Description) CID Reimbursements Finance: Council Notes: �50 �O/O- S� Agenda Item No. CITY OF SAN BERNARDINO — REQUEST FOR COUNCIL ACTION Staff Report Subject: Resolution of the Mayor and Common Council authorizing the City Manager to execute an agreement between the City of San Bernardino and Friends of the Center for Individual Development(C.I.D.). This agreement between the City of San Bernardino and the Friends of the C.LD will provide for personnel costs of one full-time Recreational Therapist position and eleven part-time positions. Said personnel will provide activities in support of the Center for Individual Development. Background: The Center for Individual Development (C.I.D.) is a recreation center, serving people with disabilities along with their family and friends. The individuals served at the C.I.D. range in age from 6 months to 80 years of age. These disabilities include physical disabilities, developmental disabilities and mental illness. Senior citizens and individuals without disabilities also participate in the C.I.D. programs. Also included in the Center's programs are the aquatic programs, Teen Club,an after school program, Merri-Mixer and Project LEO. C.I.D. programs also include after-school recreation, warm water pool and spa exercise, aerobics and Water Babies. Programming at the C.I.D. promotes healthy lifestyles, physical fitness and mental well being. The therapeutic recreation programs at the C.I.D. have been sponsored by the City of San Bernardino Parks, Recreation and Community Services Department. Currently, program staffing include a full-time Program Manager, a full-time Recreational Therapist and eleven part-time staff of which all are employed by the City of San Bernardino. In light of the City's current financial condition, the City is no longer able to fund the Center at its current level. The Friends of C.I.D., a non-profit corporation formed to support and fundraise for the San Bernardino Center for Individual Development have indicated their willingness to assist the City in funding staff in an effort to continue the programming at the C.I.D. Financial Impact: The Friends of the C.I.D. are willing to donate $100,000 for FY 2010/11 in an effort to fund the salaries and benefits. This will include up to eleven part-time program staff and one full-time Recreational Therapist. This contribution will provide for ongoing C.I.D. programming expenses for the period July 1, 2010 through June 30, 2011. The City currently contributes $132,300 toward the C.I.D. Manager's salary and benefits. Donations to C.I.D. will he disbursed in $25,000.00 increments beginning September 30, 2010, December 31, 2010, March 31, 2011 with final disbursement, June 30, 2011. The $100,000 revenue has already been accounted for and reflected in the approved FY10/11 Budget document. That the City Manager is authorized to execute an Agreement for C.I.D. staff 10 funding between Friends of the C.I.D. and the City of San Bernardino, a copy of which is 11 attached hereto, marked Exhibit"A"and incorporated herein by reference as fully as though set 12 forth at length; 13 SECTION 2: That the authorization to execute said Agreement is void and of no effect 14 if it is not executed within thirty days of the date that this Resolution is adopted. 15 16 SECTION 3. AND CITY OF SAN BERNARDINO This Agreement is made and entered into by and between the FRIENDS OF C.I.D., a California non-profit corporation("FRIENDS") and the CITY OF SAN BERNARDINO, a municipal corporation("CITY'),hereinafter the"Parties." WHEREAS, the CITY is a member of a joint powers agency, the Authority for the Handicapped of San Bernardino County("AUTHORITY"); and, WHEREAS,the FRIENDS is a non-profit corporation formed to provide support and fundraising for the San Bernardino Center for Individual Development("C.I.D.'); and, WHEREAS, certain C.I.D. staff, to wit, a full-time C.I.D. Program Manager, a full-time Recreation Therapist, and eleven part-time staff are CITY employees; and, WHEREAS, the current financial condition of CITY is such that it can no longer afford to fund C.I.D. at its current level; and, WHEREAS, almost all CITY employees paid from the General Fund, including C.I.D. staff, have been put on a furlough program through June 30, 2011,wherein their salaries have been reduced by ten percent; and, WHEREAS, it is the intent of FRIENDS to assist the CITY in funding so as to continue i C.I.D. Park, Recreation &Community Services Department programs, including C.I.D. Aquatic programs, the Teen Club after school program,the Merri-Mixer Program and Project LEO; i THE PARTIES AGREE AS FOLLOWS: 1. FRIENDS' OBLIGATIONS A. No other expenditures made by CITY shall be reimbursed or funded by FRIENDS without the prior written authorization of FRIENDS upon the approval of its Board of Directors. B. The $100,000 donation shall be made in four equal quarterly installments of $25,000.00 on September 15,2010,December 15, 2010, April 15, 2011 and June 15,2011. 2. CITY'S OBLIGATIONS A. CITY shall continue to employ the following C.I.D. staff: one full-time C.I.D. Program Manager,one full-time Recreational Therapist and up to eleven part-time staff. B. CITY shall continue to pay the salary and benefits of the full-time C.I.D. Program Manager,which is anticipated to be(including wages and benefits, and after a 10% furlough reduction): $88,473.60 for FY 010/11. C. CITY shall continue to provide C.I.D. Parks,Recreation &Community Services ^ Department Programs on the same schedule and at the same level of programming existing as of F�•• March 1,2009, including but not limited to: Twinges in the Hinges Aquatic Programs,the Teen Club after school program,the Merri-Mixer Program, and Project LEO. D. CITY shall continue to meet its obligations under its contract with the AUTHORITY. E. CITY agrees that if its financial condition recovers to the extent that it discontinues employee furloughs prior to June 30, 2011, it will make a good faith effort to restore funding for the Recreation Therapist and up to eleven part-time staff, and relieve FRIENDS of any further obligations under this Agreement. 3. TERM; TERMINATION The term of this Agreement is July 1, 2010 through June 30, 2011. Either party may terminate this Agreement at any time by thirty(30) days' written notice.
