OBJECTIVE
Obtain Council approval to adopt resolution to amend agreement with West Coast Arborist, Inc.
BACKGROUND
On September 20, 1993 a resolution was adopted which awarded a contract to West Coast
Arborist, Inc., for tree trimming services in the amount of $329,500.
On December 6, 1993, a resolution was adopted which amended the contract by transferring
salary savings (two vacant positions/$70,700) into contractual accounts. This amendment
increased the contract limit to $400,200.
Staff estimate that the City has a tree inventory of approximately 85,000 trees. Because of
budget constraints in recent years, tree trimming was deferred and a backlog of trimming exists.
In order to address this trimming backlog, it is necessary to increase our tree trimming efforts.
Additionally, the contractor supplemented their work force with San Bernardino residents and
if this amendment is not approved, some employees may be laid-off or transferred to the
Northern California office.
DISCUSSION
During the last year, the work done by West Coast Arborists, Inc., has generated
overwhelmingly positive response from residents.
A backlog of tree trimming work exists in residential areas and if this amendment is approved,
the focus will be in these areas.
A savings of$100,000 in County Waste Fees is available because alternative disposal methods
have been used. These savings are eligible for expenditure for tree trimming.
RECOMMENDATION
It is recommended that Council approve the resolution to amend the contract with West Coast
Arborist, Inc. to increase award in the amount of $100,000.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING A SECOND
AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND
3 WEST COAST ARBORISTS, INC. RELATING TO TREE TRIMMING SERVICES.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is hereby
6
authorized and directed to execute on behalf of said City a second
7
amendment to the agreement with West Coast Arborists, Inc.
8
relating to tree trimming services.
9
SECTION 2 . The authorization to execute the above referenced
10 amendment to agreement is rescinded if the parties to the
11 agreement fail to execute it within sixty (60) days of the passage
12 of this resolution.

I HEREBY CERTIFY that the foregoing resolution was duly

adopted by the Mayor and Common Council of the City of San
15 Bernardino at a meeting thereof, held on the _

SECOND AMENDMENT TO AGREEMENT

4 THIS SECOND AMENDMENT to the agreement between WEST COAST
5 ARBORISTS, INC. ("CONTRACTOR") and the City of San Bernardino
6 ("CITY") is entered into as of this day of
7 1994 .
8 WITNESSETH:
9 WHEREAS, the parties enter=_d into that certain agreement
10 dated September 29, 1993 , relating to tree trimming services, and
11 WHEREAS, the parties entered into that certain First
12 Amendment to Agreement dated December 21, 1993 , and
13 WHEREAS, the parties desire now to further amand said
14 agreement,
15 NOW, THEREFORE, the parties hereto agree as follows:
16 SECTION 1 . Section C. 2 . , of that certain agreement dated
17 September 29 , 1993 between the parties as amended December 21,
18 1993 , is further amended to read as follows:
19 "Over the term of this agreement, CONTRACTOR shall be paid
20 for such services for a total amount not to exceed $500, 200
21 determined in accordance with Bid Specification F-94-05. The
22 Assistant Director of Public Services shall provide the Contractor
23 with the listing of residential streets upon which the additional
24 tree trimming services shall be performed. "
25 SECTION 2 . Except as amended herein, said agreement shall
26 remain in full force and effect.
