Description) Finance: Council Notes: 75-0262 Agenda Item No n CITY OF SAN BERN MIND - REQUEST F%.A COUNCIL ACTION STAFF REPORT Complaints were received by this Department, after inspections by Vehicle Abatement Officers, legal ten (10) day notices were issued and mailed to land owners. Upon no response to the Abatement Orders, the abandoned vehicles were abated by the City. Costs were incurred by the City for abatement and are being liened on the properties. ]5-0264 I RESOLUTION 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING CERTAI PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDIN 3 FOR THE COSTS OF ABATEMENT OF PUBLIC NUISANCES (ABANDONED VEHICLES) ON SAID PROPERTIES. 4 WHEREAS, the City of San Bernardino, pursuant to its authority 5 under Chapter 8 . 36 of the San Bernardino Municipal Code, 6 did lawfully give notice of and thereafter abate public nuisance 7 found to exist on the properties listed below; and 8 WHEREAS, pursuant to the San Bernardino Municipal Code, the 9 Director of Facilities Management Department served notice on all 10 property owners of the abatement costs for removing abandoned, 11 wrecked, dismantled, and/or inoperable vehicles or parts thereof 12 from the property; and 13 WHEREAS, opportunity for a hearing of the Board of Building 14 Commissioners to protest the abatement costs was afforded the 15 property owners, with no response forthcoming; 16 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 17 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 18 SECTION 1. The above assessments shall be paid to Facilities 9 Management Department, basement of City Hall, 300 No. "D" Street, 10 San Bernardino, CA 92418, within thirty (30) days after notice of 11 this resolution is mailed to all parties with an interest in the 12 above properties. All assessments not fully paid in thirty (30) 13 days shall become a lien on the property pursuant to The San 14 Bernardino Municipal Code and shall be collected as a special 15 assessment thereon. 16 SECTION 3. If the above assessment is not paid as hereinabove 17 provided, the City Clerk is directed to file a certified copy of 18 this resolution with the Auditor of the County of San Bernardino, 19 State of California, directing that said assessment be entered as 20 a lien against the property as it appears on the current assessment 21 rolls. The assessment shall be collected at the same time and in 22 the same manner as the eneral g property taxes for the City of San 23 Bernardino including penalties and interest for delinquent 24 payments. 25 The City Clerk shall also present for recording appropriate 26 notices of the imposition of these liens with the County Recorder. 27 28 2 I RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING CERTAIN 2 PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF ABATEMENT OF PUBLIC NUISANCES (ABANDONED 3 VEHICLES) ON SAID PROPERTIES. 4 I HEREBY CERTIFY that the foregoing resolution was duly 5 adopted by the Mayor and Common Council of the City of 6 San Bernardino at a meeting thereof, held on the 7 day of 1994 by the following vote, to wit: 8 Council Members: AYES NAYS ABSTAIN ABSENT NEGRETE 9 — CURLIN 10 — HERNANDEZ Il 12 — OBERHELMAN — 13 DEVLIN 14 — POPE-LUDLAM — 15 MILLER 16 17 City Clerk 18 The foregoing resolution is hereby approved this day 19 Of 1994 , 20 21 22 Tom Minor, Mayor City of San Bernardino 23 Approved as to 24 form and legal content: 25 JAMES F.
