P. CONSTRUCTION COMPANY, INC. FOR INSTALLATION OF 3 A STORM DRAIN IN MILL STREET, FROM PENNSYLVANIA AVENUE TO RANCHO AVENUE. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1 . C. P. Construction Company, Inc. , is the 7 lowest responsible bidder for: Installation of a Storm Drain in 8 Mill Street, from Pennsylvania Avenue to Rancho Avenue, per Plan 9 No. 8820 . A contract is awarded accordingly to said bidder for 10 the total amount of $139, 100. 40 , but such award shall be 11 effective only upon the contract being fully executed by both 12 parties. All other bids, therefore, are hereby rejected. The 13 Mayor is hereby authorized and directed to execute said contract 14 on behalf of the City; a copy of the contract is on file in the 15 office of the City Clerk and incorporated herein by reference as 16 fully as though set forth at length. 17 SECTION 2. This contract and any amendment or modifica- 18 tions thereto shall not take effect or become operative until 19 fully signed and executed by the parties and no party shall be 20 obligated hereunder until the time of such full execution. No 21 oral agreements, amendments, modifications or waivers are 22 intended or authorized and shall not be implied from any act or 23 course of conduct of any party. 24 SECTION 3.
