BACKGROUND The State of California Department of Alcohol Beverage Control will award grants up to $100,000 in Fiscal Year 2010/11 to local law enforcement agencies to develop an effective, comprehensive and strategic approach to eliminating the crime and nuisance problems associated with alcoholic beverage outlets, and then institutionalize the approach within the local police agency. To achieve its goals, the program emphasizes a "full-court press" strategy in correcting and eliminating alcohol-related problems at the point of sale with a strong emphasis on comprehensive enforcement tactics. Selected police agencies will implement the full-court press through a variety of innovative project objectives involving both educational and enforcement programs, including the training of law enforcement personnel, community involvement, prevention, enforcement, records management, a liaison with the ABC district office, and media involvement. The deadline for this grant application is March 31,2010. The Vice &Narcotics Unit's proposal,Attack Underage Drinking(Attachment `A'), targets the problem of underage drinking stemming from both on and off sale liquor license establishments, using both educational and enforcement programs. If awarded, the grant will provide $100,000 for overtime, training, support and equipment to complete the grant goals and objectives. Grant funds will provide 1,466 hours of overtime for police officers and support personnel to perform educational and enforcement programs. In 2006,we applied for and received a similar ABC grant. We were allotted a total of$30,000 to target underage drinking. During an eighteen month period, we targeted seventy-one businesses within the City of San Bernardino. As a result of these investigations, fifty-seven arrests were made,targeting businesses that were supplying alcohol to underage minors. FINANCIAL IMPACT There will be no impact on the City's General Fund. The Police Department will be using a total of$100,000 in Alcohol Beverage Control grant funds, if awarded, to perform enforcement and educational programs in support of grant goals and objectives. Expenditures are detailed in the Grant Budget and Budget Narrative (Attachment "B'). The department has adopted Community Policing and Problem Solving (COPPS) as a department wide policing strategy. The City has been divided into four geographic Area Commands, each staffed with a police lieutenant and a complement of police officers and support staff. Area personnel, in conjunction with community members, are responsible for identifying and eliminating problems in the community. The police department is divided into three divisions: Patrol, Investigations and Administrative Services. The Vice Unit, comprised of two investigators, supplemented by fifteen Narcotic Officers, under the direction of a sergeant, is part of the Investigations Division. In addition to the enforcement of ABC related activities, this unit is responsible for the enforcement of all vice-related crimes, to include street level prostitution, escorts, motel prostitution, massage parlors, gaming and carnivals, gambling, animal fighting, lewd act investigations, and adult bookstores. They also work directly with City Hall, particularly the Business Registration and Planning Departments. The department is seeking ABC grant funding in the amount of$100,000. This funding will allow the department to attack underage drinking in our community and improve the quality of life by enhancing alcohol-related enforcement and prevention programs. The specific goals of our proposal are as follows: 1. Reduce the incidence of underage drinking in the community through a variety of education and enforcement programs. 2. Establish and strengthen partnerships with California State University San Bernardino and San Bernardino Valley College officials. 3. Identify and target problematic ABC licensed establishments using crime analysis information and input from Patrol Officers and the community. 4. Contact business owners and operators at identified problem establishments to solicit voluntary cooperation and compliance 5. Conduct at least six DUI Checkpoint programs. 6. Coordinate and conduct sixty IMPACT training sessions. 7. Conduct at least twenty-five bar checks/active surveillance. 8. Conduct at least fourteen shoulder tap/minor decoy operations. 9. Conduct two LEAD business education programs. 10. Conduct at least four Trap Door operations. 11. Use local media to publicize grant funded programs and outcomes. 12. Problem Statement: The City of San Bernardino is the County seat for the San Bernardino County. San Bernardino is located 60 miles east of Los Angeles and is surrounded by the neighboring communities of Highland, Loma Linda, Rialto, Colton, Redlands and Devote. Interstate freeways 1215, I10 and 1210 provide travel through the City. The City has an ethnically diverse population of 204,483 residents in an area the size of 63 square miles. Recent analysis has shown approximately 36.4% of the city's population is under the age of 18 years of age. In 2009, police officers responded to 91,229 calls for service and made over 12,968 arrests, including 11,669 adult arrests and 1,299 juvenile arrests. Of those arrests, approximately 776 were made for public intoxication. The City reported 84,970 violent crime felonies to the Department of Justice and 6,196 property crimes. The Morgan Quitno Awards has listed the City of San Bernardino as the twenty-fourth (24) most dangerous city in America. Our crime rate has been adversely impacted by a number of interrelated factors: low rents, a low percentage of owner occupied residences, 1,714 resident parolees, 38.3% of the community receiving State and Federal aid, and a high number of residents living below the poverty level. The primary alcohol-related problem facing the City is underage drinking at the ABC licensed establishments. The secondary problems are the associated crimes of drinking in public, public intoxication, intoxicated patrons fighting in the parking lots and general quality of life issues for the businesses and residences that are in close proximity of a licensed location. Among the most problematic are three large night club type establishments that draw underage patrons from as far south as San Diego and as far west as Los Angeles. Identified problems include juvenile drinking, public intoxication, fighting, loitering, driving under the influence, vandalism, etc. These problems have been validated through 536 calls for service, public complaints, information from bar operators and security, arrests,traffic collisions, ABC information and vice programs. Businesses located in close proximity to licensed establishments suffer economically as they are forced to close when the patrons of the establishment loiter and commit vandalism, graffiti and thefts. Efforts to resolve these problem establishments have included active surveillance with arrests of offenders and meetings with owners attempting to secure voluntary compliance at their businesses. Our efforts have been severely restricted due to limited funds available for the programs. There are 394 licensed establishments within the City of San Bernardino (104 type 20, 86 type 21, 10 type 40, 70 type 41, 4 type 42, 68 type 47, 18 type 48, 7 type 51, 5 type 52, 1 type 57, 16 type 58, 1 type 64, 2 type 68 and two type 77). Currently with only two officers assigned to full time investigatory vice responsibilities and the large number of licensed establishments, it is very difficult to adequately ensure proper compliance with all applicable ABC laws, as well as local statutes. Nevertheless, during the period from January 1, 2009 through December 31, 2009, a total of 1 shoulder-tap and decoy operations were conducted, resulting in 11 arrests. Using scarce police resources to address these crimes diminishes our ability to respond to serious and violent crimes. These combined factors, coupled with fiscal restraints due to renewed state and local budged reductions, challenge our ability to provide quality police services. The City Attorney, who handles the various municipal code violations, and the District Attorney's Office that prosecutes the state law violations are both highly supportive of enforcement programs as well as preventative measures. Obviously, the preventative programs are preferred, as this will minimize the drain on their limited resources. Project Description: Through past experience it has been found that a two-prong attack on the problem of under aged drinking has been the most effective. The first step is a proactive educational effort directed as the ABC establishments who through their location or past history have a high likelihood of underage patrons trying to purchase or use alcohol. Educational efforts are also directed at the underage population that may try to purchase alcohol. This is accomplished through a working relationship with the officials at Cal State San Bernardino and San Bernardino Valley College. We will also continue our participation in the California State University Partnership Program. By doing on site visits with owner/operators and providing them with the necessary © information to help their employees identify underage patrons and take the appropriate steps to eliminate that activity, we can reduce the enforcement efforts. A secondary benefit from the educational efforts is the development of a partnership with the licensed establishments. This helps to open the lines of communication and to encourage the rapid exchange of timely information. The second step in attacking the problem is the use of decoy programs and undercover surveillance programs to target the offenders themselves. Several methods that have been used successfully in the past and will continue to be aggressively pursued are the "shoulder tap" method of undercover operatives trying to have others purchase the alcohol for them, decoy programs where underage operatives try to purchase the alcohol for themselves, and undercover surveillance, where undercover officers observe a licensed location to apprehend offenders as they consume alcoholic beverages in the parking lots of the establishments, prior to their going inside. We have also worked with ABC personnel in identifying the use of false or fraudulent identification at licensed establishments, to help prevent under aged patrons from obtaining alcohol and to protect the licensee's interests by deterring the use of alcohol by under aged patrons and reducing the crimes which are associated to it. They will complete all necessary progress reports required of the grant. The following personnel will be required to carry out grant objectives as supported by the proposed © budget. Sergeant Rob Young is an 18-year police veteran police officer. He has four years experience as a sergeant and directly supervises the Vice Unit and Narcotic Team. Officer Jerry Valdivia is a 29-year veteran police officer. He has over eight years of experience working in the Vice Unit. He has participated in over 1,000 vice programs, including prostitution, ABC operations, lewd acts, gaming and smoking. Jerry has completed well over 200 hours of advance officer training related to vice operations. Officer Jennifer Kohrell is a 7-year police veteran. She has been assigned to the Vice Unit for the last six months. She has worked as an undercover operator in over 30 street level prostitution programs and has personally conducted eight programs. Officer Devon Reid is a 7-year police veteran. He has over 24-months experience working in Narcotics with the Vice Unit and has been utilized as an undercover officer in approximately 25 "Craigsist," 40 street level prostitution, and 20 bathroom (lewd conduct) operations. Devon has participated in over 200 vice programs. Overtime will be utilized to complete grant funded goals, objectives and programs with the exception of data collection and analysis, identification of problem establishments, roll call training, IMPACT training and LEAD training. These programs will be completed by the Vice Officers on regular duty time. The City has been divided into four geographic Area Commands, each staffed with a police lieutenant and a complement of police officers and support staff. Area personnel, in conjunction with community members, are responsible for identifying and eliminating problems in the community. The police department is divided into three divisions: Patrol, Investigations and Administrative Services. The Vice Unit, comprised of two investigators, supplemented by fifteen Narcotic Officers, under the direction of a sergeant, is part of the Investigations Division. In addition to the enforcement of ABC related activities, this unit is responsible for the enforcement of all vice-related crimes, to include street level prostitution, escorts, motel prostitution, massage parlors, gaming and carnivals, gambling, animal fighting, lewd act investigations, and adult bookstores. They also work directly with City Hall, particularly the Business Registration and Planning Departments. The department is seeking ABC grant funding in the amount of$100,000. This funding will allow the department to attack underage drinking in our community and improve the quality of life by enhancing alcohol-related enforcement and prevention programs. The specific goals of our proposal are as follows: 1. Reduce the incidence of underage drinking in the community through a variety of education and enforcement programs. 2. Establish and strengthen partnerships with California State University San Bernardino and San Bernardino Valley College officials. 3. Identify and target problematic ABC licensed establishments using crime analysis information and input from Patrol Officers and the community. 4. Contact business owners and operators at identified problem establishments to solicit voluntary cooperation and compliance 5. Conduct at least six DUI Checkpoint programs. 6. Coordinate and conduct sixty IMPACT training sessions. 7. Conduct at least twenty-five bar checks/active surveillance. 8. Conduct at least fourteen shoulder tap/minor decoy operations. 9. Conduct two LEAD business education programs. 10. Conduct at least four Trap Door operations. 11. Use local media to publicize grant funded programs and outcomes. 12. Problem Statement: The City of San Bernardino is the County seat for the San Bernardino County. San Bernardino is located 60 miles east of Los Angeles and is surrounded by the neighboring communities of Highland, Loma Linda, Rialto, Colton, Redlands and Devore. Interstate freeways 1215, I10 and 1210 provide travel through the City. The City has an ethnically diverse population of 204,483 residents in an area the size of 63 square miles. Recent analysis has shown approximately 36.4% of the city's population is under the age of 18 years of age. In 2009, police officers responded to 91,229 calls for service and made over 12,968 arrests, including 11,669 adult arrests and 1,299 juvenile arrests. Of those arrests, approximately 776 were made for public intoxication. The City reported 84,970 violent crime felonies to the Department of Justice and 6,196 property crimes. The Morgan Quimo Awards has listed the City of San Bernardino as the twenty-fourth (24) most dangerous city in America. Our crime rate has been adversely impacted by a number of interrelated factors: low rents, a low percentage of owner occupied residences, 1,714 resident parolees, 38.3% of the community receiving State and Federal aid, and a high number of residents living below the poverty level. The primary alcohol-related problem facing the City is underage drinking at the ABC ® licensed establishments. The secondary problems are the associated crimes of drinking in public, public intoxication, intoxicated patrons fightin&in the_parking_lots and general quality of life issues for the businesses and residences that are in close proximity of a licensed location. Among the most problematic are three large night club type establishments that draw underage patrons from as far south as San Diego and as far west as Los Angeles. Identified problems include juvenile drinking, public intoxication, fighting, loitering, driving under the influence, vandalism, etc. These problems have been validated through 536 calls for service, public complaints, information from bar operators and security, arrests, traffic collisions, ABC information and vice programs. Businesses located in close proximity to licensed establishments suffer economically as they are forced to close when the patrons of the establishment loiter and commit vandalism, graffiti and thefts. Efforts to resolve these problem establishments have included active surveillance with arrests of offenders and meetings with owners attempting. to secure voluntary compliance at their businesses. Our efforts have been severely restricted due to limited funds available for the programs. There are 394 licensed establishments within the City of San Bernardino (104 type 20, 86 type 21, 10 type 40, 70 type 41, 4 type 42, 68 type 47, 18 type 48, 7 type 51, 5 type 52, 1 type 57, 16 type 58, 1 type 64, 2 type 68 and two type 77). Currently with only two officers assigned to full time investigatory vice responsibilities and the large number of licensed establishments, it is very difficult to adequately ensure proper compliance with all applicable ABC laws, as well as local statutes. Nevertheless, during the period from January 1, 2009 through December 31, 2009, a total of 1 shoulder-tap and decoy operations were conducted, resulting in 11 arrests. Using scarce police resources to address these crimes diminishes our ability to respond to serious and violent crimes. .. These combined factors, coupled with fiscal restraints due to renewed state and local budged reductions, challenge our ability to provide quality police services. The City Attorney, who handles the various municipal code violations, and the District Attorney's Office that prosecutes the state law violations are both highly supportive of enforcement programs as well as preventative measures. Obviously, the preventative programs are preferred, as this will minimize the drain on their limited resources. Proiect Description: Through past experience it has been found that a two-prong attack on the problem of under aged drinking has been the most effective. The first step is a proactive educational effort directed as the ABC establishments who through their location or past history have a high likelihood of underage patrons trying to purchase or use alcohol. Educational efforts are also directed at the underage population that may try to purchase alcohol. This is accomplished through a working relationship with the officials at Cal State San Bernardino and San Bernardino Valley College. We will also continue our participation in the California State University Partnership Program. By doing on site visits with owner/operators and providing them with the necessary �,. information to help their employees identify underage patrons and take the appropriate steps to eliminate that activity, we can reduce the enforcement efforts. A secondary benefit from the educational efforts is the development of a partnership with the license establishments. This helps to open the lines of communication and to encourage the rapid exchange of timely information. The second step in attacking the problem is the use of decoy programs and undercover surveillance programs to target the offenders themselves. Several methods that have been used successfully in the past and will continue to be aggressively pursued are the "shoulder tap" method of undercover operatives trying to have others purchase the alcohol for them, decoy programs where underage operatives try to purchase the alcohol for themselves, and undercover surveillance, where undercover officers observe a licensed location to apprehend offenders as they consume alcoholic beverages in the parking lots of the establishments,prior to their going inside. We have also worked with ABC personnel in identifying the use of false or fraudulent identification at licensed establishments, to help prevent under aged patrons from obtaining alcohol and to protect the licensee's interests by deterring the use of alcohol by under aged patrons and reducing the crimes which are associated to it. Sergeant Rob Young is an 18-year police veteran police officer. He has four years experience as a sergeant and directly supervises the Vice Unit and Narcotic Team. Officer Jerry Valdivia is a 29-year veteran police officer. He has over eight years of experience working in the Vice Unit. He has participated in over 1,000 vice programs, including prostitution, ABC operations, lewd acts, gaming and smoking. Jerry has completed well over 200 hours of advance officer training related to vice operations. Officer Jennifer Kohrell is a 7-year police veteran. She has been assigned to the Vice Unit for the last six months. She has worked as an undercover operator in over 30 street level prostitution programs and has personally conducted eight programs. Officer Devon Reid is a 7-year police veteran. He has over 24-months experience working in Narcotics with the Vice Unit and has been utilized as an undercover officer in approximately 25 "Craigsist," 40 street level prostitution, and 20 bathroom (lewd conduct) operations. Devon has participated in over 200 vice programs. Overtime will be utilized to complete grant funded goals, objectives and programs with the exception of data collection and analysis, identification of problem establishments, roll call training, IMPACT training and LEAD training.
