Motion 1: Adopt Resolution; and Motion 2: Authorize the Director of Finance to amend the FY 2011-12 Budget and appropriate $200,000 from the General Fund's undesignated/unreserved fund balance to Account No. 001-030-5502-0000-0009 (Elections - Professional/Contractual Services). Synopsis of Previous Council Action: June 6, 2011 - Resolution #2011-112 was adopted requesting that the City's Primary Municipal Election be consolidated with the Consolidated Election conducted by the County of San Bernardino. Background: Elections Code Section 10002 provides that the governing body of any city may by resolution request the County Board of Supervisors to permit the county elections official to render specified services to the city relating to the conduct of an election. The City's primary municipal election held on November 8, 2011, was conducted by the Registrar of Voters Office. Seven City offices were up for election. In all races but one a winner emerged in the primary election. There were five candidates vying for the Office of City Clerk and no candidate garnered sufficient votes to win in the primary election. Section 10 of the City Charter states, in part, "...a general election shall be held in said City on the first Tuesday in February of the following even numbered year for the election of City Officers. ..... In 2009, the City's Municipal Code was amended to allow a run-off election to be conducted as a mail ballot election, pursuant to the provisions of the Elections Code. The City has had two mail ballot elections -- in 2009, the City had a mail ballot election in the Fourth Ward, and this year, the City had a mail ballot election in the Second Ward. The City has not had a citywide election conducted by mail ballots. No funds were allocated in the current budget for a run-off election. Consequently, to minimize the costs of conducting the run-off election, staff recommends the Mayor and Council authorize a run-off election to take place on February 7, 2012, that such election be conducted as a mail ballot election, and that funds be allocated for the estimated cost of this required election. The Registrar of Voters Office has estimated that a run-off election will cost approximately $200,000 versus an estimated cost of$300,000 for a traditional,go-to-the polls election. Should the Mayor and Council approve conducting the run-off election by mail ballots,there will be two satellite locations where voters can drop off their voted ballots on Election Day, one at the County Registrar of Voters Office, 777 East Rialto Avenue, and another site at a location to be designated. As authorized by Section 10002 of the 0 Elections Code of the State of California, the Mayor and Common Council request that the 0 u Board of Supervisors of the County of San Bernardino permit the County Registrar of Voters to m m furnish services and supplies to this City for the General Municipal Election to be held on c February 7,2012. A iu SECTION 2. Conduct of Election. Pursuant to Section 2.56.170 of the San Bernardino c c� Municipal Code, the General Municipal Election so called shall be conducted by all mail ballot a° with two polling places located as shall be determined by the City Clerk and the Registrar of e 0 Voters of the County of San Bernardino. The Board of Supervisors of the County of San d z Bernardino is hereby requested to issue instructions to the Registrar of Voters to take all steps o v necessary for the holding of the General Municipal Election. The polls for said election shall be ° 0 open at 7 a.m. of the day of said election and shall remain open continuously from that time until ` 8 p.m. of the same day when said polls shall be closed, except as provided in Section 14401 of z V the California Elections Code. The Mayor is authorized to execute a contract for the services necessary for conducting the General Municipal Election. The City of San Bernardino recognizes that additional costs will be incurred by the County by reasons of this election and agrees to reimburse the County for such costs.
