(FINAL READING). Financial Impact: None. The hearing was opened on June 18,2012. Motion: Adopt Ordinance. Synopsis of Previous Council Action: None. Background: On May 23,2012, the Planning Commission unanimously recommended that the Mayor and Common Council approve Development Code Amendment No. 12-03 (DCA 12-03) to allow electric fences in Industrial and Commercial land use districts up to 10 feet in height within the setbacks,and 16 feet in height in Industrial land use districts outside of the setback. DCA 12-03 also discussed the use of barbed and razor wire as acceptable fencing materials,which the Planning Commission did not support. On April 17, 2012, the Legislative Review Committee (LRC), met to consider a request by a private electric fence contractor ("Electricguarddog.com") to consider whether to allow electric fences to be installed in the City of San Bernardino. The fence contractor noted that they had been approached by several property owners in the City about installing electric fences, to prevent theft of materials, especially those stored outside. The fence contractor proposed a low- voltage (12 volt) wire fence that would be installed behind a standard fence, with a four-inch to 12-inch separation between the two fences to reduce the probability of someone touching the Oelectric fence. The contractor also noted that the electric fence needed to be at least 10 feet in height,to prevent someone from standing on the outer fence/wall and stepping over the electric fence. In discussing the matter, Committee Members noted that since barbed wire and razor wire existed in the City, these fencing materials might also be appropriate. The Chairperson pointed out that such materials provide a negative image for the City. Fence height was also discussed by Committee Members. The contractor asked for a 10-foot high electric fence, stating that the additional height was necessary to prevent somebody from standing on the fence located in front of the electric fence and stepping over the electric fence. The LRC voted to provide staff with direction to prepare an ordinance to allow the installation of electric fences up to 10 feet in height, along with allowing the use of barbed and razor wire as acceptable fencing materials. The fence contractor provided fence standards for the following California jurisdictions that allow electric fences: Bakersfield, Sacramento, Sacramento County, Salinas, San Jose, Santa Maria, Stockton and Sunnyvale. However, these Municipal Codes were only presented if the Ojurisdictions allowed electric fences, and the standards were not presented for other fencing materials or maximum fence heights. To subjectively provide data regarding where electric fences and barbed/razor wire fences are allowed in addition to maximum fence height standards, staff surveyed the development standards for San Bernardino County, 14 cities in the County, and the cities of Riverside and Corona, to determine their fencing requirements. Staff chose these jurisdictions, as they are located adjacent to, or near the City of San Bernardino (or are located in San Bernardino County) and similar to the City, rather than being from outside the area. The results of this research are provided below. ELECTRIC FENCES 1. Permit Required. No electric fence shall be installed or used unless a Fence Permit has been applied for and obtained from the Community Development Department. 2. Type of Electric Fences Allowed. The construction and use of electric fences shall be allowed in the City only as provided in this section and subject to the following standards: a. IEC Standards 60335-2-76: Unless otherwise specified herein, electric fences shall be constructed or installed in conformance with the specifications set forth in International Electrotechnical Commission(IEC) Standard No. 60335-2-76. b. Electrification: (1) The energizer for electric fences must be driven by a commercial storage battery not to exceed 12 volts DC. Updated:6/28/2012 by Sabdi Sanchez E 1867 (2) The electric charge produced by the fence upon contact shall not exceed energizer characteristics set forth in paragraph 22.108 and depicted in Figure 102 of IEC Standard No. 60335-2-76. 3. Conditions for Installation. a. Perimeter Fence or Wall: No electric fence shall be installed or used unless it is completely surrounded by a non-electrical fence or wall that is not less than six feet high. b. Location: Electric fences shall be permitted only in non-residential zones and only in locations approved by the Community Development Department. { C. Height: Electric fences shall not have a height in excess of 10 feet in commercial and industrial setback areas and shall not have a height in excess of 16 feet outside of the setback areas on industrial properties. d. Warning Signs: Electric fences shall be clearly identified with warning signs prepared in English and Spanish that read: "Warning-Electric Fence" at intervals of not less than 60 feet. e. "Knox Box": A"Knox Box Electrical Shunt Switch' and a"Knox Box" or other similar approved device shall be installed for emergency access of Police and Fire Departments. 4. Indemnification. All applicants issued permits to install or use an electric fence as provided in this Chapter shall agree, as a condition of permit issuance, to defend, indemnify and hold harmless the City of San Bernardino and its agents, officers, consultants, independent contractors and employees from any and all claims, actions or proceedings arising out Updated:6/28/2012 by Sabdi Sanchez E PacketPg_1131. i 1867 of any personal injury, including death, or property damage caused by the electric fence. 5. Emergency Access. In the event that access by the City of San Bernardino Fire Department and/or Police Department personnel to a property where a permitted electric fence has been installed and is operating, is required due to an emergency or urgent circumstances, and the Knox Box or other similar approved device referred to in this Chapter is absent or non- functional, and an owner, manager, employee, custodian or any other person with control over the property is not present to disable the electric fence, the fire or police personnel shall be authorized to disable the electric fence in order to gain access to the property. As a condition of permit issuance, all applicants issued permits to install or use an electric fence as provided in this Chapter shall agree in writing to waive any and all claims for damages to the electric fence against the City of San Bernardino and/or its personnel under such circumstances. 6. Violation; Misdemeanor. It shall be unlawful,and a misdemeanor, for any person to install, maintain or operate an electric fence in violation of this v Chapter. More specifically, the City of San Bernardino and the majority of the other cities surveyed (as noted in Tables I and 2, above), prohibit such types of fencing because common planning principles have demonstrated that it is unattractive and further,when a passerby views a property surrounded by barbed/razor wire and/or electrified fencing, the typical response is that the business must be located where crime is an issue. Further, the fencing contractor that originally approached the City about installing electric fences noted that businesses, such as 7.H.c Development Code Amendment No, 12-03 May 23,2012 Page 6 salvage yards, had requested to install such fencing. However, these types of businesses themselves may not be aesthetically pleasing. Therefore, staff is not in support of this request because installing such types of fencing in conjunction with these businesses could further exacerbate their situation, and the fencing would generally negatively impact the overall community and character of the City and its neighborhoods, in that the fence materials are unattractive and promote a negative and unsafe image, although if the electric fencing was limited to within the City's height limitation of 10 feet,it may be implemented in such a way that it does not distract from the City's aesthetics. u c m LL FINDINGS OF FACT v U GENERAL PLAN AMENDMENT w M 1. The proposed amendment is not consistent with the General Plan. N General Plan Land Use Policy 2.1.1 states: "Actively enforce development standards, o design guidelines,and policies to preserve and enhance the character of San Betnardino's neighborhoods." The proposed amendment has the potential to introduce electric fencing and barbed/razor a wire as allowed fencing materials. Additionally, these materials could potentially be N constructed at heights taller than currently allowed. As discussed above, the use of barbed wire, razor wire, and electric fences as appropriate fencing materials in principle, a is not aesthetically pleasing and when used on non-agricultural properties (i.e., around o commercial or industrial uses), is commonly associated with high-crime areas. Further, N, Industrial Guideline 9.13.4 states that barbed wire is a design element that is undesirable r and should be avoided. Therefore, the use of such fencing materials would not be consistent with the City's design guidelines and would not preserve and enhance the M character of the City's neighborhoods. N U 2. The proposed amendment would be detrimental to the public interest, health, safety, e convenience, or welfare of the City. M As noted in Finding 1, above, the installation of electric, barbed and/or razor wire fences w around businesses in the City would negatively impact the aesthetic value of the = surrounding neighborhood and promote a negative image for the City. Further, although the fence contractor who originally approached the City about allowing such fences in the a City noted that such fences are only charged with 12 volts of electricity, there is the possibility that a person or animal could be injured by the fence, potentially creating a E liability for the City. The same could be said for allowing the installation of sharp objects, such as barbed or razor wire where a person or animal could be injured through contact with the fence. Additionally, the fence contractor noted that an electric fence should be installed four to 12 inches behind another fence. This could result in a property maintenance issue, in that trash, debris and weeds would collect in between the fences, with no access to maintain the area between the fences. This Development Code Amendment would also result in two fences of varying, and possibly additional,heights (i.e.,the fence contractor noted that electric fences should be taller than the fence they are Packet Pg.,1 l44' Development Code Amendment No, 11-03 May 23,1012 Page 7 placed behind to preclude somebody from climbing over the electric fence) potentially installed adjacent to property lines and/or along public rights-of-way. Therefore, the proposed amendment would be detrimental to the public interest, health, safety, convenience and welfare of the City. FINANCIAL IMPACT m There could be a negative financial impact due to increased Code Enforcement activities regarding the maintenance of the areas between two parallel fences on a property; however, this v may be equalized because Code Enforcement action on existing, illegally installed barbed wire fences would no longer be required. The City may be subject to litigation should a person be S injured by electric, barbed or razor wire fences that the City permitted. As noted in Findings 1 m and 2, above, the use of electric, barbed and razor wire as fencing materials generally sets a M negative aesthetic and safety image for a community. This in turn, could negatively impact N property values and the revenues collected by the City from the property taxes and any resulting a loss of business by patrons who choose not to conduct business in an area they feel is not safe. The use of barbed wire, razor wire and other similar materials is prohibited, unless deemed necessary for safety by the director. 4. Long expanses of fence or wall (fifty or more feet in length) adjacent to a public right-of-way shall have offset areas(decorative pilasters or a jog in the wall) of a minimum of three to four feet along its length and shall be architecturally designed to prevent monotony. , m E. Unsafe areas. A six-foot high wall or fence shall be constructed along the perimeter of all areas determined by the director of community development, the building official, or the city engineer, to pose a danger to the public health or safety. 3. Swimming pools. `w a. Areas surrounding a swimming pool shall be fully enclosed by a minimum five-foot high nonclimbable fence. b. All entrances and exits from an enclosed swimming pool area shall have a self-closing, self-latching closures installed.
