A total of 6 bids were received, ranging from $84 , 645 . 62 to $144 , 661 . 68 . The Bid Schedule for Zone 3 , of Assessment District No. 952, was inadvertently left out of the final contract documents. The low bidder has agreed to perform the landscape maintenance in Zone 3 at the same unit prices in his bid for the other zones. Change Order No. One will authorize the inclusion of Zone 3 in the contract, at an increase of $15 ,405. 00 in the contract price, from $84 , 645 . 62 to $100, 050 . 62 . The adjusted low bid price of $100, 050. 62 is 44 . 98 under the Engineer' s Estimate of $181 , 616. 00 . Below is an estimate of the total annual cost for providing these landscape maintenance services, from 7-1-93 to 6- 30-94 . Maintenance Contract: $ 100, 050. 62 Incidental Costs (Assessment Engineering, Publishing and Recording Fees, Inspection by Dept. of Parks & Recreation, Water, Administrative Fee, Electricity, and Advertising for Bids) 66, 261. 00 TOTAL ESTIMATED ANNUAL COST $ 166,311.62 Funds to finance the costs incurred for 1992/93 were provided through an interfund loan from the Sewer Line Construc- tion Fund (245) . The actual costs incurred will be recovered in the following year through assessments on the parcels within Assessment Districts No. 951 and 952 . Costs that will be incurred for 1993/94 Fiscal Year will be advanced from the General Fund and recovered in the following year through assessments on the parcels within these districts. Inspection will be provided by the Department of Parks, Recreation and Community Services. Mentone Turf Supply is the lowest responsible 6 bidder for: Maintenance of Landscaping in Assessment Districts 7 Nos. 951 , 952 and 1002 , per Plans Nos. 6192-A, 6056-A and 8302 . 8 A contract is awarded accordingly to said bidder for the total 9 amount of $84 , 645. 62 , but such award shall be effective only upon 10 the contract being fully executed by both parties. All other 11 bids , therefore, are hereby rejected. The Mayor is hereby 12 authorized and directed to execute said contract on behalf of the 13 City; a copy of the contract is on file in the office of the City 14 Clerk and incorporated herein by reference as fully as though set 15 forth at length. 16 SECTION 2 . This contract and any amendment or modifica- 17 tions thereto shall not take effect or become operative until 18 fully signed and executed by the parties and no party shall be 19 obligated hereunder until the time of such full execution. No 20 oral agreements, amendments, modifications or waivers are 21 intended or authorized and shall not be implied from any act or 22 course of conduct of any party. 23 SECTION 3.
