Ordinance of the City of San Bernardino repealing Chapters 2.47 (Central City Advisory
Board), 2.44 (Cemetery Commission), 2.41 (Main Street Advisory Board), and 2.27
(Commission for Disabled Persons) of the San Bernardino Municipal Code, and
amending Section 2.42.020 of the San Bernardino Municipal Code by adding Paragraph
"I" relating to meetings of the Community Television Commission.
Background:
Several months ago, City Clerk Rachel Clark noted that several of the City's boards and
commissions had no members, and were no longer active. It was suggested that some of
these inactive boards and commissions should be formally eliminated from the City's
Municipal Code, in order to reflect current practice. This matter was referred to the
Legislative Review Committee for further analysis.
On September 8, 2004, the Committee discussed the matter, and recommended that the
Central City Advisory Board, Cemetery Commission, Commission for Disabled Persons,
Central City Parking Place Commission, and Main Street Advisory Board be abolished
for the following reasons:
♦ The Central City Advisory Board's main role was to provide recommendations to the
Mayor and Council concerning the use of Area Tax revenues derived from downtown
businesses. That tax has since been eliminated.
♦ The Cemetery Commission has been inactive for approximately 15 years. The Parks,
Recreation, and Community Services Department has assumed responsibility for
Pioneer Cemetery, so the Parks and Recreation Commission and Senior Affairs
Commission may discuss cemetery issues as needed.
♦ The Commission for Disabled Persons has been inactive for 7 years. Its functions are
necessary, but they can be handled by the Handicap Accessibility Appeals Board
through a resolution.
♦ The Central City Parking Place Commission has been inactive for many years. The
parking district bonds have been paid off, and the parking district tax has been
eliminated. The Main Street Advisory Board has been inactive since the Main Street
program was assumed by the Economic Development Agency.
On September 20, 2004, the Mayor and Council referred this item back to LRC for
further discussion. At the October 5 LRC meeting, staff recommended that the Central
City Parking Place Commission be preserved since a number of issues related to
downtown parking have recently arisen, and will need to be discussed in the coming
months. The Committee agreed and recommended that the ordinance be referred back to
the Mayor and Council,with a modification to retain that commission.
Financial Impact:
There is no direct financial impact as a result of this action. Streamlining boards and
commissions is likely to result in savings in potential staff time that would be associated
with staffing and supporting these entities.
Recommendation:
That said ordinance be laid over for final adoption.

14 be assumed by other appropriate active boards and commissions; and
15 WHEREAS,in other cases the responsibilities of such inactive boards and commissions can
16 be assumed by an ad hoc committee, should the need so arise.
17 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
18 DO ORDAIN AS FOLLOWS:
19 SECTIONI. Chapter 2.47(Central City Advisory Board)of the San Bernardino Municipal
20 Code is hereby repealed.
21 SECTION2. Chapter 2.44(Cemetery Commission)of the San Bernardino Municipal Code
22 is hereby repealed.
23 SECTION 3. Chapter 2.41 (Main Street Advisory Board)of the San Bernardino Municipal
24 Code is hereby repealed.
25 SECTION 4. Chapter 2.27 (Commission For Disabled Persons) of the San Bernardino

9 every calendar year(at least once every three months)."
