HomeMy WebLinkAbout2012-136 1 RESOLUTION NO. 90 1 9_136 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1005, 3 LANDSCAPING MAINTENANCE DISTRICT, CAJON BOULEVARD AND PEPPER 4 LINDEN AVENUE (CAMPUS PARKWAY)AREA. 5 WHEREAS, by Resolution No. 91-466, the Mayor and Common Council found that 6 the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and S WHEREAS, by said Resolution No. 91-466, the Mayor and Common Council 9 formed an assessment district known as Assessment District No. 1005 for the purpose of 10 11 providing landscaping maintenance in the Cajon Boulevard and Pepper Linden Avenue 12 (Campus Parkway) area, pursuant to the provisions of Chapter 12.90 of the San Bernardino 13 Municipal Code; and 14 WHEREAS, by Resolution No. 91-434, the Mayor and Common Council declared 15 that all the land included within the boundaries of said district receive a special benefit by the 16 17 maintenance of said landscaping; and 18 WHEREAS, said Resolution No. 91-434 declared that an annual assessment shall be 19 levied on all land within the district to provide funding for said landscaping maintenance and 20 the administration thereof; and 21 WHEREAS, an Assessment Roll has been prepared totaling $20.294.94, which sets 22 23 forth the individual assessments to be levied on each of the parcels of land within Assessment 24 District No. 1005 for the fiscal year 2012/2013; and 25 WHEREAS, Article XIII D of the California Constitution requires that any and all 26 Assessment Districts existing on the effective date of said Article X111 D shall comply with 27 the procedural and approval process as set forth in Section 4 of said Article XIII D, except as 28 2012-136 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT 1 ROLL FOR ASSESSMENT DISTRICT NO. 1005, LANDSCAPING MAINTENANCE DISTRICT, CAJON BOULEVARD AND PEPPER LINDEN AVENUE(CAMPUS PARKWAY)AREA. 2 3 set forth in Section 5 therein. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. That the Mayor and Common Council do hereby find and determine 7 that the assessments as set forth on said Assessment Roll No. 1005 are hereby exempt from 8 9 the procedural and approval requirements of Article XIII D of the California Constitution, as 10 provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set 11 forth on said Assessment Roll are equal to or less than any prior approved assessments. 12 SECTION 2. That the Mayor and Common Council do hereby find and determine 13 that the proportionate costs to be levied against the parcels of land within Assessment 14 15 District No. 1005 are correctly set forth on Assessment Roll No. 1005, for the fiscal year 16 2012/2013, on file in the office of the City Clerk of the City of San Bernardino, and do 17 hereby confirm said assessments. 18 SECTION 3.
