HARDGRAVE Subject: Protest hearing and Resolution Confirm- ing Assessment Roll --- Underground Dept: Public Works / Engineering Utility Assessment District No. 19 Date: May 3, 1993 (Waterman Avenue) Synopsis of Previous Council action: 11-21-88 Authorization to proceed with the formation of an Underground Utility Assessment District was granted and Resolution No. 88-440 was adopted, setting a Public Hearing for 01-03-89. 06-05-89 Resolution No. 89-171 was adopted, creating Underground Utility Assessment District No. 19 04-06-92, 06-16-92, 07-09-92 Authorization to proceed was given to cause the undergrounding of certain parcels located within Underground Utility District 19 Zones 3, 2 and 1 respectively. 04-05-93 Resolution No. 93-97, accepting report of costs and setting date for public meeting and public hearing was adopted. 05-10-92 Public meeting was held and protests, if any, were carried over to public hearing. Description) REIMBURSED THROUGH ASSESSMENTS Finance: Council Notes: 75-0262 Agenda Item No CITY OF SAN BERN. .RDINO - REQUEST I )R COUNCIL ACTION STAFF REPORT The attached Resolution confirms the Assessments for Underground Utility Assessment District No. 19 (Waterman Avenue) . Adoption of the resolution will allow the City to recover the cost of undergrounding of overhead utilities on certain parcels, and its adoption is therefore recommended. On November 21, 1988, this office was authorized to proceed with the formation of Underground Utility Assessment District No. 19 along Waterman Avenue, between 9th Street and the Santa Ana River. All property owners in the district and all affected utilities were notified and a public hearing was held on January 3, 1989. On June 5, 1989, Resolution No. 89- 171 was adopted, creating Underground Utility Assessment District No. 19. Notice to convert was given to all property owners within Zones 1,2 and 3 of the district. Pursuant to S.H.M.C. Section 13.060.090, any work not performed within the prescribed time can be caused to be completed by the Director of Public Works/ City Engineer. On 04-06-92, 06-15-92 and 07-09-92, the Director of Public Works/City Engineer was authorized to proceed with causing the necessary work to be done within Zone 3, Zone 2 and Zone 1 respectively, on those parcels where their respective owners had not completed the necessary work. That the Mayor and Common Council do hereby find and 20 determine that the costs to be levied against the parcels of land lying 2I 22 within Underground Utility District No. 19, designated as Exhibit "A" and 23 incorporated herein by reference, are correctly set forth and do hereby confirm said assessments. 24 SECTION 2. the City of San Bernardino, acting through it's Director of 25 26 Public Works/City Engineer, does hereby claim a lien on all of the properties listed in said assessment roll in the amounts so listed which are 27 not paid within five (5) days from the date of the adoption of this 2$ Resolution and the same shall be a lien upon said real property and 05-03-93 RESOLUTION CONFIRMING ASSESSMENTS: UNDERGROUND UTILITY ASSESSMENT DISTRICT NO. 19 (WATF-"AN AVENUE) 1 collected with the property taxes.
