April 21, 1994 -- LRC recommended approval of the amendment to the San Bernardino Municipal Code adding Section 5.69.090 relating to the prohibition of the possession by juveniles of marker pens and spray can tips . Recommended motion: That further reading of the ordinance be waived and that it be laid over for final adoption. Description) Finance: Council Notes: 75-u262 Agenda Item No. SAN BERNARDINO AREA CDAMBER OF COWNWItCE 546 W.6TH Si. • P.O.13OX 658 •SAN aERNARDINO,CA 92402•(909)895-7515 March 2 , 1994 To the Mayor and Common Council: Following the recommendation of the San Bernardino Area Chamber of Commerce' s Task Force, SCAT (Safe Community Action Team) , and Officer Dwight Waldo with the S.B.P.D. , the SBACC's Board of Directors voted to ask that the following addendum to the existing graffiti ordinance be placed on the City Council Agenda for approval We the San Bernardino Area Chamber of Commerce Board of Directors are recommending the approval and enforcement of this endorsement to give our Police Officers the extra power needed to fight graffiti . PROPOSED ORDINANCE REGARDING POSSESSION OF PRESSURIZED CANS CONTAINING PAINT, FELT TIP MARKERS, GLASS ETCHING TOOLS AND SPRAY CAN TIPS. Possession of pressurized cans containing paint, felt tip markers, glass etching tools and spray can tips by juveniles prohibited. It is unlawful for any minor person under the age of 18 years to have in his or her possession any pressurized can containing any substance commonly known as paint, felt tip marker, glass etching tool and spray can tips, while upon any public highway, street, alleyway, park, playground, swimming pool, public buildings or other public place, whether such juvenile is or is not in any automobile, vehicle or other conveyance. The provisions of this section shall not apply to any person under the age of 18 years who is accompanied by a parent or guardian or under the supervision of an adult teacher. Section 8.69.090 is hereby added to the San 7 Bernardino Municipal Code to read as follows: 8 "8. 69.090 Possession of marker pens and spray can tips by Juveniles prohibited 9 It is unlawful for any minor person to have in 10 his or her possession any marker pens with tips exceeding four millimeters in width, containing 11 anything other than a solution which can be removed with water after it dries, and any spray can tips, 12 other than those affixed to a spray can, while on any public highway, street, alleyway, park, playground, 13 swimming pool, public buildings or other public place, whether such juvenile is or is not in any automobile, 14 vehicle or other conveyance. The provisions of this section shall not apply to any person under the age of 15 18 years who is accompanied by a parent or guardian, or under the supervision of an adult teacher.
