SUBJECT:
Authorization to Proceed and Resolution Setting Public Hearing --- Underground Utility District
No. 28 --- Portions of Base Line Street, East of California Street and Portions of Pennsylvania
Avenue,North of 9a' Street.
BACKGROUND:
In September, 1999, a request was submitted by the San Bernardino City Unified School District
for the formation of a Rule 20A Underground Utility District adjacent to the new high school
being built on the south side of Base Line Street, east of California Street (copy attached) and
along portions of Pennsylvania Avenue, north of 9"' Street. The purpose of this request was for
the School District to avoid having to pay the cost of relocating the power poles to accommodate
the widening of Base Line Street on the south, which is a condition of their development. The
estimated cost for relocating the poles is $450,000.
San Bernardino City Municipal Code 13.36 provides for the formation of Underground Utility
Districts, for the removal of overhead utilities, such as power, telephone and cable TV. The
funding for the electrical portion of the undergrounding of these utilities is typically funded by
Rule 20A Funds. These funds, which are mandated by the PUC (Public Utilities Commission),
are set aside by the various power companies for the purpose of undergrounding, and are then
allocated annually for use by various Cities and Counties within the power companies' service
area. Other utilities, such as telephone and cable TV, are not governed by the PUC and therefore
have to provide their own funding. Any affected property owners within a district must also pay
a portion of the undergrounding of electrical services on their respective properties. No City
funds are used for Rule 20A projects.
On November 4, 1999, the Underground Utility Committee recommended approval of the
formation of Underground Utility District No. 28. If authorization is given to proceed, approval
of the attached resolution will set a public hearing for March 6, 2000. All affected utilities will
be given mailed notice of the hearing. The boundaries, as proposed, do not involve any private
properties; thus no property owners will be affected.
Presently, there are two districts in the process of being completed. The first district is along
Mill Street, between Lena Road and Tippecanoe Avenue. The second district is along 6th Street,
between the I-215 freeway and"F" Street. These projects will be completed on schedule and will
not be affected by the formation of this district. There are also three additional districts that are
currently in the design phase. The first one is Mt. Vernon Avenue, from 9th Street to 16`s Street.
This district was formed over 10 years ago, but was deferred to allow completion of Waterman
Avenue, south of 5a' Street. The second project in design is 40`h Street, from Electric Avenue to
Waterman Avenue. The third district is along portions of 5a' Street and 3`a Street, between Del
Rosa Avenue and the I-210 freeway (formerly Highway 30). This is a joint project with the City
of Highland and only about 25%of this district is within San Bernardino City

limits. The School District has requested that the projects be prioritized to allow the
undergrounding along Base Line Street to be completed prior to the Mt. Vernon Avenue and the
40th Street projects. Edison has advised us that doing so would delay the 40th Street project by
at least 90 days. Construction was scheduled to begin around May of this year, but would get
deferred until around August or September. They advised us that the Mt. Vernon project will
proceed on schedule and not be affected by this request. The 51h Street/ 3rd Street project should
not be affected since it is not scheduled to be begin until the latter part of 2000. They advised us
that they could reprioritiize the projects with the City's concurrence, which would allow the high
school project to proceed in a timely manner.
The School District has made this request due to the fact that they have installed $1.3 million in
public improvements in connection with the construction of the new high school. These
improvements primarily consist of oversize storm drain and street improvements.
There is adequate funding available to include this new district in the undergrounding projects,
without affecting the funding for the other projects. Including the 2000 allocations, there is
approximately $2.4 million available for new projects. The cost of this district is estimated at
$450,000, leaving about $1.95 million for new projects. Below is a summary of the existing
projects and the affect the creation and prioritizing of this district will have on those projects.

If this district is not formed, the City may require the school district to do the undergrounding at
their cost.
FINANCIAL IMPACT:
No City funds will be used for this project. City's allocation of Rule20A funds will be
diminished by approximately $450,000.
RECOMMENDATION:
Staff recommends that authorization to proceed with Underground Utility District No. 28 be
given and that the attached resolution setting a public hearing be adopted.

Dear Mr. Fogassy:
Thank you foi your letter of August 19, 1999, regarding the underground of overhead
utilities at the new high school site. We request the formation of the district to
underground overhead facilities along Base Line Street, between California Street and a
point 1200 east and along Pennsylvania Avenue from Ninth Street to its northerly
terminus.
The formation of the district needs to take-place as soon as possible. -

7 WHEREAS, Chapter 13.36 of the San Bernardino Municipal Code of the City of San
8 Bernardino provides for the establishment of an underground utility district within said City
9 upon a finding by the Mayor and Common Council after a public hearing that the public
10 necessity, health , safety or welfare requires the underground installation of utilities within said
11 district; and

13 WHEREAS, the Underground Utilities Committee of said City has recommended the
14 formation of an underground utility district to include the real property described in this
15 resolution.
16 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
17 OF SAN BERNARDINO AS FOLLOWS:
18 SECTION I. Notice is hereby given that a public hearing will be held before the Mayor
19 and Common Council of the City of San Bernardino on Monday, March 6, 2000, at the hour of
20 10:00 a.m., in the Council Chambers, City Hall, 300 North "D" Street, San Bernardino,

California, to determine whether the public necessity, health, safety or welfare requires the
22
23 formation of Underground Utility District No. 28 located along portions of Base Line Street,
24 from the east line of California Street to a point approximately 1225.6 feet easterly therefrom and
25 along portions of Pennsylvania Avenue, from the North line of 9th Street to a point
26 approximately 560 feet northerly therefrom, within said City, more particularly shown on
27 Drawing No. 10052, on file in the office of the City Clerk, a reduced copy of which is attached
28
hereto as Exhibit"A" and made a part of this description.
