Recommended Motion:
1. That the public hearing relative to the formation of Underground Utility District No. 28, along
portions of Base Line Street,east of California Street and portions of Pennsylvania Avenue,
north of 9d' Street,be closed.

Staff Report
SUBJECT:
Public Hearing — 10:00 AM and Resolution Creating Underground Utility District No. 28 ---
Portions of Base Line Street, East of California Street and Portions of Pennsylvania Avenue,
North of Wh Street.
BACKGROUND:
In September, 1999, a request was submitted by the San Bernardino City Unified School District
for the formation of a Rule 20A Underground Utility District adjacent to the new high school
being built on the south side of Base Line Street, east of California Street (copy attached) and
along portions of Pennsylvania Avenue, north of 9h Street. The purpose of this request was for
the School District, to avoid having to pay the cost of relocating the power poles to
accommodate the widening of Base Line Street on the south, which is a condition of their
development. The estimated cost for relocating the poles is $450,000.
The School District has installed approximately $1.3 million in public improvements relative to
the construction of the new high school. The cost of undergrounding the overhead utilities will
be funded from the City's Rule 20A allocations and no City funds will be used. If this district is
not formed, the City may require the school district to do the undergrounding at their cost.
On November 4, 1999, the Underground Utility Committee recommended approval of the
formation of Underground Utility District No. 28. Authorization to proceed with the proposed
district was given on February 7, 2000 and Resolution No. 2000-26 was adopted, setting a public
hearing for March 6, 2000. All affected utility companies were given notice of the proposed
formation and the public hearing.
To facilitate the completion of the district and allow for the widening of the south side of Base
Line Street, Edison has advised us the 400, Street undergrounding would need to be delayed by
90 days. Due to various design and/or construction stages of other undergrounding projects,
Edison has advised us that 40°i Street is the only project that can be rescheduled without
incurring additional costs. Below is a summary of other current undergrounding projects.

Staff Report -Continued
In response to the Mayor and Common Council's concerns, City staff has met with Edison staff
to relay the City's concerns and to facilitate expediting the 40s'Street project wherever possible.
FINANCIAL IMPACT:
No City funds will be used for this project. City's allocation of Rule 20A funds will be
diminished by approximately$450,000.
RECOMMENDATION:
Staff recommends that the public hearing be closed and that the resolution creating Underground
Utility District No. 28 be approved.

BERNARDINO.

6 WHEREAS, a public hearing was held on March 6, 2000, at the hour of 10:00 a.m., at
7 the Council Chambers, 300 North "D" Street, San Bernardino, California, to determine
8 whether the public necessity, health, safety or welfare required the formation of Underground
9 Utility District No. 28, located along portions of Base Line Street, east of California Street and
10 along portions of Pennsylvania Avenue,north of 9s' Street, San Bernardino, California; and
11 WHEREAS, Notice of such hearing has been given to all affected property owners as
12
shown on the last equalized assessment roll and to all utilities concerned in the manner and for
13
the time required by law; and
14
15 WHEREAS, such hearing has been duly and regularly held and all persons interested
16 have been given an opportunity to be heard.
17 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
13 CITY OF SAN BERNARDINO, AS FOLLOWS:
19 SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San
20 Bernardino Municipal Code of the City of San Bernardino, and to definitions contained
21 therein that the public necessity, health, safety and welfare require the formation of
22 Underground Utility District No. 28, located along portions Base Line Street, east of California
23 Street and along portions of Pennsylvania Avenue, north of 9h Street, San Bernardino,
24
25 California, public streets which are extensively used by the general public and carry a heavy
26 volume of vehicular traffic, in order to remove utility poles, overhead wires and associated
27 structures and to underground utilities along said portions of said Base Line Street and
28 Pennsylvania Avenue.

3 SECTION 2. An underground utility district to be known as Underground Utility
4 District No. 28 is hereby established in that area along portions of Base Line Street, east of
5 California street and along portions of Pennsylvania Avenue, north of 9t° Street, more
6
7 particularly shown on Drawing No. 10052 by the Engineering Division, Department of
8 Development Services, City of San Bernardino, on file in the office of the City Clerk of said
9 City, a copy of which is attached hereto as Exhibit"A" and made a part of this description.
10 SECTION 3. All poles, overhead wires and associated overhead structures lying
11 within 50 feet of the centerline of said Base Line Street and Pennsylvania Avenue shall be
12 removed and underground installations made in said underground utility district within the
13
following times:

15 a. Underground installation by utility companies and property owners and
16 reconnections not later than September 30, 2000.
17 b. Removal of poles, overhead wires and other associated structures not later
18 than November 30, 2000.
19 Said dates, however, may be extended by the Director of Development Services to
20 facilitate coordination with the various property owners and utility companies.

22 SECTION 4. The City Clerk is hereby directed to mail, or cause to be mailed, a
23 copy of this Resolution and a copy of Chapter 13.36 of the San Bernardino Municipal Code, to
24 all affected property owners as shown on the last equalized assessment roll and to all affected
25 utilities within ten(10) days after the adoption of this Resolution.
