In turn, CalRecycle has allocated funds for the Waste Tire Enforcement Grant Program, which are made available to qualifying entities. For the past 15 years, the City of San Bernardino has received such grant funding to monitor businesses generating waste tires within the City. Funds allocated by CalRecycle for the Waste Tire Enforcement Grant are for inspection, compliance, and survey activities of waste tire facilities, haulers, tire dealers, and auto dismantlers. The intent of this activity is to develop and implement an effective inspection and compliance program at the local level, which will provide guidance to facility operators, and if necessary, take initial enforcement action to remediate threats to public health, safety, and the environment. These activities enhance the City's current tire enforcement program and complement enforcement actions by the State. During the 17th cycle grant period, City staff successfully completed a total of 102 inspections of local tire dealers. Of these inspections,it was determined that nine sites had violations. Public Works staff, in conjunction with the City of San Bernardino Fire Department, is in the second phase of completing the 18th Cycle Waste Tire Enforcement Grant and survey activities. As a result of the program, staff has noticed a substantial increase in the awareness of business owners of State laws and manifesting requirements, and a decrease in the number of illegally stockpiled tires. Grant funds will be used to continue the local monitoring, enforcement and education efforts, and will allow the City to continue the current monitoring of waste tire generators and haulers. The grant application deadline for the 19'h Cycle Waste Tire Enforcement Grant was November Undated-4/11/2012 by Sabdi Sanchez Page 2 i 1587 30, 2011. The grant term is June 30, 2012, through September 30, 2013. The City's original grant request was for$35,000. The grant requests received by CalRecycle exceeded the monies available for this program. Therefore, the City's final grant award eligibility is $28,000. If approved,the City will receive$28,000 in funding for the tire enforcement program. The acceptance of the Waste Tire Enforcement was reviewed at the Grants Ad Hoc Committee meeting on March 27, 2012 and the Committee recommended this item to the Mayor and Common Council for approval. DATE: April 16, 2012 Pursuant to the South Coast Air Quality Management District (SCAQMD) request, the applicant proposes minor revisions shown below in bold and underline be added to the Mitigation Monitoring and Reporting Program (MM/RP) MM Air 1-C: MM AIR 1-C: During operation, the following measures shall be complied with: • At project start, all heavy-duty trucks entering the property must meet or exceed EPA 2007 engine emission standards. • Beginning in 2015, all heavy-duty trucks entering the property must meet or exceed 2010 engine emission standards. • If the above clean truck requirements are infeasible, a phase-in schedule should be put forth that will feasibly achieve emission reductions as soon as possible, and the project proponent should consult with the SCAQMD on such phase-in schedule. Conclusion: Minor modifications incorporated in the MM/RP do not affect the Findings of Fact recommended for approval of General Plan Amendment No. 11-04, Tentative Parcel Map No. 19330 (Subdivision No. 11-02) and Development Permit 2 No. 11-04, as stated in the March 28, 2012 Staff Report. Recommended Action: the Mayor and Common Council adopt the Resolution to: I. Certify the Environmental Impact Report(SCH #201107017). 2. Adopt the Facts, Findings and Statement of Overriding Considerations. 3. Adopt the Mitigation Monitoring/Reporting Program. 4. Ian contacted the City of San Bernardino on April 11,2012 requesting a minor revision to Mitigation Measure AIR-1c.As per Ian's request, Mitigation Measure AIR-1c has been revised to include SCAQMD as a consultant in the event said clean truck requirements are infeasible. The following are revisions to the Draft EIR for the National Orange Show Industrial Project. These revisions are minor modifications and clarifications to the document, and do not change the significance of any of the environmental issue conclusions within the Draft EIR.All additions to the text are underlined(Underlined) None of the analysis or conclusions in the narrative text that follows the enhanced mitigation constitute as significant new information as identified within State CEQA Guidelines§15088.5 and therefore do not require recirculation.
