BACKGROUND During last fiscal year, the City of San Bernardino chose to participate in a Regional Crime Enforcement Coalition. The Coalition pooled funds from throughout the county to hire probation officers and place them on school campuses. The City passed Resolution No. 1999-16 authorizing the use of our portion of the block grant funds ($103,742.00) by the regional coalition. None of the county probation officers were sited in San Bernardino. This year, the City has been notified it is eligible to receive $104,015.00 in JAIBG funds (excluding the cash match). FINDINGS The County of San Bernardino Probation Department has been awarded $800,000 in "Edward Byrne Memorial Grant" funds from the Bureau of Justice Assistance to implement a juvenile probation accountability program. The Probation Department will form a partnership with the Police Department to field four city police officer/county probation officer teams, a police sergeant, and ancillary vehicles/equipment. This program is modeled after a highly successful program initiated in Boston, commonly called "Night Light." The program will be replicated locally and the funding for four additional police officer and one police sergeant positions will be 100%paid by the county's Byrne grant. This JAIBG project seeks to fund a fifth city police officer and county probation officer team in order to match our area command structure. The fifth team allows for easy and convenient linkages between "Night Light" police officer/probation officer teams and area command personnel. By combining the county's "Edward Byrne" grant and the city's JAIBG grant programs into a single strategy, the partnership will allow both entities to more effectively accomplish program goals. The San Bernardino project will accomplish, among other things: • Police officer/probation officer teams will receive referrals from educational institutions, courts, community-based organizations, and Probation Department concerning juveniles or young adults who have demonstrated violent negative behavior and who demonstrate a need to be closely monitored. • Police officer/probation officer teams will work with other criminal justice system stakeholders (Probation Department, courts, District Attorney's Office, Public Defender's Office) to ensure that youth who commit crimes within the City of San Bernardino are accountable for their actions. • Police Officer/probation officer teams will regularly conduct probation compliance checks and curfew compliance checks to ensure juveniles and young adults are complying with court mandated terms of probation. • Police officer/probation officer teams will work in partnership with the city Police Department's gang suppression unit to ensure curfew and probation compliance checks occur with identified members of criminal youth gangs. • This program is designed to foster a sense of responsibility and accountability on the part of juvenile and young adult offenders on the probation officer caseload. Accountability will be enforced through scheduled and random probation/curfew compliance checks. Appropriate referrals to supportive community-based social service agencies to reinforce positive behaviors on the part of juveniles and young adults will occur. The JAIBG grant requires proposals fit into specific purpose areas. The areas can best be broadly described as those efforts that contribute to efficient operation of the juvenile justice system as well as providing accountability incentives/sanctions for youthful offenders. Due to the timeline requirement, the grant documents have been submitted with a letter from the Mayor indicating a copy of the Resolution, if approved, will be forwarded at a later date. The Probation and Police Departments will execute a Cooperative Agreement wherein each agency is essentially a subgrantee to the other agency's grant award. This resolution formally approves the submission of the grant package. FINANCIAL U"ACT The City of San Bernardino will receive $104,015 in JAIBG grant funds. There is a mandatory 10% cash match of$11,557 that will not be waived. One half of the total grant funds, or $52,007, will be allocated to the County of San Bernardino Probation Department (as a subgrantee) to fund one Probation Officer position. The Probation Department has agreed to contribute half of the cash match to cover the amount allocated to their department. The City will use the remaining half of the grant award amount of$52,008 towards funding one additional police officer position. The.City's cash match of$5,779 and the balance required to fund one police officer position ($6,888) will be derived from the FY 2000/01 COPS Option grant award. Necessary equipment needs are to be funded by both departments under separate grant budgets. There is no impact on the general fund. This is a one-year commitment that will add one additional police officer position. RECOMMENDATION Adopt resolution. I US2 OZO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE MAYOR TO SUBMIT AN APPLICATION TO ACCEPT THE FY 1999/2000 JUVENILE 3 ACCOUNTABILITY INCENTIVE BLOCK GRANT(JAIBG). 4 WHEREAS the City of San Bernardino Police Department desires to undertake a certain 5 project designated the San Bernardino Juvenile Accountability Project to be funded in part from funds 6 made available through the Juvenile Accountability Incentive Block Grant (JAIBG) Program 7 administered by the Officer of Criminal Justice Planning (hereafter referred to as OCJP). 8 NOW, THEREFORE, BE IT RESOLVED that the prior execution and submittal by the 9 Mayor of the City of San Bernardino of the attached proposal to OCJP is hereby authorized and 10 ratified by the Common Council. 11 BE IT FURTHER RESOLVED that the City of San Bernardino agrees to provide all 12 matching funds required for said project (including any amendment thereof) under the program and 13 the funding terms and conditions of OCJP and that the cash match will be appropriated as required. 14 IT IS AGREED that any liability arising out of the performance of this grant award 15 agreement, including civil court actions for damages, shall be the responsibility of the City of San 16 Bernardino. (EFOP). We have reviewcd this information along with other data that we collected when this office visited your department for an an-site review. As you know, the Office for Civil Rights (OCR) at the Office of Justice Programs (OJP),United Stites Deportment of Justice(DOJ) cunducted an on-site compliance review of the San Bentardino Police Department(SBPD) in September 1997. As a consequence of OCR's recent implementation of streamlined compliance review guidelines, OCR issues this Letter of Compliance binding in accordance with 28 C.F.R. § 42.206(ex 1). (XR concludes that based on the available record. SRPD is in substantial compliance with the Federal civil rights laws that OCR enforces. Purpose Area 3 — "Hiring additional...probation officers...to ensure the smooth and expeditious administration of the juvenile justice system;"—50% allocation,557,786.00. PROGRAM DESCRIPTION The San Bernardino County Probation Department and the San Bernardino Police Department will collaborate to provide five teams of police/probation officers (in pairs). The teams will work together to conduct law enforcement and Probation Department accountability compliance checks on juvenile probationers. The San Bernardino County Probation Department has been awarded a federal grant to implement a "Night Light" Program. The grant will fund four probation/police officer teams to work with the City of San Bernardino. This JAIBG proposal seeks to add a fifth team. The probation officers identify juveniles who are at risk for future placement in the juvenile justice system or who have been previously adjudicated through the juvenile court system. The probation officer seeks to intervene with the juvenile and his/her family, monitor progress in school, and make referrals to appropriate programs and/or services that support positive social and educational development. The police officers accompanying probation officers on compliance checks will provide re-enforcement for probation officers as well as investigate and take appropriate enforcement action on any new criminal behavior discovered. Police officer/probation officer partnerships will enhance, efficiency and effectiveness of the City of San Bernardino and County of San Bernardino Probation Department by holding juveniles accountable, providing appropriate consequences and re- enforcing appropriate progress and behaviors. Street crime, drug sales, and gang activity continue to be issues for the City of San Bernardino. In 1996, San Bernardino City police arrested 133 juveniles for street crimes involving assaults, injury, or homicide. Crimes frequently were perpetrated with firearms since in two-thirds of homicides the weapon causing death was a firearm. Many minors and young adults who commit these crimes are under the jurisdiction of the courts or are under informal probation contract. On any given day there are over 500 juveniles and more than 300 youthful adult offenders under probation supervision in the City of San Bernardino. Many violent crimes in San Bernardino occur after dark. Traditionally, probation officers have worked standard day shifts and do not supervise clients during evening or weekend hours. Violations occurring during evening hours or on weekends are rarely discovered unless a crime is committed and investigated by the Police Department. After business hours, probationers are free of supervision and control by probation officers. The Night Light Program for San Bernardino will expand operations of both police and probation officers, maximize existing resources, and implement new strategies. The program will dedicate five police officers and five probation officers (four teams funded by a federal grant, the fifth team funded by the JAIBG grant) along with all support equipment. In addition to enforcing curfew and other conditions of probation, officers will remove unlawful firearms and hack firearm sources. While enforcing a "no tolerance" policy for illegal gang activities and violence, the program will emphasize alternatives to incarcgration including house arrest and electronic monitoring. Recognizing that youth need alternatives to gang activities and other behaviors that lead to criminal acts, probation officers will work with community organizations to develop positive recreational, social, and educational options. These programs are designed to re- enforce community ties, strengthen family support, and improve educational achievement. Many resources already exist through the Youth Justice Center in San Bernardino (a Probation Department program). Examples of existing services include: 1. A day reporting program providing supervision, community service, and education. 2. The parent project, an educational and group counseling program for parents of troubled youth. 3. Gang reduction and intervention program providing counseling, mentoring, and recreational activities. 4. Drug and alcohol education and counseling group. PROBLEM STATEMENT San Bernardino City and County are successfully serving a limited number of young people with programs, ensuring accountability through administration of accountability based sanctions, providing for the smooth and expeditious administration of the Juvenile Justice System, reducing recidivism, and protecting juveniles from drug, gang, and youth violence. San Bernardino County is home to many children who are exposed to one or more of the following risk factors: • One out of six children are born to drug-using mothers. • Thirty per cent of the city's children receive some form of public aid. • Those children 10-19 years of age are more likely to die from a homicide than a car accident. • More illegal, clandestine methamphetamine laboratories per capita are found in San Bernardino County than in any other jurisdiction in the United States. • Over 10,000 juveniles identified as gang members reside in the County of San Bernardino. The additional resources provided will better serve juveniles and young people living in the City of San Bernardino by responding quickly and appropriately to juvenile justice issues and social service needs. ACTIVITIES EMPLOYED WITHIN THE PROGRAM PURPOSE AREAS The San Bernardino Juvenile Crime Enforcement Coalition approves the expansion of police officer/probation officer teams within the City of San Bernardino. The funds will be used to add one additional police officer/probation officer team to a grant-funded program beginning at about the same time. Monies expended under Program Purpose Area 2 will be used to fund a police officer position in the Police Department. Monies expended under Program Purpose Area 3 will be used to fund a probation officer position in the Probation Department.
