Synopsis of Previous Commission/Council/Committee Acdon(s):
On 3/15/99, the Commission adopted Resolution 1999-8A approving the execution of a professional service agreement
with RSG for purposes of carrying out the redevelopment feasibility analysis for the proposed 4&street and Waterman
Avenue Redevelopment study area.
On 8/16/99 the Commission received and filed the Feasibility Study prepared by RSG for the proposed 40 Street
Redevelopment area.
On 8/16/99, the Mayor and Council adopted Resolution No. 1999-216 designating a redevelopment Survey Area for
project study purposes(40*Street).

On 9/07/99, the Planning Commission adopted Resolution No. 99-02 approving the preliminary
plan for the 40`h Street Redevelopment Project Area.
On 9/20/99, the Mayor and Council adopted Resolution No. 1999-242 adopting procedures for
the formation and election of a project area committee for the 40'" Street Redevelopment Project
and calling for the formation of a PAC.
On 12/06/99, the Mayor and Council adopted Resolution No. 1999-315 affirming the Project
Area Committee.
On 12/20/99, the Commission adopted Resolution No. 1999-48 approving the preliminary report
for the 40th Street Redevelopment Project, and directing transmittal of the preliminary report to
affecting taxing agencies.
On 12/20/99, the Commission adopted Resolution No. 1999-49 approving the draft
Redevelopment Plan for the 40a' Street Redevelopment Project, and authorized transmittal of the
proposed plan to affected taxing agencies, and persons and organizations within the project area,
and submittal to the Planning Commission for report and recommendation.
On 12/20/99, the Commission adopted Resolution No. 1999-50 approving draft owner
participation rules for the 40th Street Redevelopment Project.
On 12/20/99, the Commission adopted Resolution No. 1999-51 approving a draft Method of
Relocation for the 400' Street Redevelopment Project.

Resolutions regarding the Use of Low-and-Moderate Income Housing Set Aside Funds
40" Street Redevelopment Project
BACKGROUND
The Community Development Commission of the City of San Bernardino ("Commission") has
undertaken proceedings for the adoption of a Redevelopment Plan for the 40'" Street
Redevelopment Project. On September 20, 1999,the Commission adopted Resolution No. 1999-
34 approving the Preliminary Plan for the 40'h Street Redevelopment Project. The adoption of
this Resolution also directed the preparation of a redevelopment plan for the Project Area and the
noticing of affected taxing entities of the proposed adoption of the Redevelopment Plan.
To date, the required notices pursuant to Sections 33327 and 33328 of the California Community
Redevelopment Law, Health and Safety Code Section 33000, et. seq. ("CRL") were transmitted
to affected taxing entities on September 22, 1999, and the Redevelopment Plan and related
documents were received and approved at the Commission's regular meeting on December 20,
1999.
Pursuant to Section 33344.5 of the CRL, the Preliminary Report was transmitted to all affected
taxing entities on December 23, 1999. The draft Environmental Impact Report ("EIR") has been
prepared by our environmental consultant, Culbertson Adams and Associates, Inc., and has been
transmitted to all affected taxing entities and other agencies pursuant to the requirements of the
California Environmental Quality Act. This document has also been available for public review
as of December 20, 1999.
CURRENT ISSUE
The proceedings to adopt the Redevelopment Plan are nearing the final step in the process. As
required by the CRL, 20% of all tax increment revenues collected by the Commission are to be
used for the purpose of increasing, improving, and preserving the community's supply of low
and moderate income housing in the City of San Bernardino. Section 33334.2(g) of the CRL
provides the Commission the authority to use such funds outside 40`^ Street Redevelopment
Project if the City Council and the Commission adopt findings that such expenditure of funds
will be of benefit to the 40t' Street Redevelopment Area.
FISCAL IMPACT
None.

RECOMMENDATION
Staff recommends that the Mayor and Common Council and the Community Development
Commission adopt the attached resolutions regarding the use of low-and-moderate income
housing set aside funds for the proposed Redevelopment Plan for the 40's Street Redevelopment
Project.

WHEREAS, the Community Development Commission of the Ci of San Bemardin
7
("Commission") is undertaking the required steps for the consideration of the adoption of the
8
Redevelopment Plan for the 40th Street Redevelopment Project(" edevelopment Plan");

WHEREAS, a Redevelopment Plan has been repared in accordance with the
11 provisions of the California Community Redevelopment aw, Health and Safety Code Section
12 33000, et. seq., ("CRL");
13 WHEREAS, the Redevelopment Plan ovides for the allocation of taxes from the
14 40th Street Redevelopment Project("Project At ");
15 WHEREAS, unless certain exce ions apply, Section 33334.2 of the CRL require
16 that not less than twenty percent (20%) f all taxes allocated to the Commission pursuant to
17 Section 33670 of the CRL be used for a purpose of increasing, improving, and preserving the
18
community's supply of low- and in erate-income housing available at affordable housing cos
19
to persons and families of low- or oderate-income and very low-income households; and
20
WHEREAS, Sectio 33334.2(g) of the CRL provides that such funds may be use
21
22 outside of the Project Area ' a finding is made by resolution of the Commission and the City
23 Council of the City of S emardino that such use will be of benefit to the Project.
