BACKGROUND: The San Bernardino City Unified School District originally submitted a request that the City design and construct a modification to the existing traffic signal at the intersection of California Street and Baseline Street. This intersection currently has signal controls on the north, east, and west legs, but there is no control on the south leg. The School District requested that the City modify the signal to control the south leg of the intersection. See location map(Exhibit A). The reason for the requested signal modification was to allow the School District to construct its primary access driveway to align with the south leg of the intersection. Pursuant to direction from the Ways and Means Committee at the December 8h meeting, staff met with representatives from the School District and Mr. Norm Johnson of Fourth Street Rock on December 13, 1999 (see attached minutes) to explore opportunities to work together on respective access issues. The conclusion of that meeting was essentially concurrence by all to proceed with a Memorandum of Understanding among the parties to work out an agreement for the design and construction of Phase I of State Street in lieu of the proposed improvements to California and Baseline Streets. It is anticipated that the agreement will be presented to the Mayor and Common Council at a future Council meeting. This action was agreed to by the Ways and Means Committee at their meeting on December 22, 1999. It is anticipated that all costs incurred by the City of San Bernardino pursuant to the MOU, once executed, will be funded from Account No. 129-3679-5504-7060 (State Street) as adopted in the current Capital Improvement Program. FINANCIAL IMPACT: No financial impact at this time. RECOMMENDATION: That the report regarding transfer of funds for the design and modification of existing traffic signal at the intersection of California and Base Line Streets be received and filed and that Staff be directed to develop a Memorandum of Understanding among Fourth Street Rock, the San Bernardino City Unified School District, and the City of San Bernardino for the design and construction of Phase I of State Street. He also addressed the effects of Electro Magnetic Field (EMF)on the students driving under the transmission wire. • Mr. Lee then responded: that SCE did not approve this design as a main entrance to the school since it entails greater encroachment into the SCE right-of-way and runs parallel to the transmission line. Mr. Lee recalled that he did review the design and at that time the entrance from Baseline Street was to be a temporary entrance until State Street was built, and the main entrance would then be directly from State Street. The entrance on State Street would only cross the transmission line at a 900 angle and therefore not represent a clearance conflict for the electrical wire itself since it is next to the transmission tower. He also commented that he had reviewed the design of the State Street alignment by Associated Engineers. This alignment would have less effect on the power poles and transmission towers as compared to the City's design since SCE only has to relocate one power pole at 9th and State Streets. ❑ Mr. Jon Sirugo, Manager of EMF Research and Education of SCE stated: that there should not be any effect to anybody driving under the line at that location since it is considered an intermittent exposure. Nor does it affect people at the school building, since the building is more than 150 feet away from the transmission wire. • Mr. Perez requested that SCE provide him with a letter stating that EMF will not cause any harm to the students. • Mr. Sirugo said he could not provide such a letter but would be happy to provide educational information and meet with the public or school board members regarding the EMF issue. State Street Project Minutes File No. 1.7060 Page 2 of 2 • Mr. Bail commented that he would have to notify the school board and the State Architect regarding the entrance issue. • Mr. Kuehl was concerned about when the State Street traffic signal and relocation of the power pole could occur. He wanted to make sure that they would be completed prior to school opening in September 2001. • Mr. Casey concluded the meeting: stating that if the School District Board concurred with the primary school entrance on State Street, the City staff would work with the City Attorney's office to prepare a three-party agreement between the City of San Bernardino, the School District and Fourth Street Rock to share the cost of the construction of Phase I of State Street between Baseline Street and the School District's access road. The agreement would ultimately be based on an approved improvement plan, designed by Associated Engineers,on behalf of Mr. Johnson. The proportionate share of improvement costs could be based on an approved traffic study relative trip generations associated with the high school, and the present and future development of Fourth Street Rock(Norm Johnson's)property. Background: The San Bernardino City Unified School District has submitted a request that the City design and construct a modification to the existing traffic signal at the intersection of California Street and Base Line Street. The driveway construction will be accomplished entirely by the School District, subject to design approval by the City. It was originally anticipated that State Street could be constructed from Base Line Street to approximately 1,000 feet south of Base Line Street in time for the opening of High School No. 5 in September of 2000. This would have allowed the School to take its main access from the newly constructed State Street. A funding shortfall and a conflict with existing high voltage electric transmission lines has delayed the completion State Street. Because of these problems, it is not anticipated that State Street will be constructed in time to meet the District's timetable for opening the new High School. At the November 1, 1999 Council meeting, Staff was directed to evaluate a private property owner's proposal to design and construct a portion of State Street with an understanding that the cost of the project, including right-of-way, might be reimbursed to said property owner at some later date. It was proposed that these improvements could be accomplished within the District's necessary time frame and preclude the need for traffic signal modifications at the intersection of California Street and Base Line. The results of that evaluation are as follows: 1) The preliminary design submitted for Staff review appears feasible with the revisions recommended during plan check. More definitive review will be necessary during the final design process, including the approval of an Engineer's Estimate, which could serve as the basis for any reimbursement agreement between City and Property Owner. 2) It does not appear to be feasible to utilize Federal/State Aid funding to reimburse a private property owner for costs associated with a road improvement project as proposed. 3) It is possible, through a simple reimbursement agreement, for the City to reimburse a private property owner for infrastructure costs considered above and beyond those required of his/her development. 4) In order for the City to commit to reimbursing the property owner for costs associated with State Street, it is anticipated that the Mayor and Common Council would have to reprioritize projects already established in the 5-year Capital Improvement Program (CIP), or make a commitment to include the reimbursement in the CIP within some future time threshold. 5) School District representatives continue to express a strong concern with the primary access to the new school passing beneath the high voltage lines en route to State Street (see follow-up letter attached). In the attached letter, the School District has asked the City to commit $65,000 to modify the signal. Due to age of the existing signal, we feel that $65,000 may only cover construction cost and, therefore, additional funds are being requested to cover design, construction inspection and contingencies. Staff proposes to transfer $85,900 of the State Street monies to California at Base Line Street traffic signal modification. Staff would propose to restore these funds to the State Street account as part of the FY 2000-2001 CIP. Recommendation: That the Mayor and Common Council Authorize the Director of Finance to Transfer $85,900 from Account No. 129-367-5504-7060 (State St from 9' to Base Line — grade, pave and install traffic signal) to fund the modification of the existing traffic signal at the intersection of California Street and Base Line Street, Account NO. 129-367-5504-7182. "Jarb" Thaipejr, for reviewing the proposed State Street access for the new high school, as proposed by Mr. Norm Johnson. While the District supports the future development of State Street, the District at this time can not support providing access for the new high school - from State Street. There are two major reasons: 1. HEALTH & SAFETY - While there is no current report stating that students passing under the high power Southern California Edison transmission lines are in danger of electric magnetic fields, the District does not want to expose the students to any unforeseen danger. The area residents have already expressed their concern about various environmental issues at the new site. The District does not want to add to the community concerns. 2. EASEMENT & TIMING - Southern California Edison has restricted all construction beneath the transmission lines. There is a concern that street elevations would not allow t1w ccroswacttGn of the street, much less the dally access of vchlcies underneath the transmission lines (proper clearances would not be achieved). Additionally, the time frame to obtain the necessary construction easements and relocate and elevate the transmission lines -could not be in time for the opening of school. At such time, when the District and the community could be given assurances about the environmental safety of the students traveling under the transmission lines, and the development/relocation of the driveway has occurred (with proper height elevations), would the District consider using State Street as an access point for the new high school. This continuance is supported by staff as it will allow us to evaluate the proposal presented by Mr. Johnson at the meeting of October 18, 1999, and provide a coordinated response. Financial Impact: There will be no financial impact to the City due to this continuance.
