5. PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA: A three-

CONSENT CALENDAR
MOTION: That the motions indicated by consent calendar items
6 through 9, be adopted except for _ and

MOTION: That full reading of the resolutions and ordinances on
the regular, supplemental and addendum to the
supplemental agendas of the Mayor and Common
Council/Community Development Commission and

7. Council Minutes.
MOTION: That the minutes of the following meeting of the Mayor
and Common Council/Community Development
Commission of the City of San Bernardino be approved
as submitted in typewritten form:
October 19, 1998 (Distributed on 1/29/99)
8. Personnel Actions. (See Attached)
MOTION: That the personnel actions as submitted by the Chief
Examiner, dated January 26, 1999, in accordance
with Civil Service rules and Personnel policies adopted
by the Mayor and Common Council of the City of San
Bernardino, be approved and ratified.

9. An ordinance of the City of San Bernardino amending Chapter
19.06, Section 19.06.030(2)(B)(1) of the San Bernardino Municipal
Code (Development Code) to allow an alcoholic beverage control
license within 100 feet of residentially used, but not residentially
zoned property with a Conditional Use Permit. FINAL READING
(Backup material was distributed on January 25, 1999, Item
No. 21.)
MOTION: That said ordinance be adopted.

10. Approve in concept request to install campus event posting
monument sign in median of University Parkway, and direct City
Attorney to prepare a license agreement authorizing encroachment
within the right-of-way. (See Attached) (No cost to the City.)

MOTION: That the Mayor and Common Council approve in
concept the request to install a campus event posting
monument sign in the median of University Parkway
and direct the City Attorney to prepare a license
agreement to authorize encroachment within the right-
of-way- subject to the conditions contained in Exhibit
"E" of the staff report dated January 19, 1999, from
Michael Hays, Director of Development Services.

11. Resolution of the Mayor and Common Council of the City of San
Bernardino approving a lease of property located at the San
Bernardino International Airport from the San Bernardino
International Airport Authority and the provision of certain fire
fighting services pursuant thereto. (See Attached) (Cost to the
City - Not to exceed $45,000 from the General Fund.) Ward 1
MOTION: That said resolution be adopted.

12. Appeal hearing - an appeal of a 90-day extension of time for
Conditional Use Permit No. 97-17 & Variance No. 97-10 A & B - a
proposal to permit an impound vehicle storage year and establish
reduced side yard setbacks - 206 South "D" Street. (See Attached)

Request/Location: The appellant is appealing a 90-day extension
of time granted by the Planning Commission for the above
referenced project at its November 17, 1998 meeting. The
applicants had requested the extension of time to complete the
construction of the Phase I buildings and necessary improvements
as required by the Conditions of Approval and Standard
Requirements. The site is located at the southwest corner of Athol
Street and "D" Street and is generally known as 206 South "D"
Street.
MOTION: That the hearing be closed; that the Mayor and
Common Council deny the appeal; and uphold the
Planning Commission's decision to approve a 90-day
extension of time for Conditional Use Permit No. 97-17
and Variance No. 97-10 A&B, based on the Findings of
Fact, subject to the Conditions of Approval and
Standard Requirements, as noted in the staff report
dated January 21, 1999, from Michael Hays, Director
of Development Services.

R13. Resolution of the Mayor and Common Council of the City of San
Bernardino awarding two (2) purchase orders, one (1) to Allstar
Fire Equipment and one (1) to South Coast Fire Equipment for the
purchase and delivery of various ancillary equipment, to be utilized
by the Fire Department of the City of San Bernardino in
accordance with Bid Specification F99-19A. (See Attached)
(Resolution not available at time of printing.)
MOTION #1: That the Mayor and Common Council approve a
modification of the project to allow for the
purchase, as well as, the lease of ancillary
equipment for the Fire Department (CDBG
Projects 97-229 & 98-219); and
MOTION #2: That said resolution be adopted.

Resolution of the Community Development Commission of the
Redevelopment Agency of the City of San Bernardino authorizing
the hiring of a finance team and the commencement of preparation
of bond documents for the issuance of bonds to finance the
purchase of certain real property located within CFD 995 of the
City of San Bernardino.

San Bernardino Joint Powers Financing Authority
Resolution of the San Bernardino Joint Powers Financing
Authority approving the hiring of a finance team and the
commencement of preparation of bond documents for the issuance
of bonds to finance the purchase of certain real property located
within CFD 995 of the Citv of San Bernardino.
MOTION: That said resolutions be adopted.
R15. Resolution of the Community Development Commission of the City
of San Bernardino authorizing the Executive Director of the
Economic Development Agency to execute an agreement for
professional services with Theatrical Arts International. (See
Attached) (No cost to the Agency) (Resolution not available at
time of printing.) Ward 1
MOTION #1: That said resolution be adopted; and
MOTION #2: That the Community Development Commission
authorize the Executive Director to enter into a
contract with Theatrical Arts International to
manage the California Theater for one year,
commencing on February 10, 1999 with a 30-
day termination clause by either party.
R16. Resolution of the Community Development Commission of the City
of San Bernardino authorizing the Executive Director of the
Economic Development Agency to execute a loan agreement. (See
Attached) (Cost to the Agency -- $200,000 from the
Community Reinvestment Fund.) (Resolution not available at
time of printing.) Ward 1
MOTION #1: That said resolution be adopted;
MOTION #2: That the Community Development Commission
authorize a loan agreement with Steven T. and
Kuan-Yih Wuo for property located at 101 North
"E" Street.

R17. Approve in concept an Amendment to the Cooperative Agreement
with San Bernardino Associated Governments (SANBAG) relating
to the restoration of the Santa Fe Depot and maintenance of the
Commuter Rail Station. (See Attached) Ward 1
MOTION: That the Mayor and Common Council and Community
Development Commission approve the amendment to
the cooperative agreement in concept, and that staff be
directed to work with SANBAG to finalize the
amendment.
18. Adjournment.
MOTION: That said meeting be adjourned.
NOTE: The next joint regular meeting is scheduled for 8:00 a.m.,
Monday, February 15, 1999, in the Council Chambers of City Hall,
300 North °D" Street, San Bernardino, California.

NOTICE: Any member of the public may address this meeting of
the Mayor and Common Council and Community Development
Commission/San Bernardino Joint Powers Financing Authority on
any item appearing on the agenda by approaching the microphone
in the Council Chambers when the item about which the member
desires to speak is called and by asking to be recognized.
Any member of the public desiring to speak to the Mayor and
Common Council and Community Development Commission/San
Bernardino Joint Powers Financing Authority concerning any
matter not on the agenda but which is within the subject matter
jurisdiction of the Mayor and Common Council and Community
Development Commission/San Bernardino Joint Powers Financing
Authority, may address the body at the beginning of the meeting,
during the period reserved for public comments. Said total period
for public comments shall not exceed forty-five (45) minutes,
unless such time limit is extended by the Mayor and Common
Council and Community Development Commission/San
Bernardino Joint Powers Financing Authority. A three minute
limitation shall apply to each member of the public, unless such
time limit is extended by the Mayor and Common Council and
Community Development Commission/San Bernardino Joint
Powers Financing Authority. No member of the public shall be
permitted to "share" his/her three minutes with any other member
of the public.
The Mayor and Common Council and Community Development
Commission/San Bernardino Joint Powers Financing Authority
may refer any item raised by the public to staff, or to any
commission, board, bureau, or committee for appropriate action or
have the item placed on the next agenda of the Mayor and
Common Council and Community Development Commission/San
Bernardino Joint Powers Financing Authority. However, no other
action shall be taken nor discussion held by the Mayor and
Common Council and Community Development Commission/San
Bernardino Joint Powers Financing Authority on any item which
does not appear on the agenda unless the action is otherwise
authorized in accordance with the provisions of subdivision (b) of
Section 54954.2 of the Government Code.
Public comments will not be received on any item on the agenda
when a public hearing has been conducted and closed.
