SAN BERNARDINO CREATING AND ESTABLISHING POSITIONS FOR THE VARIOUS
3 DEPARTMENTS OF THE CITY OF SAN BERNARDINO , AND REPEALING RESOLO-
TION NO . 2771.

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO THAT:
7 SECTION ONE . POSITIONS. CREATED AND DEFINED . The offices,
8 employmentsand positions hereinafter designated in this resolution,
9 except insofar as they are specifically provided for by the Charter
10 of the City of San Bernardino, are hereby created.
11 Wherever the word "position" is hereinafter used, it shall
12 be deemed to mean and refer to all offices, employments and posi-
13 I tions.

14 SECTION TWO ; POSITIONS. DEFINITIONS OF DUTIES. The defi-
15 nitions, typical tasks of each position herein mentioned, except
16 as may be otherwise provided by the Charter of the City of San Ber-
17 nardino, shall be those which are or may be hereafter defined by
18 the classification plans and class specifications for the City of
19 San Bernardino by the Mayor and Common Council of the City of San
20 Bernardino.

21 SECTION THREE: That the following employees of the City of
22 Bernardino are hereby provided for and shall be employed , to-
23 wit.
24 1. Recreation Director
25 2. Planning Director
26 3. Refuse Superintendent
27 4. Automotive Shop Superintendent
28 5. Electrical Superintendent
29 That said Recreation Director, Planning Director, Refuse
30 Superintendent, Automotive Shop Superintendent and Electrical Super-
31 intendent shall be in the classified service of the Civil Service
38 of the City of San Bernardino.

28 SECTION FIVE : SICK LEAVE : Sick Leave means the absence from
29 '1: duty of an officer or employee because of illness or injury, ex-
30 posure to contagious disease, attendance upon a member of his
31 immediate family who is seriously ill and requires the care of or
32 attendance of the officer or employee, or death in the immediate
I family of the officer or employee,
2 Immediate family means : husband , wife, grandmother, grand-
3 father, mother, father, sister, brother, son or daughter, providing
4 he or she lives in the same household.
s All appointive officers and all employees of the City of San
6 Bernardino (exclusive of those employees under the Board of Water
7 Commissioners and the Free Public Library Board) who are actively
8 on duty in any calendar year, have been in the service of said City
gillfor one year or more continuously, and who are compelled to be
10 � absent from their work on account of illness or injury, other than
11 that caused by or arising from their own moral turpitude, or that
12 which is compensable under Section 6 of this Resolution , shall be
13 entitled , after one calendar year of continuous service after Janu-
14 ary 1st, 1957 to receive their full salary, wages or compensation
is for a period of twelve working days and thereafter, shall receive
16I their full salary, wages or compensation for a period of one day
17 for each month of continuous service ; provided, that Sick Leave
shall not accumulate while said employees or officers are being
19 compensated under the provisions of Section 6 of this Resolution.
20 Time off with pay for Sick Leave shall be considered as time worked
21 and no deduction shall be made therefor. Such working days shall
23Inot be decreased by the fact that any legal holiday occurs during
time off on account of illness. Such legal holidays shall be as
24 defined in Section 7 of this resolution. Such working days shall
25 not be increased by the fact that any other assigned "Time Off" days
26 occur during time off on account of illness. A working day, as
27 referred to herein , shall mean a normal eight-hour day to which an
28 employee has been assigned to work , and in case of monthly paid
29 " employees working half days on Saturday, such days shall be consi-
30 dered as a full working day, Said Sick Leave may be accumulated
31 without limit from January 1st, 1957, and to such accumulation shall
32 be added the accrued Sick Leave days in effect for such officer or
I employee as of December 31st, 1956, and no additional Sick Leave
2 with pay beyond that accumulated shall be granted,
3 Compensation for Sick Leave shall be allowed only upon sub-
4 mission by the employee of a statement to the Head of the Depart-
s ment, setting forth the period of absence and nature of illness,
6 The Administrative Officer shall not approve payment for Sick
7 Leave unless such statement accompanied the time sheets as pre-
8 sented to him by the Head of the Department,
9 Not more than five days of Sick Leave within any calendar
10 year may be granted to an officer or employee for the care of or
11 attendance upon members of his immediate family. Not more than

12 five days of Sick Leave may be granted to an officer or employee
13 for each absence due to death of a member of his immediate family
14 as defined above, or his mother-in-law, father-in-law, sister-in-
15 j law, brother-in-law, daughter-in-law or son-in-law,
16 I No absence due to illness or injury in excess of five (5)
17 i working days will be approved except after satisfactory evidence
18 of illness or injury; and a certificate from a practicing physi-
19 cian or the City Health Officer may be required by the Head of the
20 Department and shall be subject to his acceptance covering said
21 I absence, The Mayor and Common Council shall have the right to
22 require that any person claiming the Sick Leave benefit of this
23 i resolution, be examined at any reasonable time or intervals by
24 the City Health Officer or other designated physician, and in the
25 event of an adverse report, to reject such claim, in whole or in
26 part, or to terminate the Sick Leave Compensation, In the event
27 of the refusal of any person to submit to such examination after
28 the request, the Mayor and Common Council may terminate the Sick
29 Leave and/or reject any claim therefor, The Mayor and Common
30 Council shall have the right to require a certificate from a prac-
31 ticing physician or the City Health Officer stating that an offi-
32 cer or employee is able to return and perform his work and duties

I satisfactorily before an officer or employee who has been on Sick
2 Leave shall be allowed to return to work,
3 Whenever any person entitled to Sick Leave, as stated in this
4 resolution, shall have been in the service of the City of San Ber-
5 nardino continuously for five years or more, upon his written appli—
6 cation, approved by the Head of the Department, the Civil Service
7 Board accompanied by a report from a practicing physician or the
8 iCity Health Officer stating the extent or nature of the illness of
9 said applicant and approximately the time required for recovery,
10 the Mayor and Common Council may grant to said person an extra leave
11 of absence because of illness without compensation, in addition to
12 ' the provisions of this resolution. A leave of absence without pay
13 may be granted to any employee of the City of San Bernardino, sub-
14
� ject to the rules and regulations governing Civil Service officers
15 'i or employees,
16 Whenever the term " service of City" appears herein, it shall
17 be deemed to include all service of the City of San Bernardino,
18 the San Bernardino Board of Water Commissioners and the San Bernar-
19 dino Free Public Library Board,
20 When an employee is off the payroll on pay because of sick
21 lileave or injury and has not had a vacation at the end of the current
22 year, he shall be allowed to take his vacation in the next calendar
23 year, but must take said vacation prior to the time he returns to
24 work after his illness or injury,
25 SECTION SIX: INJURY LEAVE : When injury is sustained in
26 the course of, arising out of and proximately caused by , the per-
27 formance of duties of the employment under the Mayor and Common
28 ' Council of the City of San Bernardino, said employee shall be com—
29 pensated under the provisions of the Workmen' s Compensation Insur-
30 ance and Safety Act of California, and not under the provisions of
31 this resolution ; provided, however, that during the first seven
32 days of necessary absence for such cause, the disabled person shall

I receive one hundred per cent (\100%) of his normal salary or wages
2 for that period,
3 When an employee is off the payroll on pay because of sick

8 SECTION SEVEN: HOLIDAYS: The following days shall be holi-
gl days for the purpose of this resolution :
10 New Year' s Day
Washington ' s Birthday
11 Memorial Day
Independence Day
12 I'' Labor Day
Admission Day
13 Veteran' s Day (Armistice Day)
Thanksgiving Day
14 Christmas Day
15 I All employees with the exception of those in the Police De-
16 partment, Fire Department, Refuse Disposal Department and Municipal
17 Transit System, shall be allowed the above holidays at full pay,

13 when such holidays occur within the regular assigned working period,
19 If it becomes necessary for an employee to work on any of the above
20 mentioned holidays, then he shall be allowed another day off of
21 equal time and pay as would be approved by the Head of his Depart-
22 ment.
23 Members of the Police Department and Fire Department shall
24 be allowed compensatory time off for the above holidays at full pay,
25 when such holidays occur within the regular assigned working period ;
26 and such compensatory time off shall be added to the regular annual
27 � vacation period or termination date of service. Holidays as set
28I forth shall be credited subsequent to July 1st, 1961 , and the first
29 effective starting compensatory time off for such holidays shall
30 be during the 1962 calendar year,
31 Members of the Municipal Transit System shall enjoy all of the
32 holidays listed above as they occur except Washington' s Birthday,
I February 22nd, Admission Day, September 9th and Veteran' s Day ,
2 November 11th, on which days the Municipal Transit System will
3 operate and the employees of said System assigned to work such
4 days shall have compensatory time off. Holidays as set forth
5 shall be credited subsequent to September 5th , 1961, and the first
6 effective starting compensatory time off for such holidays shall
7 be during the 1962 calendar year.
g Members of the Refuse Disposal Department; namely, the Refuse
9 Crew Foreman, Refuse Crew Field Checkers, Refuse Crew Leadmen and
10 Heavy Laborers shall work all holidays except Independence Day,
11 July 9th, Thanksgiving Day and Christmas Day, December 25th , and
14 the other six holidays will be added to their annual vacation , if
13 such holidays occur within the regular assigned working period.
14 Holidays as set forth shall be credited subsequent to September 5,

15 1961 , and the first effective starting compensatory time off for
16 such holidays shall be during the 1962 calendar year.
17 No cumulative holiday time in any one calendar year shall be
IS used in a subsequent calendar year.
19 SECTION EIGHT: OTHER LEAVE OF ABSENCE : All employees of
20 the Fire Department shall be allowed one day off with pay for each
21 six days worked, such days off not to exceed four days in any one
22 calendar month. Time off not to be cumulated from one month to

23 another.
24 All employees of the Police Department shall be allowed 2
25 days off duty for each 5 days of actual work. Said time off to
26 be taken within each month but limited to 9 days off in any one
27 ',• month . However, days off in any one month shall not be consecutive
23 ',x; with days off in the preceding month. Time off not to be cumulated

29 from one month to another.
30 An employee who shall enter the Armed Forces of the United
31 States during war or national emergency, as declared by the Presi-
32 dent or the Congress of the United States, shall be entitled to a

I leave of absence without pay during such service and for a period
2 of ninety days thereafter. Every such employee and/or officer re-
3 turning to the City within the time herein specified, and who has
4 been honorably discharged from such service shall be reinstated
s without loss of status or seniority, provided they are not physi-
6 cally or mentally incapacitated from performing the duties of said
7 office or position.
S That all persons appointed to fill such positions during
9 war or such national emergency, shall be temporary appointees only.
10 Any employee who is absent from his duties on account of
11 being called to service in the Armed Forces of the United States
12 Shall be entitled to two calendar weeks earned vacation as may
13 have been earned based upon the anniversary date of one full year
14 of service to the effective date of his leave of absence ; and in
is addition, shall receive two calendar weeks vacation allowance.
16 SECTION NINE ; CONTINUOUS SERVICE DEFINED : Whenever the term
17 "years of employment" or "continuous service" appear in this resolu-
1S- tion , it shall be deemed to mean that employees compensated on a
19 monthly basis shall have completed ten months or more of compensa-
20 ted service within the twelve (12) months period immediately pre-
21 ceding the date of the employees return to service ; and that emp-
22 loyees compensated on a daily basis , working five days a week ,

23 ' shall have completed 217 or more compensated days within the twelve
24 ( 12) months period immediately preceding the date of the employees
25 return to service ; and that employees compensated on a daily basis ,
26 working six days a week , shall have completed 261 or more compensate
27 days within the twelve ( 12) months period immediately preceding the
26 date of the employees return to service. This section shall not
29 apply to employees who have not completed one year of actual com-
30 pensated employment.
31 SECTION TEN: AWARD OF SERVICE PINS: Employees of the City
32 of San Bernardino shall be awarded service pins upon completion of
I each of the following period of years of continuous loyal service :
2 Five Years
Ten Years
3 Fifteen Years
Twenty Years
4 Twenty-Five Years and Over
S Years of service shall be deemed to include all continuous
6 loyal employment, as defined in Section 9 of this resolution , for
7 the City of San Bernardino, the San Bernardino City Board of Water
8 Commissioners and for the Free Public Library Board.
91j Award of service pins for the above designated service shall

10 i be made as soon as may be practicable after the employee has com-
1111 pleted the required period of employment.
12 Service pins shall be of such design as approved by the
13 Mayor and Common Council of the City of San Bernardino and shall
34 j show the number of years of service for which the award is made and
is I the City seal of the City of San Bernardino.
16 SECTION ELEVEN: VACATION; Every employee of the City of
17 l San Bernardino (exclusive of those employees under the Board of
i
18 Water Commissioners and the Free Public Library Board) shall be
19 allowed vacation as follows :
20 (a) After completion of one ( 1 ) full year of employ-
ment by the City of San Bernardino, every employee
21 shall be allowed vacation equivalent to two (2)
calendar weeks with pay for each year of employ-
22 ment. Vacation shall accrue at the rate of 1. 166
calendar days per month for employees having from
23 one (1) to and including fifteen (15) years of
employment.

(b) When any such employee has completed fifteen (15 )
25 full years of employment by the City of San Ber-
nardino, thereafter, such employee during the
26 sixteenth (16) calendar year and thereafter until
the completion of twenty-five (25) full years of
27 employment, shall be allowed vacation equivalent
to three (3) calendar weeks annually. Vacation
28 shall accrue at the rate of 1. 75 calendar days
per month for employees having from fifteen ( 15 )
29 to and including twenty-five (25) years of emp-
loyment.

(c) When any such employee has completed twenty-five
31 (25) full years of employment by the City of San
Bernardino, thereafter, such employee during the
32 twenty-sixth (26) calendar year and thereafter,
upon completion of each full year of employment,
I shall be allowed vacation equivalent to four (4)
calendar weeks annually. Vacation shall accrue
2 at the rate of 2, 33 calendar days per month for
employees having over twenty—five (25) years of
3 employment.
4 Compensation for the above vacation, other than payment for
3 earned vacation at time of termination of employment, shall be for
6 the amount normally earned for regular assigned working time, other
7 than overtime.
8 Wherever the terms "year or years of employment" appear
9 herein , it shall be deemed to include all service for the City of
10 San Bernardino, the San Bernardino City Board of Water Commissioners
11 and for the San Bernardino Free Public Library Board.
12 ii No vacation or portion thereof from any one year shall run
13 1 consecutively with the vacation of the preceding year. A period
14 of three or more months must elapse between the expiration of one
is year ' s vacation and the commencement of the next following year' s
16 I vacation.
17 Employees shall not be permitted to work in their City posi—
18 tion in lieu of taking vacations in order to receive additional
19 compensation from the City.
20 The vacation period to which any employee shall be entitled
21 I shall be assigned by the Head of the Department in the calendar
22 year when due.
23. When a holiday , authorized by the Mayor and Common Council,
24 occurs within the vacation period of an employee, then such emp-.
25 loyee shall receive an additional day of vacation with pay, except
26 those employees of the Police and Fire Departments who receive
27 additional vacation time in lieu of holidays.
28 � When an employee resigns or otherwise leaves the service
29 II of the City of San Bernardino and has not had his earned vacation
30 �„ since his last anniversary date, then payment shall be made to the
31 employee for the earned portion of his vacation.

3211 When an employee resigns or otherwise leaves the service of

i the City of San Bernardino prior to the next anniversary date of
2 his employment and has received a vacation with pay under the
3 provisions of this resolution prior to his termination of service,
4 then a deduction will be made in such employee' s final pay period
5 for the unearned portion of his vacation.
6 Calculation of payment for earned vacation, or deduction for
7 unearned vacation upon termination , shall be made on the basis
8 i of the annual salary of such employee. The annual salary shall
9 be computed at twelve (12) times the monthly rate for monthly emp-
101!,, loyees ; 261 times the established daily rate for 5-day week emp-
I
11 loyees ; 313 times the established daily rate for 6-day week emp-
12 loyees. The annual salary divided by 365 will secure the vacation
13 daily rate. This rate multiplied by the number of earned or un-
14 earned vacation days will result in the amount to be paid res-
15 pectively for earned vacation due the employee or for unearned
16 III vacation due the City of San Bernardino by the employee.

17 When an employee returns to work after a break in "continuous
18 �I service" as defined in Section 9 of this resolution , and when such
19 break in "continuous service" shall have been by leave of absence
20 with the approval of the mayor and Common Council , vacation time
21 shall accrue monthly from the date of return to service from such
22 approved leave of absence, based upon the total length of service
23 of the officer and/or employee.
24 SECTION TWELVE : The following special provisions for the
25 Police Department and Fire Department, in addition to those provided
26 for in Section 186 of the City Charter, are hereby established ;
27 ( a) Assignments under Section 186 THIRD (b) of
the City Charter for periods of absence,
28 vacation leave, sick leave, injury leave or
during a vacancy shall be made as provided
29 for in Rule 415 of the Rules and Regulations
of the Civil Service Board, approved by the
30 Mayor and Common Council by Resolution No.
6409 on June 25th, 1962,

(b) Sixty-three (63) hours shall be the average
32 work week for the following positions in the
II
I Fire Department :
2 Fireman
Dispatcher `
3 Engineer
Captain
4 Battalion Chief
5 Forty (40) hours shall be the average work week
for the following positions in the Fire Depart-
6 ment :
7 Captain : when assigned
to the Fire
8 Alarm Bureau
Assistant Fire Prevention
9 Engineer
Drill Master
10 Fire Prevention Engineer
Master Mechanic
11 Assistant Chief
12 (c) All overtime and court time worked in excess of
the regular scheduled work week for employees of
13
the Police Department shall be repaid to the emp-
loyee by equal time off. However, such time off
14 shall not be taken in excess of seven (7) days at
any one time, and then only by permission of and
is j at the discretion of the Chief of Police,
16 j SECTION THIRTEEN: That nothing herein contained shall be

17 deemed to affect the Civil Service rights of any City Employee,
18 SECTION FOURTEEN: That Resolution No, 2771 is hereby re-
19 pealed on the effective date of this resolution,
2D SECTION FIFTEEN: That this resolution shall be effective
21 July 1st, 1962,
