Winkler,Director Ec mic Developm t Agency Develo ment Department Commission/Council Notes: -------—--- -------------------- ---------------- GVO:REW:Iag:01-24-00 Eminent Domain COMMISSION MEETING AGENDA Meeting Date: 011//224/2000 Agenda Item Number: /UY ECONOMIC DEVELOPMENT AGENCY STAFF REPORT --------------------------------------------------------------------------------------------------------------------- Redevelopment Project Area Plan Amendments—Eminent Domain Background At the Redevelopment Committee meeting of October 21, 1999,a discussion was held regarding amending the Agency's existing Redevelopment Project Areas to extend the ability to use eminent domain when necessary. As you recall,the power of eminent domain has expired in all project areas but Mt.Vernon. Further,the down swing in real estate during the early 1990's slowed economic activity in many of our project areas. Recent economic recovery together with new concepts such as the Lakes and Streams project may lead to new demand for land assembly. As a consequence,the Committee directed staff to evaluate need to re-establish the power of eminent domain in selected project areas. This evaluation was presented to the Committee at it's January 13,2000 meeting. Current Issue Staff and Special Counsel surveyed each project area considering need and potential for future development. Based upon that survey, it is recommended that the following project areas be considered for amendment to extend the power of eminent domain: • Central City North—The Entire Project Area • Uptown—The Entire Project Area • Central City East—The Entire Area,Except Government Buildings • Meadowbrook—The Entire Project Area • Central City South—The Entire Project Area The amendment process involves noticing the affected property owners,drafting and circulating amendment language and conducting noticed public hearings. Special Counsel is working with IVDA on amendments to extend their power of eminent domain. This would facilitate joint developments where required. Fiscal Impact Cost associated with the process are mostly related to securing a list of affected property owners,mailing notices and conducting the hearings. It is recommended the hearings be conducted simultaneously to economize on cost. Total cost is not expected to exceed$50,000. Recommendations The Redevelopment Committee recommends that the Community Development Commission authorize the Executive Director to prepare plan amendments to reinstate eminent domain in the Central City North,Central City South,Central City East,Uptown,and Meadowbrook Project Areas.
