Background: On June 30, 2010, the Mayor and Common Council approved a 30-day extension of the General Unit 10% concession Side Letter agreement. On July 31, 2010, this extension will expire. The General Unit has agreed to extend the Side Letter an additional 15 days, until August 15, 2010, to provide an opportunity to review proposals, counter proposals and reach an agreement with the City. The Human Resources Department recommends that the Mayor and Common Council adopt the attached Resolution. Financial Impact: General Fund savings total $81,500. Recommendation: Adopt Resolution. I RESOLUTION NO. COPY 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING EXTENSION OF SIDE LETTERIRESOLUTION FOR 3 THE GENERAL BARGAINING UNIT. 4 5 WHEREAS, the General Unit entered into a Side Letter to provide a 10% salary reduction 6 administered through a 36-hour reduced work week; 7 WHEREAS, pursuant to the Side Letter, the aforesaid employee concessions were to 8 expire on July 31, 2010; 9 10 WHEREAS, the City is in contract negotiations with this employee group and desires to 11 continue the aforesaid concessions; 12 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 13 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 14 SECTION 1: The City Manager of the City of San Bernardino and the Director of Human 15 Resources are hereby authorized and directed on behalf of the City to extend the termination date 16 of the following Side Letter/Resolution from July 31, 2010 to August 15,2010: 17 18 General Unit—Side Letter/Resolution No. 2010-217 19 SECTION 2: Side Letters executed by the affected employee groups reflecting the 20 extension of the above-mentioned termination date is attached hereto and incorporated herein, 21 marked as Exhibit A. 22 23 24 1 25 27 28 I RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING EXTENSION OF SIDE LETTERIRESOLUTION FOR 2 THE GENERAL BARGAINING UNIT. 3 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and 4 Common Council of the City of San Bernardino at a meeting thereof, held 5 on the day of 2010,by the following vote,to wit: 6 7 Council Members Ayes Nays Abstain Absent 8 MARQUEZ 9 DESJARDINS 10 BRINKER 11 SHORETT 12 KELLEY 13 JOHNSON 14 15 MC CAMMACK 16 17 City Clerk 18 The foregoing resolution is hereby approved this day of 2010. 19 20 Patrick J. PENMAN City Attorney 24 By: 25 26 27 28 2 EXHIBIT A SIDE LETTER AMENDMENT/AGREEMENT TO SIDE LETTERS 2009-33 AND 2009-68 BETWEEN THE CITY OF SAN BERNARDINO AND THE GENERAL UNIT The following sets forth an amendment to Side Letters 2009-33 and 2009-68 for frill-time, non- safety General Unit employees and extends the termination date outlined in said Side Letters from July 31,2010 to August 15,2010.
