OF SAN BERNARDINO — REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT Resolution by the Mayor and Common Council authorizing the City Manager to execute amendment No. 5 to the Services Agreement with the San Bernardino City Unified School District for the operation of the School Crossing Guard Program by the Police Department. BACKGROUND Crossing guards are vital to protect the safety of elementary school students while walking on city streets to and from school. The City of San Bernardino and the San Bernardino Unified School District have participated in the school crossing guard program for a number of years. Currently, the Police Department has administrative oversight of the program and both parties contribute 50% of the financial costs of operating the program. The most recent service agreement expired June 30`h, 2010. The reimbursement will be retroactive to July 1,2010. FINANCIAL IMPACT The Police Departments adopted budget for FY 2010/2011 includes $433,200 (Account 001-210- 5014-0000-0081) for part-time crossing guards. The costs associated with the San Bernardino City Unified School District agreement are projected to total $415,200. The SBCUSD will reimburse 50% of the program cost or roughly$207,600(Revenue Account#001-000-4740). Account Budgeted Amount: 433,200. Balance as of 8-5-10. Balance after approval of this item: $18,000 Please note this balance does not indicate available funding. It does not include non-encumbered reoccurring expenses or expenses incurred but not yet processed. RECOMMENDATIONS 1. Moms,Mayor 25 City of San Bernardino Approved as to form 26 27 dazne arr Eitp,4tferney 28 2010-295 AMENDMENT NO.5 TO THE CROSSING GUARD SERVICES AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND THE SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT This Agreement is made and entered into this day of ,2010 by and between the San Bernardino City Unified School District, hereinafter referred to as the "District" with its principal place of business at 777 North "F" Street, San Bernardino, California 92410, and the City of San Bernardino Police Department, hereinafter referred to as"City"having a business address at 710 N. "D" Street,San Bernardino,California 92401. WHEREAS,the City and the District previously entered into as Agreement to share equally the cost of a school crossing guard program;and, WHEREAS,the parties wish to extend the agreement through the current school year;and, WHEREAS,the parties wish to amend Paragraphs I and V of the agreement; NOW,THEREFORE, the parties agree to amend paragraphs I and V of the Agreement to read as follows: 1. TERM OF AGREEMENT A- This Agreement is effective beginning July 1, 2010, and continuing through June 30, 2011. The school year is from July 1 to June 30 of each succeeding year. V. CITY'S FEE AND PAYMENT THEREOF A. In accordance with negotiations with the City, the District agrees to compensate the City for one-half of the costs of services rendered to accomplish the results required hereunder, in the total amount not to exceed $207,600.00. Invoices are submitted quarterly(three months). All other terms and conditions will remain the same. IN WITNESS THEREOF,the parties have executed this Agreement as set forth below.
