Description: Public Improvement Fund Finance: Agenda Item No. 12 3-15-io CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution approving Amendment No. Two to Agreement for Professional Services with Engineering Resources of Southern California to provide Civil/Traffic Engineering Services for the design of street, storm drain, and traffic signal improvements along Victoria Avenue from Highland Avenue to Lynwood Avenue(SS05-25). Background: On October 4, 2004, the Mayor and Common Council adopted an Agreement with the San Manuel Band of Mission Indians for public improvement projects to address tribal project impacts. Staff identified the design of street, storm drain, traffic signal and sound wall improvements along Victoria Avenue from Highland Avenue to Lynwood Avenue as a project that could best be accomplished by a consultant. The Tribe committed a total of$5.5 million for design and construction of soundwalls, roadway improvements, traffic controls, drainage and right-of way acquisition. On January 10, 2005, the Mayor and Common Council adopted Resolution No. 2005-008 approving an Agreement for Professional Services with Engineering Resources of Southern California, Inc. (ERSC) to provide Civil/Traffic Engineering Services for the Design of Street, Storm Drain, Traffic Signal, and Sound Wall Improvements along Victoria Avenue from Highland Avenue to Lynwood Avenue. Early in the design process it was determined that the project should be divided into two phases in order to expedite construction. Phase I of Victoria Avenue between 28th Street and Lynwood Drive focused on street improvements, beautification and soundwall improvements. Hillcrest Construction completed Phase I in early 2009 and the City accepted the work. Phase II consists mainly of work in the intersection of Victoria Avenue and Highland Avenue in order to add a double left turn from eastbound Highland Avenue to northbound Victoria Avenue. Phase II required the acquisition of right of way in the City of Highland. The City of Highland successfully completed that acquisition in late 2008. On May 4, 2009, the Mayor and Common Council adopted Resolution No. 2009-108, approving Amendment No. One to the Agreement for Professional Services with ERSC to finalize details of the design of Phase 1I. Numerous changes were necessary to accommodate the requirements of the City of Highland. Additionally, staff has determined that design changes were needed to accommodate a left turn pocket from northbound Victoria Avenue for the San Bernardino County Flood Control at its Patton Basin. These changes have made it necessary for ERSC to modify the previously completed design for the intersection of Highland Avenue and Victoria Avenue and a portion of Victoria Avenue between Highland Avenue and 28th Street. 2 CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT—Continued On January 13, 2010 a meeting was held between the San Manuel Tribe, the City of Highland and the City of San Bernardino to resolve remaining issues with the design of Phase II of the project. Staff was advised the Tribe has acquired most of the property at the southwest comer of Victoria Avenue and Highland Avenue. The existing bungalows at that location are now vacant; therefore, it is no longer necessary to provide access and parking for the bungalows. It is the intent of the Tribe to remove the bungalows from the property. The Tribe agreed that all proposed improvements to the bungalow properties could be eliminated from the Phase II plans and requested that a 5' high bronze colored wrought iron fence be installed along the Highland Avenue frontage. ERSC was advised of the necessary plan changes and has submitted a letter proposal dated February 2, 2010 requesting an Amendment to their Agreement and compensation in the amount of$4,100.00. Staff has reviewed ERSC's proposal and feel that the amount requested is fair and reasonable for the services to be provided. If this Amendment is approved, the Phase II design work can be completed in approximately one month and the project can be advertised for bids in April 2010. Construction can start in July 2010 and be completed by April 2011. The services of ERSC will be needed through the end of construction and project closeout; therefore, staff is recommending that the term of the contract be extended through June 30,2011. Financial Impact: Adequate funding is available in Account Nos. 246-366-5504-7549, 7550 & 7551 "(SS05-25) Widen Victoria Avenue from Highland Avenue to Lynwood Avenue" to cover the cost of this Amendment. Pursuant to this determination, the Director of Finance 16 is hereby authorized and directed to increase the Purchase Order for said services to said firm 17 which references this resolution. WITNESSETH: A. WHEREAS, on January 10, 2005, Resolution No. 2005-008 was adopted by the City approving an Agreement for Professional Services with Consultant to provide Civil/Traffic Engineering Services for the Design of Street, Storm Drain, Traffic Signal, and Sound Wall Improvements along Victoria Avenue from Highland Avenue to Lynwood Avenue(SS05-25); and, B. WHEREAS, on May 4, 2009, Resolution No.2009-108 was adopted approving Amendment No. One to Agreement for Professional Services with Consultant to provide Civil/Traffic Engineering Services for the design of street, storm drain, traffic signal, and sound wall improvements along Victoria Avenue from Highland Avenue to Lynwood Avenue(SS05-25); and, C. WHEREAS, the City has need of additional Professional Services from Consultant not included in the scope of services of said Agreement or Amendment thereto; and, D. WHEREAS, Consultant has submitted a letter proposal dated February 2, 2010 offering to provide the additional Professional Services; and E. WHEREAS, said Agreement was approved for a term of one year after the date of approval of the Agreement; and F. WHEREAS, the City will need the services of Consultant through the construction period which is estimated to be 16 months. NOW THEREFORE,the parties hereto agree as follows: Section 1. "Scope-of Services" is hereby amended to add the following: Consultant shall perform those additional services specified in Consultant's letter proposal dated February 2, 2010, attached and incorporated herein as Attachment "A., Section 2. These changes have or will entail revised design and revision to the plans, specifications, and estimates. Changes necessary to be made are as follows. 1. Revise the bid schedule and cost estimate from the original single schedule and cost estimate into three schedules and three cost estimates. This was done at the request of the City to segregate cost of construction for Victoria and Highland Avenues improvements,for the work on the private property at the southwest comer of Victoria and Highland Avenues, and for the work to be done on Patton Basin. 2. Since the San Manuel Tribe has acquired the three"bungalow parcels at the southwest comer of Victoria Avenue and Highland Avenue, it is desired that all onsite improvements previously negotiated be deleted. The only onsite improvement desired is that of a decorative picket fence fronting Highland Avenue and a short distance southerly on Victoria to join an existing fence. The decorative fence is to match that of the fence placed at the northeast corner of the San Manuel parking lot. We have not been able to obtain plans of the existing fence, so have conducted a field visit to measure and note the construction details.We will then detail the construction required. 3. These will be shown and specified to be relocated by the utility owner. We will seek the installation plan from the City of Highland and specify relocation on the street improvement plan. 4. Revisions will be made to the storm drain modification design on Victoria Avenue, approximately 1,850 feet south of Highland Avenue. This was determined to be advantageous to the City since the existing 18-inch.drain is reinforced concrete pipe and in good condition and will not result in any interference with utilities. Rather than the current design of constructing a new storm drain pipe, the existing will be retained, the existing catch basin converted to a junction structure between the 18 and 30-inch, and a new replacement catch basin designed for construction on the west side of the street. Revisions to the plans,specifications, and estimate to reflect these changes in design will be completed for a lump sum amount of$4,100. Total contract amount will then be$402,600. Based on our discussions and understanding, we have completed the work described in Item No. 1 and will proceed with changes described in Items Nos. 2, 3, and 4. It is requested that our contract then be amended to compensate ERSC for the additional services required and expended in the amount of$4,100.
