Rex, a licensed veterinarian, to oversee the purchase and

animal euthanasia, as required by law.

CITY OF SAN BERNARDINO — REQUEST FOR COUNCIL ACTION
Staff Report
Subject: Resolution of the Mayor and Common Council of the City of San Bernardino
authorizing execution of a contract for services with Dr. Leonard A. Sigdestad, a licensed
veterinarian,to oversee the purchase and administration of controlled substances for the purpose
of humane animal euthanasia, as required by law.
Background: The Federal Controlled Substances Act of 1970 requires certain classes of drugs
be strictly regulated. Included in these classifications are substances used by the City's Animal
Shelter in the performance of euthanasia. An animal shelter can not obtain a permit to order,
administer or possess any of the scheduled substances without the oversight of a veterinarian.
The veterinarian must also hold a current DEA permit to obtain these substances.
The City of San Bernardino has, in the past, entered into a contract for services with a local
veterinarian who is willing to provide this service and who holds the valid permit.
Recently the veterinarian who provided this service cancelled his contract with the City. This
contract was not formally bid upon because of the need to quickly renew this contract,per DEA
regulations, and the low cost associated with this service.
Dr. Sigdestad was contacted by phone and was willing to provide this service. The terms of the
contract are for an indefinite period and either party may cancel with 14 days notice.
Compensation is$50.00/mo and payment of any permit or licensing fees which may occur as a
result of the contract. Dr. Sigdestad operates Loma Linda Animal Hospital which is a San
Bernardino City business.
Fiscal Impact: This item will have no effect on the General Fund as it is a budgeted item.
Annual cost is $670.00 ($50/mo service fee+ $210/3yr permit fee).

6 WHEREAS, federal law requires certain registrations and oversight for the purpose of
7 purchasing and administering controlled substances used for humanely euthanizing animals;
8 and
9
WHEREAS, the CITY OF SAN BERNARDINO desires to have a contractual
10
11 arrangement with a licensed veterinarian for the purpose of purchasing and administering said
12 controlled substances; and,
13 WHEREAS, LEONARD A. SIGDESTAD, D.V.M. possesses the required state and
14 federal registrations necessary to purchase and administer said controlled substances.

15 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
16 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. That the MAYOR of the CITY OF SAN BERNARDINO is hereby

authorized and directed to execute that certain contract for services between the CITY OF SAN

21 Animal Hospital, a copy of which is attached hereto as Exhibit "A".

CONTRACT FOR SERVICES

THIS AGREEMENT is entered into this 20th day of March 2000,
3 by and between LEONARD A. SIGDESTAD, D.V.M., doing business as Loma Linda Animal
4 Hospital, (hereinafter referred to as the "CONTRACTOR") and the CITY OF SAN
BERNARDINO, (hereinafter referred to as the "CITY'):

WITNESSETH:

7 A. WHEREAS, federal law requires certain registrations and oversight for the
8 I purpose of purchasing and administering controlled substances used for humanely euthanizing
9 animals, and,
10 I B. WHEREAS, the CITY desires to have a contractual arrangement with a
11 licensed veterinarian for the purpose of purchasing and administering said controlled
12 substances, and,
13
C. WHEREAS, CONTRACTOR possesses the required state and federal
14
registrations necessary to purchase and administer said controlled substances, and,
15
16 D. WHEREAS, CITY desires and CONTRACTOR is willing to provide
17 professional services needed for the purchase and administration of said controlled substances.
18 NOW THEREFORE, the parties hereto agree as follows:
19 1. SCOPE OF AGREEMENT.

a. CONTRACTOR will obtain and maintain any necessary registration
21
certificates utilizing the address of the CITY'S Animal Shelter as "secondary business" for the
22
23 purpose of purchasing, administering and storing controlled substances on CITY property by
24 CITY staff,
25 b. CITY agrees to pay the costs of any and all required registration certificates;
26 C. CITY agrees to pay the costs of all drugs and medical supplies purchased
27 through said registration certificates;

d. CITY shall keep and maintain records in accordance with the standards

and parameters set forth by CONTRACTOR in compliance with federal law;

4 e. CONTRACTOR shall conduct routine oversight inspections concerning
5 the purchase, use and storage of said controlled substances on days and times to be mutually
6 agreed upon.
7 ( 2. COMPENSATION. CONTRACTOR will be paid $50.00 per month by the
8 CITY for the services provided under SCOPE OF AGREEMENT. CONTRACTOR will
9
provide to CITY a monthly invoice in said amount.

3. TERM. This contract shall take effect upon execution by both parties.

12 4. TERMINATION OF CONTRACT. The CITY or CONTRACTOR has the
13 right to terminate this contract for services for any reason by the giving of fourteen days written
14 notice.
