I ORDINANCE NO. MC-927
2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA
3 ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
4 UPTOWN REDEVELOPMENT PROJECT

6 WHEREAS, the Redevelopment Agency of the City of San
7 Bernardino (the "Agency") , has formulated, prepared and approved
8 the Redevelopment Plan for the Uptown Redevelopment Project (the
9 "Redevelopment Plan") ; and
10
11 WHEREAS, the Mayor and Common Council of the City of
12 San Bernardino (the "City Council") , approved and adopted the
13 Redevelopment Plan pursuant to a duly enacted Ordinance on June
14 16, 1986; and
15
16 WHEREAS, Section 33333 . 6 of the California Community
17 Redevelopment Law has established certain limitations on the
18 incurring and repaying of indebtedness and the duration of
19 redevelopment plans, which limitations apply to every
20 redevelopment plan adopted on or before December 31, 1993; and
21
22 WHEREAS, Section 33333 .6 further provides that unless
23 a redevelopment plan adopted prior to January 1, 1994, already
24 contains limitations which comply with that Section, the
25 legislative body shall adopt an ordinance on or before December
26 31, 1994, to amend the redevelopment plan either 1) to amend an
27 existing time limit that exceeds the applicable time limit

1 established by that Section, or 2) to establish time limits that
2 do not exceed the provisions of that Section; and

4 WHEREAS, the time limit on the effectiveness of the
5 Redevelopment Plan as set forth in Section VIII of the
6 Redevelopment Plan, currently scheduled to terminate on July 2026
7 (forty (40) years from the date of adoption of the Plan) does not
8 exceed the time limit established by Section 33333 . 6 (b) ; and
9 therefore no amendment is required related to such limitation;
10 and

12 WHEREAS, the time limit on the establishment of loans
13 and indebtedness as set forth in Section VII D. 2 . currently
14 scheduled for fifteen (15) years from the date of adoption of the
15 Plan, does not exceed the time limit established by Section
16 33333 . 6 (a) (1) ; and therefor no amendment is required related to
17 such limitation.

19 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
20 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

22 Section 1. A new sentence is added to Section VII
23 D. 2 . of the Redevelopment Plan to read: "The Agency shall not
24 pay indebtedness or receive property taxes pursuant to Section
25 33670 after ten (10) years from the termination of the effective
26 date of the Redevelopment Plan" .

1 Section 2 . The City Clerk is hereby directed to
2 send a Certified copy of this Ordinance to the Agency.

4 Section 3. Effective Date. This Ordinance shall be
5 in full force and effect thirty (30) days after its passage.

7 Section 4. Publication. The City Clerk is hereby
8 ordered and directed to certify to the passage of this Ordinance
9 and cause the same to be published once in the Sun, a newspaper
10 of general circulation published and circulated in the City of
11 San Bernardino, California.

13 Section 5. If any part of this Ordinance is held to
14 be invalid for any reason, such decision shall not affect the
15 validity of the remaining portion of this Ordinance and the City
16 Council hereby declares that it would have passed the remainder
17 of this Ordinance, if such valid portion thereof had been
18 deleted.
