8.69.090 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE
3 PROHIBITION OF THE POSSESSION BY JUVENILES OF MARKER PENS AND
SPRAY CAN TIPS

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:
6 SECTION 1. Section 8. 69 . 090 is hereby added to the San
7 Bernardino Municipal Code to read as follows:
8 "8. 69 . 090 Possession of marker pens and spray can tips
by juveniles prohibited

It is unlawful for any minor person to have in
10 his or her possession any marker pens with tips
exceeding four millimeters in width, containing
11 anything other than a solution which can be removed
with water after it dries, and any spray can tips,
12 other than those affixed to a spray can, while on any
public highway, street, alleyway, park, playground,
13 swimming pool, public buildings or other public place,
whether such juvenile is or is not in any automobile,
14 vehicle or other conveyance. The provisions of this
section shall not apply to any person under the age of
15 18 years who is accompanied by a parent or guardian,
or under the supervision of an adult teacher. "
