Background:
This project was originally proposed in the 1996/97 budget and consists of widening the existing bridge over
Twin Creek Channel east of Waterman Avenue in the central portion of the community. The existing bridge
provides for only one lane in each direction and the proposed widening will provide for two lanes in each
direction. It incorporates the requirements for the seismic retrofit of bridges and matches the four lane
configuration that exists to the east and west sides of the bridge. Traffic projections and growth in the area
indicate the widening is required as traffic continues to increase in the area. It serves the County facilities
(Sheriff, Corporation Yards and Transportation/Flood Control), as well as the proposed developments at
Norton. All but three lots on the southwest side of the bridge have completed the street improvements. It is
proposed that additional funding be included in this project for street improvements to complete Rialto
Avenue from Lena Road on the east to Pepper Avenue on the west, with full street improvements.
Bids were received and opened at 2:00 PM on Tuesday January 12, 1999. A total of 10 bids were received
ranging from a low of $399,969.50 to a high of $602,763.80. The low bid is 9% above the Engineer's
Estimate of$361,584.20.
1 below is the estimated construction cost for the project using the low bid price for the contract.

TOTAL $526,500.00
This project was originally prepared and estimates completed in May 1998, however, it has been delayed for
a variety of reasons. The remaining street improvements to complete the roadway were designed but not
included in the project, as these improvements would be done upon development of the adjacent property.
However, the properties show no signs of additional improvements and will likely remain single family
rp6dences for quite some time. In order to complete the street, it is recommended it be completed with the
e to eliminate traffic restrictions.

To fully fund this project, the first motion is required to transfer $76,500 from the State Street - Foothill to
16' Street project in the 129 Fund. There is an original amount of $450,000.00 already allocated. It should
be noted that this project was first estimated in 1996 and revised in 1997 and represents an extension of the
existing bridge rather than a full replacement. With a transfer, there will be an available total amount of
$526,500 to fund the project.
Recommendation:
Staff recommends adoption of the resolution awarding the contract to the low bidder.

3 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO, SEAN MALEK ENGINEERING & CONSTRUCTION, INC., FOR
4 THE WIDENING OF RIALTO BRIDGE AT TWIN CREEK PER PLAN NO. 9726.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. SEAN MALEK ENGINEERING AND CONSTRUCTION, INC is the lowest
8 responsible bidder for: WIDENING OF RIALTO BRIDGE AT TWIN CREEK PER PLAN
9 NO. 9726. A contract is awarded accordingly to said bidder in a total amount of$399,969.50

but such award shall be effective only upon being fully executed by both parties. All other
11
12 bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute
13 said contract on behalf of the City; a copy of the contract is on file in the office of the City
14 Clerk and incorporated herein by reference as fully as though set forth at length.
15 SECTION 2. This contract and any amendment or modifications thereto shall not take
16
effect or become operative until fully signed and executed by the parties and no party shall be
17
18 obligated hereunder until the time of such full execution. No oral agreements, amendments,
19 modifications or waivers are intended or authorized and shall not be implied from any act or
20 course of conduct of any party.
21 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
22
23 within sixty (60) days of the passage of the resolution.
