Ways and Means recommended expansion of the applicability of the Development Impact and City processing fees reductions and expansion of the Development Impact Fee deferral program. July 19, 2010. The Mayor and Common Council adopted resolutions to reduce certain Development Impact Fees and City processing fees and to expand the Development Impact Fee deferral program. Background: At the July 19, 2010 Mayor and Common Council meeting,resolutions were adopted for the following: • Reduction of certain Development Impact Fees by 50% for two years for single family subdivisions of five or more lots, commercial projects of 40,000 square feet or more, and office projects of 50,000 square feet or more. • Expansion of the Development Impact Fee Deferral program to include deferral of DIFs for non-residential projects (residential subdivisions were already included). • Reduction of certain City processing fees by 50% for two years for single family subdivisions of five or more lots. After considerable discussion,the matter was referred back to Ways and Means Committee for consideration of expanding the DIF and City fee reduction programs to include condominiums and townhome and removal of the minimum square footage for commercial and office projects. At their meeting of July 21, 2010,the Ways and Means Committee, with Councilmembers Shorett, Johnson, and Kelley present, recommended the following: • Expand the reduction of certain DIFs to include condominiums and townhomes of five or more units and commercial and office projects with no minimum square footage. • Expand the DIF deferral program to include condominiums and townhomes of five or more units. Commercial, office, and industrial are still included. • Expand the reduction of certain City processing fees to include condominiums and townhomes of five or more units and commercial and office projects with no minimum square footage. Financial Impact: • Temporary DIF Reduction Program. The City would only collect 50%of the specified DIFs upon issuance of permits. For FY 2010/11, the impacts would be minimal because revenue projections did not anticipate a lot of new development. At this time, a determination cannot be made for FY 2011/12. 2 CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT - Continued • DIF Deferral Program. There is no impact to the City. All DIFs are paid before the utilities are released. • Temporary Reduction of certain City processing fees. The City would only collect 50% of the City processing fees. For FY 2010/11,the impacts would be minimal because revenue projections did not anticipate a lot of new development. At this time, a determination cannot be made for FY 2011/12. PENMAN, City Attorney 26 27 By: 28 2 I RESOLUTION NO. r 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SA 3 BERNARDINO RELATING TO THE DEFERRAL OF CERTAIN DEVELOPMENT a IMPACT FEES ESTABLISHED BY RESOLUTION NO. 2006-97 AND REPEALING RESOLUTION NO. 2010-247. 5 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 7 SAN BERNARDINO AS FOLLOWS: 8 SECTION 1: For the construction of new single-family subdivisions, townhomes, an 9 condominium projects of five or more units, and for the construction of new commercial, office 10 I I or industrial projects, the following fees established by Resolution No. 2006-97 may be deferred 12 at the request of the owner of the property until the release of utilities is issued or eighteen (18 13 months from the issuance of the Building Permit, whichever is less: Law Enforcement Facilities 14 Vehicles, and Equipment; Fire Suppression Facilities, Vehicles, and Equipment; Regional 15 Circulation System; Local Circulation System; Parkland and Open Space Acquisition and Paz 16 17 Improvement; Library Facility and Collection; Public Meeting Facilities; Aquatics Facilities; an 18 Storm Drain Development. The owner of the property shall personally guarantee payment of the 19 fees, sign documents authorizing the City to place a lien on the property in the amount of the 20 fees, agree to place the payment of the fees in any escrow for the sale of the property, authorize 21 22 the City to demand payment in any such escrow, and pay an administrative fee set by resolution 23 of the Mayor and Common Council. The amount of the fees due shall be the amount in effect at 24 the time of collection of the fees. In no event shall utilities be released until the fees are paid 25 except that electrical service may be released at the discretion of the Building Official wher 26 necessary for security or maintenance purposes. 27 28 SECTION 2: Resolution No. 2010-247 is hereby repealed.
