The applicant, Community Housing Coalition,has recently established nonprofit status in the City of San Bernardino. BACKGROUND: In 1997, staff processed General Plan Amendment No. 97-02, a request to change the land use designation from RS, Residential Suburban, to RU, Residential Urban for a two-block area between 16s' and 17`h Streets, and"F"and"G" Streets. At their meeting of August 4, 1997, the Mayor and Common Council denied GPA No. 97-02. 640 W. 16th Street contains a 4-plex and 648 W. 16th Street contains a triplex. Both structures lost their nonconforming status and cannot be reused for multi-family. Both can be rehabilitated as single family structures. The north side of 16th Street where the properties are located contains a mix of single and multiple family units. The south side of 16th Street contains single family units. AUTHORITY FOR FEE WAIVER: Chapter 3.13 of the Municipal Code allows the Mayor and Common Council to consider the waiver or refund of fees for charitable organizations. Section 3.13.010 states: "Whenever an application for a permit, license or certificate for a building or structure, or for wiring, plumbing,heating,ventilating, air conditioning or refrigeration, or any other development permit, or undergrounding of utility costs,by a non-profit charitable organization, which desires that the fee be waived or refunded, the procedure set forth in this Chapter shall govern."The Code goes on to state (3.13.025)that the Mayor and Common Council may in their discretion ... waive or refund the established fees in a total amount of not to exceed twenty-five thousand dollars... Request for Fee Waiver j 640 and 648 W. 161 Street Mayor and Common Council Meeting of 2/15/99 2 KEY ISSUES: • It is staff s understanding that Community Housing Coalition was recently established as a not for profit housing organization in order to request the fee waiver for processing the General Plan Amendment. • Staff is not aware of any projects in the City that Community Housing Coalition has developed for low-income, low and moderate income housing, and housing for the aged, and/or engaged in other charitable housing activities, as stated in the letter from Hank Hohenstein. However, CHC is free to pursue this goal without the need for a General Plan Amendment on the properties in question. • Waiving this fee could establish a precedent whereby other nonprofit organizations request waivers or refunds. • Staff processes 10— 12 applications per year for nonprofit organizations, ranging from new development to rehabilitation permits. COSTS TO CITY: A General Plan Amendment is a direct cost recovery application. Staff estimates that it will cost approximately$2000 to re-process an amendment for the area in question. RECOMMENDATION: Staff recommends that the Mayor and Common Council deny the request for a fee waiver. Mayor Judith Valles Members of the City Council City of San Bernadine 300 North"D" Street San Bernadine, CA 92418 Dcar Madam Mayor, Recently CHC,a duly organized, not for profit, public benefit corporation filed and received a Certificate of Exemption from the City of San Bernadino. It is my understanding this action permits us to conduct business, for one year, within the City of San Bernadino without payment of a business license fee. We appreciate that courtesy. The general reason for the request contained in this letter is that CHC was organized for: "Thc specific purpose of this corporation is to develop low-income, low and moderate income housing, and housing for the aged, and to engage in other charitable housing activities(Internal Revenue Service Exempt Organization Activity Code Numbers 380, 381, 382 and 399)." The specific reason for this request is that CHC is becoming very active in housing and other community issues in the City of San Bernadino CHC has entered into an agreement to plan and manage multifamily units located at 640 and 648 W. 16th Street. There are other activities in the process of being defined. At this moment, CHC is preparing an application for a General plan Amendment for the block in which the two aforementioned properties are located. This request would change the land use designation from single family to multifamily. The Pecs charged by the City of San Bernadino for this application is a deposit of$1,500.00 and then the City will bill its costs against this deposit_ In the event staff costs are less, applicant will receive a rebate. In the event the costs are larger, applicant will pay the additional charges or the process will not continue. This is a way in which the City can protect itself from excessive Processing costs, and has been adopted by a number of cities Your staff has been very helpful in all the discussions we have had concerning these properties as well as other issues impacting housing in your City. They have suggested that CIIC, as other not for profits have done, apply for a waiver of fees. If that is the City's policy, we humbly request that CHC be allowed to file this application with a waiver of all fees, in accordance with adopted policies. CHC operates on a very limited and very specific budget. We would be very vulnerable on a 'pay for services' basis, because we have no way of estimating the total cost of the 1 010 4410949 P. 03 -z- application. In addition, CIIC is dedicated to having as great a percentage as possible, of its resources being devoted to the actual delivery of or improving housing. Business License and Activity in the City of San Bernadino Per our conversation last week, this memo is to follow-up on the material I left with you concerning the authorization granted by the City Clerk's office to Community Housing Council (CHC)to participate in business activity, especially in low to moderate housing projects within the City ot'San Bernadino. We are specifically interested in the two properties at 640 and 648 W. 16th Street. They are a foulplex and a triples respectively_ We are requesting that any notices of any sort mailed concerning these two properties include CHC. We are also interested in any activity, proposal, request for qualifications, request for proposals and any other opportunity that we be notified about them as well. When driving around the City and reading the impressive article in a recent edition of The Press Telegram one has to look at San Bernadino as being filled with opportunity. I wonder what policies, programs or ordinances have been enacted by the City to deal with boarded/vacant buildings or other such underutilized properties If their are any, please send me a copy. If there arc any costs please let me know and I will send a check by return mail. Additionally, if there are other departments which should be included in these requests I would deeply appreciate your forwarding a copy of this memo to them.
