Financial Impact: The total dollar amount to be awarded to McCray Enterprises for the replacement of fuel injectors on emergency vehicles is not-to-exceed$34,522.32. Funds to cover this cost were included in the Fire Department's FY 2011-2012 Budget,account number 001-200-5704-0000- 0050 (Miscellaneous Equipment) in the amount of$30,000. As a result of the unit price of the bid(under$5,000 per unit), funds will need to be transferred from account number 001-200- 5704-0000-0050 to account number 001-200-5173-0000-0050 for the issuance of a purchase order. Account Number: 001-200-5173-0000-0050 Budgeted Amount: $41,000 Balance as of November 16,2011: $10,627.37 Balance after approval of item: $6,105.05 (with budget amendment) Please note this balance does not indicate available funding. It does not include non-encumbered reoccurring expenses or expenses incurred,but not yet processed. Motion 1: Adopt Resolution; and Motion 2: Authorize the Director of Finance to amend the Fire Department's FY 2011-2012 Adopted Budget to reflect the expenditures as outlined in the staff report. Synopsis of Previous Council Action: None. Background: Currently, 12 fire engines are experiencing leaking fuel injectors. The fuel is leaking through the injector bodies and entering the crankcase, thus diluting the engine oil. This condition is �s Updated: 12/1/2011 by Linda Sutherland E Packet Pg. 94 1306 detrimental to the internal combustion engine because it causes failure to the main bearings and connecting rod bearings,ultimately causing the engine to seize. This seizure occurs when the oil viscosity becomes diluted with fuel to the point where it loses its lubricating qualities. In addition, a secondary issue this condition causes is the flash point in the crankcase is raised and it has been proven to cause the lower part of the engine to explode. When the fuel was discovered in the oil crankcase, the approach to prevent the internal combustion engines from being damaged was to change the oil on a hyper frequent basis. This practice has reduced the potential of damaging the engines, but has caused the apparatus to be out of service more frequently and not available for front line use. ht addition, fire suppression crews are taken out of the assigned district more and rendered out of service in order to change out into a reserve apparatus resulting in increased response times. Thus, on August 24,2011, a Request for Quote (RFQ) #F-12-02 was issued to solicit formal bids for the replacement of fuel injectors on emergency vehicles. Notices inviting bids from qualified vendors for the replacement of fuel injectors on 12 emergency vehicles were distributed to the San Bernardino Area Chamber of Commerce, the City's Web Site, and advertised in The Sun Newspaper. The RFQ #F-12-02 packages were mailed to 5 vendors including 2 local vendors within the City limits. On September 8, 2011, the City received and reviewed 5 bids and the bid responses are as follows: Vendor Location Bid Proposal Global Power Group, Inc. Lakeside, CA $59,844.00 Johnson Power Systems Riverside,CA $42,451.20 Colton Truck Terminal Garage Colton,CA $37,251.36 McCray Enterprises San Bernardino,CA(County)$34,522.32 Valley Power Systems, Inc. Industry,CA $31,011.12 To accomplish the necessary work, City staff recommends McCray Enterprises. McCray Enterprises is the only vendor who is local which will allow the City to eliminate most of the salary and fuel costs necessary to transport the fire apparatus to and from an approved repair shop that is outside of the local area. Additionally, a local repair shop will be much more efficient for future repairs and adjustments that will be needed on the fuel injectors. The San Bernardino City Fire Equipment Maintenance shop is minimally staffed and it is very important to utilize vendors who are local and bid competitively to afford the mechanics as much efficiency as possible. After analyzing fuel costs, labor costs, and the number of hours it would take for the Fire Department shop mechanics to transport the fire apparatus, it was determined that the difference in the bids between the low bidder and McCray Enterprises is negligible. Pursuant to the City's purchasing system,it is recommended that the City award a purchase order to McCray Enterprises for replacement of fuel injectors on emergency vehicles per RFQ #17-12- (w� 02 (Exhibit A). CITY OF SAN BERNARDINO—MCCRAY ENTERPRISES This Purchase Agreement is entered into this 5th day of December, 2011,by and between McCray Enterprises("Vendor's and the City of San Bernardino ("City"or"San Bernardino"). WARRANTY. a Vendor expressly warrants that all products and services supplied to City by Vendor under this Agreement shall conform to the specifications, drawings or other descriptions upon which this purchase is based, shall be fit and sufficient for the purpose intended,and shall be merchantable, of good material and workmanship, free from defects and free and clear of all liens or encumbrances. Inspection,testing,acceptance or use of the goods by the City shall not affect Vendor's obligations under this warranty, and such warranty shall survive inspection,testing, acceptance and use. Vendor agrees to replace, or correct promptly,defects of any goods or services not conforming to the CITY OF SAN BERNARDINO—McCray Enterprises I PURCHASE AGREEMENT foregoing warranty without expense to the City,when notified of such nonconformity by City. "Reasonable notice"for purposes of this section shall not be deemed to require more than 60 calendar days' notice before commencement of efforts by the City to effect cover or a cure except upon written agreement of the Parties. 5. INDEMNITY. Vendor agrees to and shall indemnify and hold the City,its elected officials, employees, agents or representatives, free and harmless from all claims, actions, damages and liabilities of any kind and nature arising from bodily injury, including death, or property damage, based or asserted upon any "- actual or alleged act or omission of Vendor, its employees, agents, or subcontractors, relating to or in d any way connected with the accomplishment of the work or performance of services under this w Agreement, unless the bodily injury or property damage was actually caused by the sole negligence of the City, its elected officials, employees, agents or representatives. As part of the foregoing indemnity,Vendor agrees to protect and defend at its own expense,including attorney's fees, the City, its elected officials, employees, agents or representatives from any and all legal actions based upon such actual or alleged acts or omissions. Vendor hereby waives any and all rights to any types of express or implied indemnity against the City, its elected officials, employees, agents or o representatives, with respect to third party claims against the Vendor relating to or in any way w connected with the accomplishment of the work or performance of services under this Agreement. r U 6. INSURANCE. a' While not restricting or limiting the foregoing, during the term of this Agreement,Vendor shall o �✓ maintain in effect policies of comprehensive public,general and automobile liability insurance,in the amount of$1,000,000 limits,and shall file copies of said policies with the City's Risk Manager prior R to undertaking any work under this Agreement. NOTICES. ASSIGNMENT. Vendor shall not voluntarily or by operation of law assign,transfer, sublet or encumber all or a any part of the Vendor's interest in this Agreement without City's prior written consent. Any o attempted assignment,transfer, subletting or encumbrance shall be void and shall constitute a breach of this Agreement and cause for termination of this Agreement. Regardless of City's consent,no N subletting or assignment shall release Vendor of Vendor's obligation to perform all other obligations g to be performed by Vendor hereunder for the term of this Agreement. VENUE. r The parties hereto agree that all actions or proceedings arising in connection with this M Agreement shall be tried and litigated either in the State courts located in the County of San o Bernardino, State of California or the U.S. District Court for the Central District of California, $ Riverside Division. The aforementioned choice of venue is intended by the patties to be mandatory and not permissive in nature. v 13. GOVERNING LAW. z This Agreement shall be governed by the laws of the State of California. 14. SUCCESSORS AND ASSIGNS. This Agreement shall be binding on and inure to the benefit of the parties to this Agreement and their respective heirs,representatives, successors,and assigns.
