Description) Pro essional Services Finance: Council Notes: Agenda Item No /jai J/Jol M0 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subject: Authorization to execute Contract Change Orders No. One and Two—Removal of Underground Storage Tanks at Fire Station No. 1 - Contractor: Safety-Kleen (CA), Inc. Background: On September 21, 1998, the Mayor and Common Council awarded a contract to Safety-Kleen (CA), Inc. of Los Angeles for the removal of underground storage tanks at the Main Fire Station located at 200 East Third Street. The Main Fire Station is also known as Fire Station No. 1. The project consisted of removal of two (2) 10,000 gallon underground fuel storage tanks. During construction it became apparent that certain changes to the design were needed to assure that the project complied with the conditions of the County Division of Environmental Health Services permit and subsequent inspection. The Contract Change Orders are described as follows: C.O. No. I Description of Change Cost ONE During excavation the Contractor discovered that the tanks $4,601.94 were encased in concrete. It would have been very expensive to remove the tanks from the concrete. County Environmental approved an alternate plan which allowed the tanks to be encased in sluLq and abandoned in place. TWO Tests on soil collected during excavation indicated that soil $2,280.00 contamination may have occurred over time due to leakage of the tanks. The County Division of Environmental Health required that additional sampling and testing be done, after excavation, on soils ad 'acent to and below the two tanks. TOTAL COST OF CCO's ONE AND TWO $6,881.94 A copy of Change Order Nos. One and Two are attached which will increase the contract total from $25,348.00 to $32,229.94. Approval of these two Change Orders is required by the Mayor and Common Council because the cumulative total cost for the two Change Orders exceeds the 15% contingencies ($5,652.00) which was approved by the Mayor and Common Council in its action of September 21, 1998. All work on this project is complete, therefore, approval of these Change Orders will allow Staff to close out this project and make a final payment to the contractor. Fbancial Impact: Sufficient funding for these Change Orders is available in the Liability Fund Account No. 629- 453-5502 "Professional Services". Recommendation: Staff recommends approval of Contract Change Orders No. One and Two.
