SUBJECT: Determination of Public Convenience or Necessity—Chevron Convenience Store—
187 North `F' Street
Mayor and Common Council Meeting of January 25, 1999

REQUEST AND LOCATION
The applicant is requesting to establish a Type 20 liquor license (off site sale beer and wine) at a
650 square foot convenience store(Chevron) located at 187 North `F' Street. No more than two
cooler doors will be utilized for beer and wine display/sales area, or approximately 42 square feet
of the 650 square foot store, which accounts for 6.5%of the total floor area.
Under previous operators, the service station had a Type 20 license from 1981 through 1984.
The state Department of Alcoholic Beverage Control has determined that the Census Tract is
over-concentrated with off-site sale licenses (2 permitted, 2 existing)and requires the City to
make a determination that the proposal will serve the Public Convenience or Necessity,before a
license will be issued.
ENVIRONMENTAL DETERMINATION
This request was reviewed in accordance with the California Environmental Quality Act and
found to be exempt per Section 15301.
POLICE DEPARTMENT RECOMMENDATION
The Police Department has indicated that they will not oppose the ABC application and have
provided Conditions of Approval(Exhibit B).
DETERMINATION
Staff feels that a determination of public convenience or necessity can be met. The applicant has
submitted a letter in support of the proposal. The sale of alcoholic beverages for off-site

consumption is a service commonly found at convenience stores. The conditions proposed by
the Police Department serve to ensure that alcohol sales will be an accessory use to the operation
of the service station. The site is located in a commercial area, and this proposal does not
conflict with Development Code locational criteria for the sale of alcohol.
FINANCIAL IMPACT
The applicant submitted an application and the applicable processing fee.
RECOMMENDATION
Staff recommends that the Mayor and Common Council determine that the public convenience
or necessity is served and direct the Planning Division to prepare a letter for the Department of
Alcoholic Beverage Control for a Type 20 liquor license at 187 North `F' Street subject to the
Police Department's Conditions of Approval.

PROBLEM:
On 11-20-98, Assistant Planner, Michael Martin, sent me a
Memorandum regarding a PCN for an ABC license type 20 off-sale
beer/wine for Chevron Service Station located at 187 N. F St . , San
Bernardino.
RECOMMENDATIONS•
Approval for the PCN is recommended as long as the applicants are
subject to the listed ten conditions. (Refer to attached
conditions. )
FINDINGS:
The business is located in reporting district SC210 and Census
Tract 59 . There are two off-sale ABC licenses allowed and there
are two existing ABC licenses in this Census Tract . There are 233
Part I Crimes and 398 Part II Arrests . This puts the reporting
district in a high crime area.
A Memorandum was sent to the Area Commander, Lt . Aragon, asking for
her input regarding this PCN. Lt. Aragon has no objection to the
issuance of the PCN as long as there are certain conditions placed
on the permit . (Refer to attached conditions. )
The San Bernardino Police Department agrees with Area Commander
Aragon and does not object to the issuance of the PCN providing the
applicant is subject to the listed ten conditions .

CONDITIONS
187 NORTH "F" STREET
1 . The licensee shall be responsible for posting of signs
prohibiting litter and loitering with management enforcing
this and maintaining the area free of litter and graffiti.
2 . Exterior lighting shall be sufficiently and properly
maintained to illuminate all areas of the exterior of the
building and property for easy detection of suspicious and
criminal activity.
3 . Must comply with all City building, fire, zoning and health
regulations.
4 . If public telephones are located on the premises, they shall
be fixed for outgoing calls only.
5 . No alcoholic beverages shall be consumed on any property
adjacent to the licensed premises under the control of the
licensee .
6 . There shall be no coin operated games or video machines
maintained upon the premises at any time.
7 . No wine shall be sold with an alcoholic content of greater
than 15k by volume except for "Dinner Wines" which have been
aged two years or more and maintained in corked bottles .
8 . The sales of beer or malt beverages in quantities of quarts,
22 oz . , 32 oz . , 40 oz . , or similar size containers is
prohibited. No beer or malt beverages shall be sold din
quantities of less than six per sale .
9 . Wine shall not be sold in bottles or containers smaller than
750 ml . and wine-coolers, beer coolers, or pre-mixed distilled
spirit cocktails (if allowed by the license) must be sold in
manufacturer pre-packed multi-unit quantities.
10 . If, in the opinion of the Chief of Police, a security guard
becomes necessary, it shall be the responsibility of the
licensee to provide the security at the hours to be listed by
the Chief of Police.

convenience or necessity is served and directed the
Development Services Department to send a letter to the
Department of Alcoholic Beverage Control for a Type 20
(off-site beer and wine) Liquor License for the Chevron
convenience store located at 187 North F Street, subject
to the Police Department' s Conditions of Approval .
