S/nopiis of Previous Council action:
08-01-91 -- The Mayor and Common Council adopted Ordinance No. MC-796 providing for
-removal of existing improvements and constructing new improvements to match the street
-width of adjoining parcels.
09-21-92 -- This office was authorized and directed to initiate proceedings on four
parcels for the removal of existing improvements and construction of new improvements
to widen the street to match adjoining parcels under the provisions of Chapter
12.92.010(E) and 12.92.035 of the Municipal Code.
Recommended motion:
That the public meeting relative to the installation of off-site improvements under
the provisions of Chapter 12.92 of the Municipal Code be closed, and the protests, if
any , be carried over to the public hearing scheduled for May 24 , 1993 .

STAFF REPORT
This is the first project to be conducted under the provisions of Chapter
12.92.035, S.B.M.C. , adopted by Ordinance MC-796, which enables the City
Engineer to require certain property owners to make off-site street
improvements in front of their properties as may be necessary to widen the
street to match the street width of adjoining parcels.
On April 7, 1993, a "Notice to Make Improvements" was sent by certified mail
to the owners of the properties listed on Exhibit "A" attached hereto as
is required by Chapter 27 and Chapter 12.92. Said notices set a public
meeting date of April 19, 1993, and a public hearing date of May 24, 1993;
the first meeting being no sooner than 10 days after giving notice, and the
second, the public hearing, being no sooner than 45 days after giving
notice.
This meeting is the first public meeting which is required in addition to
the public hearing. The purpose of this public meeting is to provide a
public forum for discussion of the proposed project. Protests may be heard,
but no action is possible at this time. If there are any protests at this
meeting, please carry them over to the public hearing scheduled for May 24,
1993, at which time final action will be made.
The April 7, 1993 notices also informed the property owners of the type of
improvements being required, and the City Engineer's estimated cost of
construction. The property owners were notified in said notice to begin the
construction within 60 days from the date of the notice, otherwise, the City
Engineer would cause the construction to be done, and the full cost of same
would be assessed to the properties regular property tax bill for a period
of three (3) years with 7% interest per annum.
According to the enabling Chapter's provisions, the property owner may
do the work himself, or he may hire his own contractor, or he may choose to
have the City do the work. If all of the affected property owners choose to
have the City do the work, then the construction contract cost will have to
be upfronted by the City.
Our estimated cost of $ 86,179.00 for this construction will have to be
upfronted, but will be recouped later through tax bill assessments. We will
not know however, if the City must upfront this cost until after the 60 day
period given in the notice for property owners to start construction has
lapsed. (The last day for the property owners to start the construction is
June 7, 1993.)
Section 12.92.060 of Chapter 12.92 which provides for this meeting does not
provide for any continuance of the meeting and the pertinent code is silent
relative to removing any parcels from the list.

Pursuant to our conversation addressing your letter of April 7, 1993
regarding the realignment of the North side of "E" Street adjacent to
Assessors Parcel No. 0136-193-27; the National Orange Show is asking
for an extension of time.
With the annual National Orange Show less than 30 days out we are asking
for an extension to July 20, 1993. The extension will allow us to
investigate the options and present to the Board of Directors.
