CITY OF SAN BERN ' RDINO - REQUEST F^R COUNCIL ACTION
STAFF REPORT
The Pavilion Partners, Inc. DBA: Glen Helen Blockbuster Pavilion,
will be offering concerts for the 1994 season, with an average
crowd expectancy in excess of 15,000 per concert.
The primary entry point to Blockbuster parking will be Institution
and Powerline Roads, where concert traffic will flow off the north
bound I-215 freeway at Palm and continue west bound to entry point.
Traffic will be passing through two (2) intersections and one (1)
railroad crossing; all of which are located in the City of San
Bernardino.
To facilitate a safe and expedient route of travel, San Bernardino
Police Department personnel will be deployed, in an off-duty
capacity, to minimize congestion. The City will be reimbursed for
all services and equipment through a contract with Pavilion
Partners, Inc.

2 THE EXECUTION OF A CONTRACT WITH PAVILION PARTNERS, INC. DBA:
GLEN HELEN BLOCKBUSTER PAVILION.
3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
4 CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. The Mayor is hereby authorized and
6 directed to execute on behalf of said City a contract with
7 Pavilion Partners, Inc. DBA: Glen Helen Blockbuster Pavilion
8 relating to traffic control services within City jurisdiction.
9 copies of said instrument are attached hereto, marked Exhibit
10 "A"" and incorporated herein by reference as fully as though set
11 forth at length.
12 SECTION 2 . The authorization to execute the above
13 referenced contract is rescinded if the parties to the agreement
14 fail to execute it within sixty (60) days of the passage of this
15 resolution.
16 I HEREBY CERTIFY that the foregoing resolution was
17 duly adopted by the Mayor and Common Co,ncil of the City of San

1 AGREEMENT FOR SERVICES

4 THIS AGREEMENT, made and entered into this Day of 1994, by and
5 between the City of San Bernardino, acting by and through the San Bernardino Police
6 Department, hereinafter called S.B.P.D., and the Pavilion Partners, Inc. hereinafter called PPI.
7 WITNESSETH: By and in consideration of the covenants and the conditions herein contained,
8
the PPI and S.B.P.D, do hereby agree as follows:

10 1. S.B.P.D. agrees to provide one (1) officer and either three (3) or four (4)
11 C.S.R.'s (Community Service Representative)* with vehicles for traffic control during various
12 events occurring at the Glen Helen Blockbuster Pavilion. Traffic control services will be needed
13 at the following locations:
14 a. 1-215 Northbound off ramp at Palm.
15
b. Palm and Kendall
16
17 C. Palm/Institution and Cajon Blvd.
18 d. Institution and Powerline Road
19 2. The S.B.P.D. coordinator shall be Sgt. R. A. Rice, Administrative Sergeant for
20 Area "A" (telephone number (909) 384-5770). The PPI coordinator shall be Mr. Alan Dezon
21 (telephone number (909) 880-6500).

3. The term of this agreement shall be May 13, 1994 through December 31, 1994.

4. In consideration for the above services and upon receipt of an itemized invoice,
24
25 PPI agrees to pay the City of San Bernardino in accordance with the following rates:

1 Patrol Officer $33.06 per hour

$21.16 per hour

$19.62 per hour

5 Vehicle/Equipment Usage $71.00 per event
6 *Events with expected attendance in excess of 15,000 will require one (1) additional
7 CSR.
8 5. This agreement may be amended by written mutual consent of both parties hereto.
9 6. In the event of disaster or unforeseen emergency, S.B.P.D. shall be excused from
10 providing scheduled traffic control services without prior notice. Either party may cancel this
11
agreement by giving thirty days notice to the other.

13 7. The rates indicated in this agreement are for estimate purposes only. In the event
14 of wage increase, PPI agrees to pay the increased rates.
15 8. PPI agrees that additional charges may be assessed for S.B.P.D. supplies
16 expended (flares), additional equipment utilized, damage to uniforms or property repaired or
17 replaced at City expense, etc., which are directly related to the services provided herein.

9. PPI agrees that any cancellation of this request for service later than 4:00 p.m.
19
20 on the day preceding the requested service may result in a charge of four (4) hours overtime for
21 each officer assigned.
t2 10. No additional gifts, donations, or gratuities may be accepted by S.B.P.D.
23 personnel in their behalf or in the behalf of the Department.

1 11. PARTNERS shall indemnify, defend and hold CITY, its
2 officers, employees and agents, free and harmless from any claim,
3 demand, liability, suit, judgment or expense ( including, without
4 limitation, reasonable costs of defense) arising out of or related
5 to CITY' s performance of services under this agreement, except
6 that such duty to indemnify, defend and hold harmless shall not
7 apply where injury to person or property is caused by CITY's
8 willful misconduct or sole negligence.
