2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA
3 ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
4 MEADOWBROOK REDEVELOPMENT PROJECT

6 WHEREAS, the Redevelopment Agency of the City of
7 San Bernardino (the "Agency") , has formulated, prepared and
8 approved the Redevelopment Plan for the Meadowbrook Redevelopment
9 Project (the "Redevelopment Plan") ; and

11 WHEREAS, the Mayor and Common Council of the City
12 of San Bernardino (the "City Council") , approved and adopted the
13 Redevelopment Plan pursuant to a duly enacted Ordinance on July
14 21, 1958; and
15
16 WHEREAS, Section 33333 . 6 of the California
17 Community Redevelopment Law has established certain limitations
18 on the incurring and repaying of indebtedness and the duration of
19 redevelopment plans, which limitations apply to every
20 redevelopment plan adopted on or before December 31, 1993 ; and
21
22 WHEREAS, Section 33333 . 6 further provides that
23 unless a redevelopment plan adopted prior to January 1, 1994 ,
24 already contains limitations which comply with that Section, the
25 legislative body shall adopt an ordinance on or before December
26 31, 1994, to amend the redevelopment plan either 1) to amend an
27 existing time limit that exceeds the applicable time limit

1 established by that Section, or 2) to establish time limits that
2 do not exceed the provisions of that Section.

4 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

7 Section 1. Notwithstanding any other provision of
8 the Redevelopment Plan (as amended) , to the contrary the
9 Redevelopment Plan is hereby amended such that the provisions of
10 the Redevelopment Plan shall be effective until January 1, 2009.

12 Section 2 . A new subparagraph is added to
13 Section 5 of the Redevelopment Plan entitled "Limitations" which
14 shall read: The Agency shall not pay indebtedness or receive tax
15 increment revenues pursuant to Health and Safety Code 33670 after
16 ten (10) years from the termination of the effective date of the
17 Redevelopment Plan.

19 Section 3 . The City Clerk is hereby directed
20 to send a Certified copy of this Ordinance to the Agency.

22 Section 4 . Effective Date. This Ordinance
23 shall be in full force and effect thirty (30) days after its
24 passage.

26 Section 5. Publication. The City Clerk is
27 hereby ordered and directed to certify to the passage of this
28 Ordinance and cause the same to be published once in the Sun, a

1 newspaper of general circulation published and circulated in the
2 City of San Bernardino, California.

4 Section 6. If any part of this Ordinance is
5 held to be invalid for any reason, such decision shall not affect
6 the validity of the remaining portion of this Ordinance and the
7 City Council hereby declares that it would have passed the
8 remainder of this Ordinance, if such valid portion thereof had
9 been deleted.
