CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
In December, the Economic Development Commission authorized the
Mayor and Development Department Executive Director to negotiate an
agreement with Ms. Patricia Leathers to coordinate a city-wide
clean-up event for the first quarter of 1993. Agreement No. EDA-
92-CO14 was executed on January 6, 1993, for a period of ninety
days.
A city-wide beautification day, Strike Out Graffiti, was held on
March 6, 1993. Over 700 citizens participated in the event.
Groups painted walls, fences, and buildings throughout the City.
Local businesses donated materials and supplies as well as made
cash donations, so the cost of the event was substantially
subsidized by outside resources.
Community groups have now expressed a desire to make the City-wide
clean-up project ongoing. Targeted projects include the following:
1. Graffiti Paint-out - monthly in cooperation with Kids
Against Crime.
2. Adopt A Block - in cooperation with City schools to
remove trash, weeds, and graffiti in areas surrounding
schools.
3. Adopt A Wall - local residents volunteer to keep local
walls clean from graffiti.
4 . Dash For Trash - regular community trash clean-up
campaigns.
It is recommended that the agreement with Ms. Patricia Leathers be
amended for an additional six months so the community clean-up
effort can continue. Application has been made to the Economic
Development Agency to fund this program with Community Development
Block Grants funds from July 1, 1993 - June 30, 1994. Applications
are being reviewed at this time and if recommended for funding, the
Economic Development Agency would use CDBG funds beginning July 1,
1993 .

OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT TO
3 AGREEMENT WITH THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF
SAN BERNARDINO ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF
4 SAN BERNARDINO ("AGENCY") AND PAT LEATHERS ("CONSULTANT") RELATING
TO CITY-WIDE BEAUTIFICATION.

BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Agency Administrator of the Economic
8 Development Agency on behalf of the Community Development
9 Commission of the City of San Bernardino is hereby authorized and
10
directed to execute on behalf of said Agency a First Amendment to
11 Agreement with the Community Development Commission of the City of
12 San Bernardino and Pat Leathers relating to city-wide
13 beautification, a copy of which is attached hereto, marked Exhibit
14 "L" and incorporated herein by reference as fully as though set
L 15 forth at length.'

17 SECTION 2. The authorization to execute the above referenced
18 agreement is recinded if the parties to the agreement fail to
19 execute it within sixty (60) days of the passage of this
20 resolution.

3 THIS FIRST AMENDMENT TO AGREEMENT made and entered into this
4 day of _, 1993, by and between the COMMUNITY DEVELOPMENT
5 COMMISSION of the City of San Bernardino, on behalf of the
6 REDEVELOPMENT AGENCY of the City of San Bernardino, a public agency
7 ("Agency") , and PAT LEATHERS, ("Consultant") .
8 WHEREAS, the parties entered into Agreement No. EDA-92-0014,
9 dated January 6, 1993 relating to coordination of activities and
10 volunteers for city-wide beautification efforts, and

12 WHEREAS, the Agreement was time limited for a period of ninety
13 days as a pilot project to organize a Community Pride Day, and
(. 14 WHEREAS, Consultant has performed the required duties of
15 graffiti abatement and city-wide beautification,
16
17 NOW, THEREFORE, the parties hereto agree as follows:
18 1. Section 3 of said agreement is hereby amended to read as
19 follows:
20 3. This Agreement shall commence as of the day and year
21 first above shown and shall remain in full force and
22 effect for a period of nine month (270 days) , unless
23 terminated sooner as provided herein-
24 2. Section 8 of said agreement is hereby amended to read as
25 follows:
26 8. During the term of this agreement, Agency shall pay
27 Consultant on a monthly basis. Said compensation

1 shall be considered full and complete reimbursement
2 for all Consultant's costs associated with the
$ services provided hereunder. The maximum
4 compensation for services, including all
5 Consultant's costs, under the terms of this
6 Agreement, shall not exceed $28,800.

Consultant shall be paid in accordance with Agency's
8
standard accounts payable system. Invoices shall be
9
approved by the Executive Assistant to the Mayor or
10 Agency's Executive Director or designees.

3 . Except as provided herein, all other terms and conditions
12
of the original agreement remain unchanged and in full force and

• EXHIBIT A
CONSULTANT RESPONSIBILITIES
1. Consultant shall recruit volunteers and coordinate activities
relating to the development and implementation of city-wide
beautification programs.
2. Consultant shall coordinate with various City departments,
including Parks, Recreation and Community Services, Public
Services, and Main Street to develop and implement
comprehensive beautification projects.
3. Consultant shall coordinate with community groups, other
municipalities, the County, and the School district for
beautification and anti-graffiti projects. to ensure that
programs interface together and resources are utilized to
their maximum potential.
4. Develop the program structure and administrative procedures to
ensure that beautification programs will continue into the
future.
