CONSENT CALENDAR MOTION: That the motions indicated by consent calendar items 5 through 12, be adopted except for —> —> and 5. Waive full reading of resolutions and ordinances. MOTION: That full reading of the resolutions and ordinances on the regular, supplemental and addendum to the supplemental agendas of the Mayor and Common Council/Community Development Commission be waived. 6. Claims and Payroll. (See Attached) MOTION: That the claims and payroll and the authorization to issue warrants as listed on the memorandum dated November 30, 1999, from Barbara Pachon, Director of Finance, be approved. 7. Personnel Actions. (See Attached) MOTION: That the personnel actions as submitted by the Chief Examiner dated January 5, 2000, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. 3 1/10/2000 City Attorney LAID OVER FROM DECEMBER 20, 1999 8. An ordinance of the City of San Bernardino adding Section 10.16.240 relating to parking vehicles on unpaved parcels of real property. FINAL READING (Backup material was distributed on December 20, 1999, Item No. 10.) MOTION: That said ordinance be adopted. Development Services 9. Authorize execution of Contract Change Order No. One - California Commercial Pools - renovation of Nunez Pool at 1717 West Fifth Street - per Plan No. 9943. (See Attached) (Cost to the City -- $18,598 from CDBG Funds.) Ward 3 MOTION: That Contract Change Order No. One to the contract with California Commercial Pools be approved for various changes described in the staff report for a total Change Order amount of $18,598, increasing the contract total from $442,000.00 to $460,598.00. 10. Order vacation of a portion of that east/west alley located on "F" Street and resolution determining fair market value and setting a public hearing relative to the proposed sale of property located east of "F" Street, between 5th and 6th Streets. (See Attached) (Cost to the City -- $1,000 from the General Fund; $1,500 revenue to the General Fund from sale proceeds.) Ward 1 NOTE: The resolution sets a public hearing for 10:00 a.m. Monday, February 7, 2000. A. Resolution of the City of San Bernardino declaring its intention to order the vacation of a portion of that certain east/west alley located east of"F" Street, between 5th and 6th Streets and reserving public utility easements. Resolution of the City of San Bernardino establishing and setting fair market value and sales price of $1,500.00 and declaring the intention of the City to sell a portion of City property located on the east side of "F" Street, between 5t and 6th Streets in the City of San Bernardino, to the Roman Catholic Bishop of San Bernardino and setting a public hearing to consider said sale. (Resolution not available at time of printing.) MOTION: That said resolutions be adopted. Human Resources 11. Resolution of the City of San Bernardino amending Resolution No. 6429, entitled in part "A resolution ... establishing a basic compensation plan for officers and/or employees of the Police and Fire Departments of the City of San Bernardino. (Charter Section 186) (See Attached) (No cost to City.) (Resolution not available at time of printing.) MOTION: That said resolution be adopted. Parks, Recreation & Community Services 12. Authorize $30,000 increase in Park Construction budget to fund resurfacing project at Norton Galaxy/Gym Tennis Court Complex. (See Attached) (Cost to the City -- $30,000 from the Park Construction Fund undesignated fund balance.) Ward 1 MOTION: That the Mayor and Common Council authorize the Director of Finance to amend and increase the 1999- 2000 Park Construction budget by $30,000 in Account No. 243-363-5504-7179 to fund the resurfacing of the North Galaxy/Gym tennis courts. Funds for this budget amendment will come from the Park Construction undesignated fund balance. Report regarding transfer of funds for design and modification of existing traffic signal at intersection of California Street and Base Line Street. (See Attached) MOTION: That the report regarding transfer of funds for the design and modification of existing traffic signal at the intersection of California Street and Base Line Street be received and filed; and that staff be directed to develop a Memorandum of Understanding between Fourth Street Rock, the San Bernardino City Unified School District, and the City of San Bernardino for the design and construction of Phase I of State Street. END OF COMMITTEE CONSENT PUBLIC HEARINGS TO BE HEARD AT 10:00 A.M. 14. Resolution of the City of San Bernardino ordering the vacation of a portion of Pumalo Street, east of Del Rosa Avenue. (See Attached) (Cost to the City -- $1,000 from the General Fund.) Ward 7 MOTION #1: That the public hearing be closed and the Findings of Fact, as set forth in the Staff Report from the Director of Development Services, as to why a portion of Pumalo Street, east of Del Rosa Avenue, is no longer necessary for public street purposes, be adopted; and MOTION #2: That said resolution be adopted. Ordinance of the City of San Bernardino adding Section 3.44.131 to the San Bernardino Municipal Code and establishing a Utility User's Tax Rebate Program. FIRST READING (See Attached) (Ordinance not available at time of printing.) MOTION: That said ordinance be laid over for final adoption. 16. Authorize additional funding to Convention and Visitors Bureau to support the San Bernardino Area Youth Sports Alliance. (See Attached) (Cost to the City -- $83,700 from the Undesignated General Fund balance.) All Wards MOTION #1: That the Mayor and Common Council approve the additional funding for the Convention and Visitors Bureau in the amount of$83,700 for FY 1999-2000; and MOTION #2: That the Director of Finance be authorized to amend the FY 1999-2000 budget and appropriate $83,700 from the General Fund's unreserved/undesignated fund balance to 001- 092-5505 (Non-Departmental Professional/ Contractual). City Attorney 17. Authorize City Attorney to join amicus brief in the case of the Alejo u. City of Alhambra. (No cost to the City.) MOTION: That the City of San Bernardino send a letter to the California Supreme Court supporting the Petition for Review in Alejo v. City of Alhambra, and, if Petition granted, to join in amicus brief. Council Office 18. Authorize use of property located at 1244 West Ninth Street at rate of $1.00 annually for San Bernardino Junior All-American Youth Football. Ward 6 MOTION: That San Bernardino Junior All-American Football be granted the use of property located at 1244 West Ninth Street at the rate of$1.00 (one dollar) annually. 7 1/10/2000 19. Resolution of the City of San Bernardino designating and commemorating the historical significance of the River Red Gum Eucalyptus tree located at 1850 Waterman Avenue. (Cost to the City -- $500 from the General Fund.) Ward 2 MOTION: That said resolution be adopted. Mayor's Office 20. Resolution of the Mayor and Common Council of the City of San Bernardino in support of SB984 establishing March 31st, Cesar Chavez's Birthday, as a Statewide holiday. Resolution of the City of San Bernardino approving the final map for Subdivision Tract No. 14193, located on the southeast corner of Ohio Avenue and Olive Avenue, accepting the public dedications as set forth on said map; and authorizing execution of the standard form of agreement for the improvements in said subdivision, with time for performance specified. (See Attached New Staff Report) (No cost to the City.) Resolution of the Mayor and Common Council of the City of San Bernardino awarding a contract to Signal Maintenance, Inc. for installation of a traffic signal at the intersection of Tippecanoe Avenue and Laurelwood Drive per Plan No. 10012. Resolution of the City of San Bernardino establishing a Management and Confidential Employee compensation and benefits plan and Rescinding Resolution Numbers 89-129, 97-77, 97-352, 97-357, 1999-197 and 1999-198. Luncheon Workshop -- 12:00 noon -- Management Information Center, 6th Floor, City Hall - Strategic Education Service, State representatives regarding legislative advocacy program for the upcoming year. 9 1/10/2000 MAYOR AND COMMON COUNCIL AND THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO RECONVENE MEETING COMMUNITY DEVELOPMENT COMMISSION MONDAY, JANUARY 10, 2000 — 2:00 P.M. PRESENT: ABSENT: TO BE HEARD AT 2:00 P.M. R25. Resolution of the Mayor and Common Council approving and authorizing an application for a Section 108 Loan Guarantee funding in the amount of $1,840,000 from the U.S. Department of Housing and Urban Development (HUD). (See Attached) (Cost to the City -- $1,840,000 - Section 108 Loan.) (Resolution not available at time of printing.) Ward 1 MOTION: That said resolution be adopted. R26. Resolution of the Mayor and Common Council approving and authorizing the Mayor to execute the Community Development Block Grant (CDBG) Loan Agreement by and between the City of San Bernardino and Inland Valley Development Agency (IVDA) in the amount of $120,000. PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA: A three- minute limitation shall apply to each member of the public who wishes to address the Mayor and Common Council/Community Development Commission on a matter not on the agenda. No member of the public shall be permitted to "share" his/her three minutes with any other member of the public. (Usually any items heard under this heading are referred to staff for further study, research, completion and/or future Council/Commission action.) 10 1/10/2000 28. Adjournment. MOTION: That the meeting be adjourned. NOTICE: Any member of the public may address this meeting of the Mayor and Common Council/Community Development Commission on any item appearing on the agenda by approaching the microphone in the Council Chambers when the item about which the member desires to speak is called and by asking to be recognized. Any member of the public desiring to speak to the Mayor and Common Council/Community Development Commission concerning any matter not on the agenda but which is within the subject matter jurisdiction of the Mayor and Common Council/Community Development Commission, may address the body at the end of the meeting, during the period reserved for public comments. Said total period for public comments shall not exceed forty-five (45) minutes, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. A three minute limitation shall apply to each member of the public, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. No member of the public shall be permitted to .share" his/her three minutes with any other member of the public. The Mayor and Common Council/Community Development Commission may refer any item raised by the public to staff, or to any commission, board, bureau, or committee for appropriate action or have the item placed on the next agenda of the Mayor and Common Council/Community Development Commission. However, no other action shall be taken nor discussion held by the Mayor and Common Council/Community Development Commission on any item which does not appear on the agenda unless the action is otherwise authorized in accordance with the provisions of subdivision (b) of Section 54954.2 of the Government Code.
